  1. Hi AmericanWoman, You can only file for wife/husband not fiancee. The ones filing for wife/husband have to get an Individual tax number if they are not in the US or if they are in the US a SS number, and if no SS# then an Individual tax number. Tom and Ling

  3. I agree with C4Racer, if you think you have a red flag, provide it and an explanation to USCIS and your app gets to GUZ, then they can not use that against you and your spouse/fiancee. This still doesn't guarantee getting the visa, but success should be a little easier. Front load with letter of evolution of Relationship.... Tom and Ling
  4. Hi Jim, My wife Ling quite her job as a nurse one month after we got married so that she could take conversational English classes. I set up a reoccurring money transfer for her to her bank account. Do I think supporting your wife is important so she can quit her job to take English classes.......YES I do.....if you can afford it. One thing it gives a commitment to the relationship. Ling's english was bad.....so we bought a sentence translator, chinese to English...english to chinese. It cost between 250.00 US to 300.00 US. I also put in my Evolution of relationship for the I-129F of Lings intent to quit her job to take english classes as well as also about the money transfers....if you have already submitted your EOR than I did an update for her interview. I also made a statement in the EOR that our communication consisted of fair English as far as e-mails, writing on note book when we were together, and that when writing or questions became detailed we used the Sentence Translator. Tom and Ling PS: Frankly..Conversational English Classes in China..."are not very good"....so don't expect her to become fluent in English,,but it can help,,,However, at her interview...I went to ACH and said that my wife was nervous and wanted her interview in Chinese.....
  5. just tracked it and don't see anything going to Guangzhou, but i do see one going to Hong Kong... maybe it's too soon to track. It goes through Hong Kong first and than on to Guangzhou,,but if your package is more than 3 lb ...it will sit in customs for probably at least 2 months..in customs clearance. Tom and Ling

  7. Hi Bryon_Tran, At some US Embassy in different countries,,The Petitioner was allowed to attend the interview...you should find out if in Vietnam you would be allowed to attend the interview. I would go with K3..so that you would have the I-130 to fall back on. More visits, more pictures and of family. "The less you visit the better your fiancee's English has to be to pass, so her anwsers to the questions werent fluent enough." **I would not say that for sure...You are in a unique situation where for an interview she has to speak English because she can not speak Vietnamese. I would check to see if you would be allowed to attend the interview..I have seen other people in certain countries being able to attend. Tom and Ling You should fill out a time line and give a history of how and when and how long you two have known each other.

  9. Hi Rob and everyone, Yes, Peter has faded....have no clue where he is. The office in the Consulate building says he is still there, but after further questioning ..I got the feeling they were lying. These law offices in the consulate building are like sharks... I actually called the law office in the US and they told me that he has not been associated with them for five years. Than they gave me an e-mail address and have never gotten a reply. Tom and Ling So are you saying that Marc Ellis is a shark too or was this a general comment. Hi defendo, Marc Ellis as far as I know doesn't have an office in the consulate building and He is the only one "if he did have an office" that I would trust. My impression is that the law offices in the consulate building are feeding off blue and white slips. Tom and ling

  12. Hi, I hired Marc Elli attorney'soffice and he added more information on the new K-1. He interviewed me and my fiance, and wrote a letter with a new K-1, he said that was the reason, we were denied in our first K-1. I am confused..... ...Was it that Marc Elli office added more information or that he wrote a letter with the new K-1?? Tom and Ling
  13. No, I was divorced in 1999 and did not marry my wonderful wife until May 2007. The only red flag that is apparent is that my wife and I married a week after we met, then we traveled around China. Knowing what I do now, I would have waited to get married until just before I returned to the US. However I returned to spend time with her. I just don't get it. Hi defendo How long did you know your wife, before you and your wife married?? Also how long did you and your wife communicate before you went to China for the first time?? Sorry about the denial, but if you persist than you will probably win in the end..it's just going to take time. Tom and Ling Tom and Ling, That is the red flag. I did not meet my wife until my 2nd day in Chongqing and we were married a week later. But when I first looked into her eyes I knew that my life would be incomplete without her. Over the next 45 days we traveled in China and I know what is in her heart. Thanks for the support. Jay I think that the red flag is only part of it. I didn't meet my wife face-to-face until 3 days before we married. You've also spent more time in China in that one visit that I did in all 4 visits. Hi Yuanyang and defendo, I don't think it is the First visit and married in 3 days. I went to China on my first visit and married Ling 5 days later. For defendo...I can see that it would be a red flag if you went to China and you met and married in 2 to 3 days. As for Ling and I...we communicated by e-mail and snail mail letters for 7 months before I flew to China and married her. This is why I think...starting a relationship of about 6 months is so important in the beginning before one goes off and gets married...but that is "just my opinion".... all of us folks on CFL would like you to fill out a time line. The time line is so the folks can keep track of Visa processing. It is usually done in your signature file, and look at mine for an example or any of the other members. Tom and Ling
  14. Hi Darnell, I still have a question about filing an I-129F based on an I-130 that has been denied. My question is can one file an I-129F for K3, based on an I-130 that has a denial attached to it?? It would have to be in the system that the I-130 was denied. Or are you suggesting this because it has not been done before and has it been done before?? Just courious....... Tom and Ling

  17. Not really what I was saying at all. I just didn't want people thinking that by explaining away a short timeframe between a divorce and new engagement/marriage in the letter of evolution that GUZ was obligated to not take it into consideration just because USCIS had passed it on. Your post seemed to imply that to be the case. Maybe that's not what you meant. I agree that a longer "courtship" is probably better, but not necessary. It can often depend on what other potential "red flag" issues are in play. But the point is GUZ will look at them all, fairly or not. I think a short time frame between a divorce and a new engagement/marriage...is something that is going to raise GUZ's eye brows...no matter who approves the petition.   20. I wouldn't count on this being true. USCIS's job is to make sure you're techically eligible to file for the visa. It's GUZ's job to look deeper into the details. If they deem a short "courting" period after a divorce to be a red flag, they can issue a blue or white and cite any reason they want, including the all encompassing "not a bona fide relationship." To believe that including an explanation of why someone met and married or were engaged soon after a divorce in a letter of evolution provides some sort of immunity is giving one a false sense of security IMHO. Well, I am "not" saying that short courting or getting involved right after a divorce will be over looked by GUZ and Like I have always said that one should give a relationship at least 6months..."in my opinion". I am refering to things like how you communicate and such...but if you want to assume that anything you report to USCIS is over turned by GUZ...than that is your opinion. I just have mine... When you PMed me, I still think one of your reasons is totally unfounded. Because of the reason I gave you, but if the other reason was more of a red flag....that would still be a "pile of manure" for them to explain. Tom and Ling unfortunatly Guz plays by their rules and their rules only we had red flags many do, the key is to address them before the interview, be smart go to ACS + ACH talk get things put into file, met VO's, be like chinese make relationship. for all waiting or with white, take time prepare carefully, address concerns, make many visits to china, remember it is up to you to prove to them bonefide, why take chance its on your life together. i see that many that get blue or white on CFL are in past just silent members until get bad news, so maybe better members ask questions be true as to their past, then we can all help. remember you cannot hide from embassy so why hide here ? This is why..when you file a petition with USCIS that you give USCIS a letter of evolution of relationship...so that if USCIS approves than GUZ can not use what ever is in the "letter of evolution of relationship" against you. I addressed the language issue, told about my previous marriage and divorce, and explained about the marriage on first meeting Ling. USCIS approved everything,,so GUZ would have had to come up with some new issues. This is the reason front loading is important. "In my opinion"..... B) Tom and Ling
  23. Hi Missingyou, My own opinion about the time line to refile again. I have seen people on this web site who have gotten a denial and refiled so fast that they have not addressed the issues of the first denial. People can do as they please ,,and file immediately but if you do than the VO is going to see that you were "fast on the draw". "In my opinion only"..I think a relationship should be given minimum 6 months to develop and also "In my opinion only",,if you are denied than there should be about 6 months before another petition is filed again...if nothing else, to address the issues of the first denial.
