  1. Others have had to sign the "sworn statement" (that you still live together, and she hasn't been arrested), including one who got theirs by mail. Watch for that. Congrats and good work! We all appreciate it.
  2. My recommendation is for everybody to do their own translating through Google or Babelfish or wherever. That is, he write to her in English, and she write to him in Chinese. Then each can put it through the translator, adding periods or commas or separating phrases where it may help, until they can figure out the meaning. Otherwise, you're just talking to the translator ABOUT the other person. BIG difference.
  3. Unfortunately, the odds are poor enough that some people give up after a few tries. We've heard stories that the odds may be improving. After the interview, of course, it's either one or zero.

  5. I guess the best way to minimize the time is to have all the documents for the P3 filled out and send them in as soon as you know the P3 is shipped to you. This method can shorten the total time some. There is no guarantee that sending in the P3 forms early will improve your place in line. Of course, it's can't hurt, either, unless you send them in TOO early (say before you're CERTAIN that they've mailed it out). A few years back, our person who monitored these things found statistically that the date they mailed the P3 was significant, while the date they received the filled-out forms was not

  13. Yes he can. Since you married before your son reached the age of 18, your husband may file an I-130 for the child of an American citizen. The CR-2 takes approximately a year. He will need a birth certificate, the passport, and either a divorce decree awarding you full custody, or permission from the birth father to bring him to the US

  15. 1) Have your wife file the I-130 for her son NOW. Waiting time for (over 21) son of an LPR is approximately 10 years. 2) Have her become a US citizen. Waiting time for the (over 21) son of a US citizen is closer to 5 years. AND the clock is running as of the day the original I-130 is filed.
  16. If they don't comply with the IMBRA law, then almost by definition they're not an IMB. I don't think we've heard of a case where the answer to the IMB question (whether yes or no) had an effect on the interview.
  17. I don't have my I-134 right in front of me but I believe we checked "Do not intend" as I believe this is refers to other visa applicants besides K-1/K-3. I could be wrong though. My wife's looking for our form at home now. I'll update when she finds it. Edit: Ok, I was right and wrong. We didn't check either box. We put "N/A K-1 visa process for permanent resident." I assume this pertains to K-3 as well. If not, someone (Dan or David) will correct me.   23. Randy, Thanks for your response and please understand that my reply is not directed at you personally. i have been pissed off for about 1/2 dat since seeing your repsonse. In the 2/4/08 memo, USCIS comitted to an oldest first policy. Sorry - I should have mentioned that our name check may have been completed before Dec. The IO said it had been sitting on her desk for 2 months while she was out of town. I understand - I wouldn't mind waiting for yours to go first, but I think we all take what we can get. Hopefully, they'll get yours soon.
