  1. Carl's right - they would be legally married. If he puts what he told them down in writing, I think they have a very good case. If he only says "Not a Valid Relationship", it'll get the same treatment everyone else does. VO's don't have the option of defining their own marriage laws.
  2. VO's deciding who can or should get married? That's a new one. Perhaps they need to send him back to the US to campaign for laws that are more in line with his viewpoint.
  3. Yes - but the son will need an I-130 sooner or later. You may file two I-130's now - one for the mother, one for the son - and go the CR-1/CR-2 route. If you go the K3/K4 route, you will file an I-130 for the mother now. Then, when you get the I-797 receipt, file an I-129F for the mother only. List the son, like Tom points out. The mother's I-130 will most likely be approved while you are waiting. The son will submit his own P3 and P4 paperwork - this is the only paperwork that needs to be submitted for K-4. Then, when they both arrive, within two years, file an adjustment of status (I-485) for the mother and a separate I-130 and I-485 for the son. If the I-130 for the mother has still not been approved, write "pending" in the blank that asks about it. So the son gets an I-130 either now, or upon arrival. But if you go the CR-1/CR-2 route, you avoid having to apply for AOS.

The IO at the AOS interview will already have the I-693 from the GUZ medical exam. In fact, your SO carries all the paperwork from GUZ to the IO at the Point of Entry in another sealed envelope is for the vaccinations. This part only (on a new I-693) will be filled in by the US Civil Surgeon. He will give you a sealed envelope with the new I-693 in it. Your AOS file will contain 2 I-693's = one from the medical exam in China, and one from the US Civil Surgeon for only the vaccinations.
  7. There are very few lawyers in the US who can tell you anything about Chinese law (or the reality). It's very likely that if she doesn't want you to see your child, you won't be able to.
  8. we havn't had the medical exam yet as i am trying to plan ahead for aos. we have received the p-4 and several medical forms, but no 693. apparently the consulate doesn't use the 693. The I-693 is furnished by the exam clinic, and is a required document for all visas
  9. You may have some explaining to do at the interview if you take longer than 6 months, but there are many of us who took 90 days to 6 months, and even a year.

  13. thanks for the reply. please correct me if i'm wrong but isn't it a new requirement to file out the i-693 and include it with the aos app? the 693a vaccination supplement is no longer listed on the forms page of uscis. it says to only have the vaccination section filled out on the 693 if you have had medical within the past year. i think they recently revised the 693 to include vaccination info and discontinued the 693a supplement. is this correct or am i confused again? You are not only correct and confused, but you are in 100% agreement with what he said and confused.   15. The 2 yr card is ALWAYS good for returning to the US no matter where you go, but it is valid for travel only to those countries that recognize it. Fortunately, Canada is one of them.

I think pinyin is the most popular input method, but anyone who went to school during the Cultural Revolution would not have learned that in school. There are also encoding methods that professionals use for speed - but they have to memorize a code for each character. I bought my wife a computer fairly early on - this is a very good investment. She had someone set it up. Kingsoft and other programs work in the way you describe. I doubt that she would be able to install any software on a computer at a netcafe - she would probably have to use whatever they had
  17. No - Babelfish and any Windows program accepts Chinese characters by whatever input method, including character recognition (the only one my wife knows). She can buy a writing pad with character recognition software for under $10.
  18. #1. DITCH THE INTERPRETER. It's a world of difference when you're talking with her, rather than the interpreter. Use babelfish to translate her IM's to you, she can use whatever tool at her end to translate yours to her. She's probably not very far behind my wife (now)
  19. If you send RMB, I think you get Western Union's exchange rate. If you send dollars, they are able to get a better rate at the other end. I believe it's the Agricultural Bank of China. In addition to China Post, that acts as an agent.

  24. The I-485 instructions say: The general consensus is that 90 days is best, 1/2 year is just fine, up to 1 year may be okay. Just get it in.
  25. I don't think this is accurate. The instructions for the I-693 on the USCIS website have a FAQ which states the following: Here is the link http://www.uscis.gov/files/form/I-693instr.pdf Read questions 1-3 in section III FAQ This form, is dated June '08. The instructions for the I-485 AOS list only the K-1 and K-2 (as not needing a new exam if the old is less than 1 year), however. This form is dated May '08. I would say let them ask for it if they need another one.
