  2. Hi Phillip2, I hope your lawyer didn't screw up because if she did ...an I-130 will have to be filed for your step-son. Boy...if your lawyer screwed up..you would have only two options: option 1..would be file an I-130 for your step-son but it would have to go through one of the two Service Centers,,and finally get to NVC. option 2..would be file an I-129F for your wife's I-130..but you would still have to wait for it to go through the one of the two service centers. Neither option is good and would require much more time...Lets hope your lawyer didn't screw up.... Tom and Ling

  4. Hi Phillip2 Ok...I have gone through Direct Consular Filing with my second wife who is now my EX. She came with her self and two children. When I filed for her I had to file 3 I-130's and had to pay three Visa fees,,that was in 2000. Now as I understand it in 2008 (when it is not DCF) NVC handles everything and if one is going for CR1 and CR2 each person has to have an I-130 filed for them and a Visa fee is paid for each of the I-130. The I-130 for the CR2 can not come on his mother's Visa. The step son would come to the US on his own visa. Your lawyer should have filed two I-130's for your wife and for your step-son,,which should have been the 355.00 for each of the I-130's. Than the NVC would have sent two bills or two in one bill for the Immigrate visa Fee so there would have been a fee for 2 times $400.00,,so if your Lawyer is your agent than your lawyer should have the bill or your Lawyer needs to contact NCV and request the bill for your step-son. I am almost positive that your step-son can not come on your wife's CR1 Visa...Why??...because if children can come on the wife's CR1 visa ...I would have let my wife go with her I-130 and my two sons would have come on my wife's visa...but they can not ...so that is why I decided to go with the K3/K4 Visa. So bottom line...your lawyer has the bill or can call NVC and request the bill for your step-son. But no...your son can not come on your wife's CR1 visa. My step-sons just turned 13 years old. Hi Phillip, I assume (which I should not) that Since you filed an I-130 for your wife and an I-130 for your step-son you designated your lawyer as the person receiving the paper work from NCV,,so your lawyer should have the bill or paper work for your step-son,,or our lawyer should have the number to pay for your son.   6. So, you are saying I do not have to worry about sending in the OF 169 or the same as Packet 3 Supplemental Information sheet? I may be anil but I do not want an RFE and I want to be done at NVC.   7. Hi Shadowman, The reason they are moving your file to CSC is because Vermont is so overloaded that they transfer petitions from Vermont to CSC. I think you will keep your date of submission and it will probably move faster, but do not quote me on that. They did this once before moving petitions from Vermont to CSC about 2 to 3 months ago, but I don't know the out come. The people on VJ site may know. But Vermont is very slow. Tom and Ling
  8. Hi amanda, Thank you for your well wishes...... From the time I filed with Vermont to the Time Vermont sent it out was 5 and a half months. Also, I filed both an I-130 and a I-129F with Vermont. So I would expect that you probably have another one to two months to go for your petition clears Vermont or less. I think you should subscribe to the online USCIS because they will notify you when they send your petition to NVC. Tom and Ling
  9. Hi Phillip2, Just like dale7570 said....If you filed an I-130 for your wife and an I-130 for your step-son than you will have to pay the fee for your wife and the fee for your son. I am assuming that you filed 2 I-130's with the USCIS..Correct?? As far as the GIV, I would assume that it is the (well maybe I should not assume anything)...Which GIV is it??? And if you have time, than I would send the GIV to your wife because Chinese Characters are hard to do for an American...so maybe you should FedEx or DHL the forms to her and let her fill them out. Darn..... So if you are going to have your girl read it ,,do it at this time so if she has any questions ..you can explain to her the facts,,because it seems like the facts are lost sometimes on 001...just my opinion... Tom and Ling I hesitated telling my fiancee about the 001 website. I just imagine hundreds of Chinese woman spreading rumors of doom and gloom. I'd rather my fiancee keep a positive attitude going into the interview. Hi Steve, you most certainly have this right. About 2 days ago I got off the Yahoo chat with ling and some of her questions were the most perplexing questions ....I think when I get to China ,,I am going to have to give her the Facts.   11. Hi Phillip2, What are you applying for CR1 or K3/K4?? You said you were married, and if you are filing just a CR1 than the boy should have had an I-130 filed for him to. Anybody that knows better..Chime in Now.... Phillip2...I AM married and going the K3/K4 route...My wife has twin boys. My step-sons can come with my wife,,but if I were going the CR1 route all three would have to have an I-130 filed for each. Are you working with NVC??   13. Hi Amanda, I warned Richard when he first started the Visa Process that the Vermont Service Center was allot longer and slower than California Service Center. That is why I decided to go the K3/K4 route, Knowing that the Vermont Service Center was very slow. I asked a visa specialist at Vermont Service Center why they were slow and the visa specialist told me that Vermont gets about twice to three times as much petitions as California. I know what the people on VJ are going through. I post there every once in a while and have friends there. But...Amanda...you have to realize that the Vermont Service Center is not just processing petitions from China,,they are processing petitions from all over the world, so it is only natural that their processing time are going to be slow, but it should not be this slow..... Here are the times I pulled off the USCIS: Vermont...Is processing February 26,2008 petitions now. I-130 Petition for Alien Relative U.S. citizen filing for a spouse, parent, or child under 21 February 26, 2008 California...is indicating that petitions from start to finish is 6 months. I-130 Petition for Alien Relative U.S. citizen filing for a spouse, parent, or child under 21 6 Months So,,I think Richard filed in April,,so if the times are correct,, than Richard's and your petition should be getting processed in the next month or two. Hi yemmie, After your girl and son read all the posts and I work in the Medical Field,,one thing they will need to consider is get familiar with the different fields and pick one or two that they would be happy with. I see allot of people that are just miserable in their field and the ones that are happy with their field and it pays a little less are better off in the long run.   16. Hi All, I guess I need to Chime in here...Assuming that Ling and the boys are approved for their Visa's.... B) Question one: Should I wait for 90 days from our 2nd anniversary to file for Ling's AOS and the boys...as this would allow for a 10 year Green Card verses a two year Green Card??? I have done the 2year Green card and removal of conditions..so I could do it either way...which do you think is prefered??? I see that Roger is doing it fairly soon, but he and his wife could have been married for two years.... Question 2: Like others that have asked ,,I only have an I-130 for Ling,,so what is the procedure for filing for my wife and two step-sons?? The step-sons are K/4 without any I-130 filed,,so what are the things I have to do and how soon should I do this?? Thanks, Tom and Ling

Submit a Chinese VISA request and reserve plane tickets for the winter school break 18 DEC to 12 Jan, if nothing good or big happens by 18 Dec, go to china prepared to marry. But not marry unless its obvious that that's the only way. I need to see my SO (last was 10 APR 07) and I don't have any childcare for the winter break, so its a good time to travel (from Honolulu to Dalian??). I don't want to give up on the GUZ until the case has been sent back, and then maybe until I can get a reading on how things are going to go. Refilling for k3 I might still run into the same unknown issues. I feel that I should exercise some patience and dig in where I can to fully expose all the facts and options."" I take it that you only filed an I-129F...Correct??? I think you are thinking the correct way. My suggestion would be that if you only filed an I-129F and it was denied than if you can not get an explanation of why you were denied and if you are working with Peter Pagant he might be able to find out. Than I would go to China and marry my Fiancee. Than file an I-130 and after it is filed File an I-129F for K3/K4 and than you would have two possible petitions to try. The I-129F for your wife and if that was denied try the I-130......this is only my opinion but because of your history that is the only advice I can give. It all depends on how much you love your Fiancee,,but take your time if you get married and prove that it is a real and solid marriage. And visit your wife as much as possible if you do marry. I still have a few more months before i can goto see her and be with her for the interview!   20. Tom & Ling Only addressed as far as listing previous spouses and citified divorce decrees. I thought that was proof enough..? And I have only been to China once for three weeks to see her Mar 2007. Previously when I was separated from my 3rd ex, while living in Bahrain is where I met my fiancee in Feb 2005 and had an on-going 'relationship' till my divorcee in Dev 2006 when we engaged. It took a long time because of child custody issues, all of this was explained in detail in an accompanied letter that I had provided to the Air Force Security office for a background check on my SO a long with 3 other package forms that the Air Force wanted. Pete Hi Pete, You have a complicated petitioning history. You addressed your three ex's but did you address the questions that pertained to the many petitions that your ex wife's represent?? and I would also say that in 2000 when I married my second wife the Affidavit of support was for only 10 years,,but now Affidavits of support are "forever". So if you are one of the "forever" folks...Guangzhou may have thought that you had too many outstanding affidavit's of support. Also...the only seeing your wife once may have been a factor too..just my opinion... Tom and Ling

  22. Hi Appaullo, See David's post above..... You need to take allot of pictures,pictures of a wedding dinner. and front load the the I-130 and I-129F with as much information about you and your wife's relationship. Others can give you more information of what to front load both the I-130 and I-129F. do a search about front loading the petitions. as well as ...try to visit your wife about every three months to every 4 month, and you should be there for her interview...just my opinion.. But can you File an I-130 and if it is denied ,,file an I-129F after the Refusal of an I-130?? I think I am confused...please explain??? Tom and Ling Yep, the purpose of filing the I-129F after NOA1 but before NOA2 was to allow the prospective immigrant to get a K-3 visa to enter the USA and wait out the approval of the I-130. I-129F cannot be filed after I-130 is approved, it has to be filed before I-130 is approved. USCIS rules on K-3 http://www.uscis.gov/propub/ProPubVAP.jsp?...5a9f46924858b06 Hard to get a K-3 after the I-130 (CR-1) is "DENIED" by the consulate or USCIS. Hi dnoblett, Well, that seems to answer that question...so if you are going to purse the K3/K4 an it is denied ..than you still have the I-130 to fall back on. and best to file the K3 or I-129F (along with the I-130) so one has this cushion. Tom and Ling Hey Tom, The primary reason to consider this 'delayed' filing of the I-129F is two-fold: 1. The petitioner really wants to pursue the I-130. It appears that USCIS *may* be holding the I-130s to see if an I-129F is submitted or not; and if so then they both get held up since the trend is they get approved at the same time. In the past, this was never done but is clear they now do this. So the idea is, don't file a I-129F while the I-130 is being looked at; let the I-130 get approved as fast as possible... Once approved, go to step 2. 2. If one has an approved I-130, then it may seem a waste of money to file the I-129F; but the only reason to consider it would be as an insurance card in case the I-130 has some issue at NVC or GUZ. While what you are saying is correct ("if the I-130 was denied than you could file the I-129F for K3"), this was not my angle... since I expect the I-130 to get approved. But I think both ways are attempting to let the I-130 simply get approved as fast as possible without any interference (ie: holdup) by a filed 129F. In fact, I don't know if my theory has any validity since I've not seen someone do it; all we can do is; see when someone does it, does their I-130 get approved faster than those who filed a I-129F/K3. Hi David, Well my I-130 and I-129f were approved at the same time and sent to NVC at the same time. I received from The NVC that my I-129f was being sent to Guangzhou and My I-130 was being halt at NVC for one year..should I want to purse the I-130. However, mine is a special case in that I have two step-sons which I didn't file an I-130 for,,so that is why I am pursing the K3/K4. However,,what I don't understand is "what if the I-130 gets to Guangzhou and is denied,,I don't think one can file a I-129F after an I-130 is denied at Guangzhou...or am I wrong?? Tom and Ling

As to your P.S. note, I've been married three times, the second was I got married to a Korean national while serving in the Air Force in Korea in 1983, married for 10 years, had 3 children the divorced in 1993. I married again in 1994 (for 12 years) and had a child (in my custody of now). Two of the three RFE's we got out of the Interview (much more on that later). were about my ex's Also when I spoke to an immigration attorney here in Honolulu when I told her over the phone the basic facts in a one minute spill (because I'd been told that she was very blunt and to the point) the first thing she said was "have you been married to a foreign national before?" . Also a few other white recipients have been and thought that it may have been an issue that the VO had turn on but didn't address directly. The RFE's, one requested a notarized person statement of "Explain in detail your relationship(s) with your ex-spouse(s), explaining how you met; whether you filed an I-130 petition for this spouse; how long you lived together before separating or divorcing (give dates and locations); how many children you had with this ex-spouse and whom the these children currently live with, and why you got divorced." the other RFE under the Residency category, asked for" the consulate has insufficient information about the residency of the following people marked with an X. Provide the address and social security numbers if applicable. (petitioners ex-spouse(s), petitioner) provide evidence to verify residency for a significant length of time and as close to the current date as possible. Include pages with names, dates and addresses of the requested parties. Provide all possible evidence such as: Lease/ mortgage statements, Utility bills, Bank and credit cards statements, Household Registry, Drivers license and other ID cars." I provided all but the copy of the ID card for the latest ex-spouse, the first and second I provided the address's, SSN's and the notarized statement that I did have access to the documents and requesting them after fifteen and twenty-five years since divorce would be awkward and useless. I went to the local USCIS (info pass) and spoke to them the predicament they acknowledged that GUZ had a history of guffy RFE's but that I MUST comply or at lease address everything noted. So that's why I commented that way. I'm going the learn how to post the RFE photos we got from GUZ (they were scanned in by my SO) with all the 30 (or so) items, they are Unbelievable...! It seemed to me reasonable that after providing the three notarized divorce decrees and stating else where the the package that I had a Top Secret security clearance and was reinvesting ed every five years with aspects of my life including personal interviews of my ex- spouses, that just providing info on the latest ex spouse wold cover the issues. But I have a hunch it's the issue. Thanks again, Pete Hi Peter, Wow...So from what you have said ...you have been married 3 times and you are married for the fourth time..is that correct?? Well, my second wife was a foreign national but she is russian and a US Citizen. But that is why I married an Asian (Chinese inparticular)..I don't trust russians anymore.... But in the I-130 and I-129F ..I addressed the fact that I was married twice and one was a foreign national. I take it that you did not address your previous marriages because of the RFE's...is that correct?? Tom and Ling
