  2. David - re-read his post there - they're waiting for the visa to arrive at the post office. This is yet another cruel twist of the knife by the consulate, especially for those people who are unable to wait for the visa. We've had petitioners who can't wait more than a couple of days in Guangzhou, and I'm sure beneficiaries who need to go back to their hometown. Couples are being separated one more time before they can go back to the states. All because of this cruel new policy.
  3. Thanks for the advice jim, I will look into that. Depending on the outcome, I suppose that we also have the option of doing a K-2 to follow. The boy lives with aunt and uncle (my SO's side) in Harbin and he is now 15, so if push came to shove, that might be a possibility. K-2's must use their visa within one year of the mother's entry date. So a K-2 follow-to-join at 18 wouldn't be possible (unless the mother's visa was also delayed by a couple of years). You can, however, file an I-130 for an IR-2 visa for your step-son (son for immigration purposes) after he becomes 18. Processing time for this would probably be well under a year. He would most likely be here before his 19th birthday.

  7. This person flat-out LIED to you. Call a supervisor, or go to another office. But when you apply for AOS, the EAD application is free. In my opinion, this is VERY important. DON'T pass it up. Just my opinion The 'temp SSN' is actually an ITIN Taxpayer Identification Number - not good for anything except the IRS

    This is NOT a good rumor to start, without a few more sample points. You won't have far to go. however. Almost every one of us (along with our SO's) have been divorced at least once.
  10. Sometimes they will reference an old application when processing a newer one. I've seen this also - the timing was close to what you might expect with regards to the newer application (I-751 in your case)

  15. This is pretty much why they issue the "Not a Valid Relationship" finding. It is not possible to challenge this finding by a VO. GUZ is a legal entity in its own right which follows its own rules and poliicies (based on the 9FAM). No lawyer can do anything more than rely on good will from the consulate. They are not going to haggle over anything that may or may not have been in the original petition. You need to create the impression of a valid relationship, not present a legal case. Yes, I'm a believer in front-loading the petition, as it's been called. Just watch the overall mood - that you're presenting a valid relationship - not challenging legal issues.l
  16. Yes - the only other application is the AP I-131. There are no biometrics for it - it just uses the passport photos that you submitted.

  18. Removing the restrictions is optional, unless her employer doesn't like to look at it. Sit back and relax, immigration-wise, for a couple of years.
  19. He will be assigned one when he applies for AOS. Watch for the I-797C receipt.
  20. As a K-1, she will not need a visa number. She can file for Adjustment of Status as soon as they are married. She MUST go the "green card route", or leave the country. It will most likely take less than 1 year. As soon as she gets her green card, she can file the I-130 for her over 21 son. She does not need to wait until she becomes a citizen. the application will be upgraded to son of an American citizen when she does. The son must wait for an available visa number. This will take about 10 years, but only 6 years if she becomes a citizen in the mean time. He MUST NOT GET MARRIED while she is an LPR. He CAN get married after she becomes a citizen, but it will delay his application by a couple of years. Check the Visa Bulletin
  21. Honesty is the best policy. Verbosity is not. They need to know she's divorced, but a sentence about the common law marriage (and when) should be enough. And, yes, that short period between the "divorce" and a new marriage may catch some notice - so an explanation there may help. I hate to suggest this, but you might even consider waiting a bit before filing the I-129F Then again, I think we've had members who have done exactly what you're doing (filing immediately after a delayed divorce) (jim_julian)

The Chinese situation is a dam of unknown stability created by the earthquake, forming a lake 1000's of feet above the valleys where people live. For an example of what can happen when the dam breaks - Estes Park in 1982 Of course, if the dam holds, the river will just fill up the lake and flow over the top just like it used to.
