Just a couple of thoughts. Is this "former" consular officer writing a book? How much of a stink did he raise about the issue when he was getting paid with our tax dollars? Most important[at least to me] what percent of the visa applications are indeed fraud? IMHO until the government gets serious about the illegals already here, trying to focus on potential future subjective acts by people following the rules means nothing. The red flags like age difference, money even common language wouldn't mean anything if people were already here. For that matter if we go to China and marry there, the same should apply. Either no visas at all or accept the fact that human nature says a certain percent of people will scam the system for monetary gain and focus on them. Here's a thought, how about bringing back home visits after arrival? Too expensive, we'll just slow down or deny petitions in the first place that will weed out frauds. This isn't about pink versus blues or whites. It's about info. Read and take what you will from it. Some of the nicest people I know are pink -

When my wife [fiancee at the time] went back with RFE stuff for the blues we got she was never interviewed again. She dropped off the stuff and they told her to come back in 2 business days for the results. -
HKG, Make sure you add that "subjective" part from the denial notes in your rebuttal letter. That part was worth a half of a page for mine After they cite they don't do it, they say how they did it.

Bryon_Tran, Remember you are dealing with TWO separate government agencies. They look at the petition from different views and look for different things. USCIS has already approved the petition, otherwise it wouldn't be in the position for a consulate to deny. This is the point that gets "tricky". Theoreticly the petitioner is afforded an opportunity to respond to the VOs negative finding. When the petitioner dosen't follow through the denial stays on the record. IMHO if you refile another petition for the same type of visa, unless you can find the reason for the first denial and address them, you may be denied again. -
Mike, You just made me think of something! I should get a visa at the same time. I should be able to get one for 30 days valid for a year, right? I'm sure the economy will be all great by next Spring Festival. PuYang here we come.

Just printed out the Chinese instuction sheet. Wife says "I know" so we get to do a road trip. Lee, the wheel was around long before me, now the internal combustion engine.....

I'm not mensa, but I didn't ride the small bus either. Anybody done this in Chi-town recently? I couldn't get any info on the consulate website about it, they were more geared to getting visas for China. We've got a few months till the old one expires and no trip planned soon, but I'd like to stay on top of it.

Certificate license it's all the same. Go to your county court house [or what ever government office recorded the marriage] and get a few copies of the license. -
They each get their own. You will need them later to adjust status[AOS]. Try to pull up a blank sample in the forms section and print a sample so they know what to expect. It's easy and straightforward. My wife copied from someone on the flight and put down the same address in Chinatown they did. The joke was on her, she ended up 40 miles away in suburban sprawl. It didn't matter when we filed AOS.

Just MHO, proceed. Everything economic wise will be based on three year average. I know people will point out that's not what you have to file now, but in the end that's what it'll boil down to. Instead of the letter of employment you might try drafting a letter yourself listing employment history and salaries, kind of like a cover letter for your resume. You can't be the only person this has happened to. I say get the ball rolling ASAP. As you noted, the worse the can happen is a request for info. Sidebar, Lake Side Inn is in my extended family. I'm the black sheep side so I've only been a few times, but it was a sweet area a few years back.

ZackinIL, I haven't done it personally, but I believe you must be married and the wife must petition for her visa. AP for her doesn't take all that long[compared to the K-1ordeal ]. -

griz, Don't think you'd be able to do it from where you're at but the wife gets prepaid phone cards from chinatown. She loads up on them like crazy. -

Just got caught up on this thread. Post 24 brought up the same thing I was told when wading through the NOID stuff. Perfect logic by GUZ. If money[visa fraud] IS involved the parties will give up. Only legit couples will keep at it, right? IF the petitioner stands to make 30 or 50K one would think there is MORE incentive to keep at it. -

Don't worry about the K-1 expiring. That only means you must get married in the 90 days. "They" won't come looking for her on the 91st day. As long as you file the next round of paperwork in a reasonable amount of time, you'll be fine. -
