  1. Sometimes a letter like this can raise a question where there is none. All they need to show is that she is NOT married. If the marriage shows up anywhere, they need the divorce certification.

  3. Once she is an LPR, she can file an I-130 to bring him here. It will take around 10 years, or 6 years if she becomes a citizen.

  6. You need proof of income. It seems like you're saying that the tax return includes it in the Adjusted Gross Income. If you have 1099's, and/or check stubs, or any kind of statement (deposit slips or bank statements) to show the deposit, that's additional proof. If your provable income is above the 125%, you're fine. It wouldn't hurt to have all 3 years available. With the I-184, what they ask for varies - sometimes they don't look at it at all.
  7. Washington State was the first to be approved by homeland security for enhanced DL. I see this as not a problem, when DHS anounced this a few years ago it caused many residents of NY state who travel to and from Canada to complain, they never travel overseas and never bothered with the high cost of a passport just to visit Canada, this will save US citizens living in NY the big pain of applying for a passport or passport-card, just to visit Canada. If that is the case, then we're only making it easier for anyone to cross our borders. The state of New York would basically take over some of the functions of the DHS.   8. Show bank statements, deposits, and check stubs. A long as their income (combined with yours) is above the poverty line, you're okay. If they can separate their income (use check stubs/deposits for one parent), then only one need file as long as they received enough income.
  9. You have a LOT more faith in those guys than MANY people on this site. It's doubtful that they would have the resources to adequately investigate any TPC, but they DO take them seriously.

  13. I would read everything over very carefully to figure out what you are not understanding. 7 1/2 hours per week is not full time. Salary is annual, not monthly. Did he submit tax returns? "Prospects for future employment and advancement" sounds like they think someone doesn't have a full time job.

  16. No worries - just make sure that it doesn't hit the 2 year expiration date. The K-1 is single entry, so AP is necessary, But not the K-3.
  17. I understand - my point was that all it takes is for the VO to utter those words - and stick to them - and perhaps they should have cameras to record each interview.

This, in itself, is irrefutable evidence (in a legal sense) that you do NOT have a valid relationship - never mind that it was dreamed up by a single VO (who made a good case for taping the interviews). The USCIS may not do anything with this (especially if they don't provide any more information than they gave you), or they may schedule a hearing to revoke the petition. BE SURE TO WATCH YOUR MAILBOX in the states (wherever they would send the hearing notice), in case they decide to do anything. You do not need to do anything unless you hear from them. And I'm sure you'll keep us up to date here.

  22. You don't say his age, but if her son is under 18, you may file the I-130 now, or after he arrives on the K-4. Make sure that he is under 21 when you file it, however, since 21 and over is a different category with a much longer wait. If he was 18 or over when you married, he may not be able to adjust status from the K-4. If he was under 18 when you married, no problem.
  23. Someone who knows the CR/IR2 fees can answer your questions, but IR2 means you are saving the cost of removing conditions - he will get a 10 year card when he arrives.
  24. Not true, Darnell. When you're cleared through customs in Canada for the US, you're cleared through customs - once. Never twice. It's like a domestic flight from there.
