  1. Thanks..that is what I have seen .. usually within 10 days. I am at 14 days and still no letter about NOA-2. Maybe the email notification I received was just to keep me from asking about status of my case ...   2. For a spousal visa like K3 then OK too............. Dan doesn't like to mention K3........ Tom and Ling As for K-3 I just point out the cons tend to out weigh the pros of the visa type. It is an OPTION that was developed at a time when USCIS was taking in cases years to approve I-130 for spousal visas, the K-3 was meant to allow a couple to be together while waiting out the LONG approval process for I-130. K-3 Pros, It may save a month or two wait time over the immigrant visa. 2 Year validity, allows K-3 to remain out of the USA for up to 2 years and then come to the USA permanently, handy when US Citizen spouse is still working overseas. Able to defer AOS or Interview for Spousal visa until close to 2 years of marriage or after 2 years of marriage, if Green-card is issued after 2 years of marriage, it will be the 10 year un-conditional type, avoiding having to file an I-751 2 years down the road. K-3 Cons, Unable to get SSN until they have EAD or Green-card, complicating some things like being added to medical insurance, or bank accounts. In most states, unable to get driver's license or state ID until they have EAD and SSN. Added expense of AOS $800+ Cannot take a job until they have EAD or Green-card. May be treated as a NON-Resident if they attempt to go to a state run college. Dan....some of us are willing to pay extra to get our wife over here faster..and until recently the K3 was a lot faster than the CR1. My wife was over in the US after only 7 and a half months. CR1 and electronic processing was not available to us..and we will see if electronic processing cuts the time to 7 months. As far as EAD we applied for that when Ling enter the country and got her EAD and SS# in only 1 and a half months ...not the 3 months take is flown around here....but I had to pay for it and was happy to do it......   3. Wife is fine, fiancee is a different matter. I-134 Question 11 has to do with specific contributions AFTER the NON-Immigrant enters the USA, I-134 is a multi purpose form, Question 11 has more to do with other NON-Immigrant visa types like Student and Visitor's visas, the sponsor can specify how much they are willing to provide to sponsor the student or visitor, in the case of K-Visas question 11 does not apply due to the permanent nature of a K-Visa, when they will be adjusting status. Yes,,I know all this but I still answered that question with the support as well as in the EOR. Tom and Ling

  5. What about if your not applying for a K1 but a K3? I was married to a Chinese woman in China last March. After consulting a lawyer, (who I did NOT hire) he actually suggested to me that I "SHOULD" be sending money to my wife each month to help prove our bonafide relationship! He suggested approximately $300.00 USD each month. Maybe it's different because this woman is already my wife and I am trying to bring her here now? And thoughts, opinions, suggestions welcome! Thanks. Supporting your wife is OK and I supported Ling for 6 months at 600 USD per month and I reported it on question 11 on the I-134. Tom and Ling

  8. Hi Cedarreefer, I-134 is for K1 and K3 I-864 is for CR1 However, most people follow the requirements for I-864 even for the I-134. As in you probably want to submit 3 years of tax retuns just to be on the safe side. Others will chime in. Tom and Ling

  10. No,,I'm not suggesting doing away with the timelines,,but what I am suggesting is to some how be able to follow the new safefile syatem and the electronic processing. Because right now we don't know who was processed by the old way or the new way. Tom and Ling
  11. Hi Wuhan4me, I agree with you on DHL being bad, but actually DHL was good to Ling and I. If you look at our timeline the wait was not there. As one member explained...if your file comes in a package less than 3 lb. it does not sit in customs and our petition did not sit in customs. Ling actually received her P3 when I was visiting her in Sept. of 2008. But it would be nice to either retire the old timelines as they are or start new timelines based on all visa's being sent by SAFEFILE. Tom and Ling
  12. Hi Wuhan4me, I agree with you here and Vermont Service center is a lot slower. Also with petitions NO LONGER TRAVELing FROM NVC to GUZ, VIA DHL but by SAFEFILE system than we don't have any idea of how long any of the visa's will take until we have more information about all of the timelines for the visa's. My K3 went through in about 7 months and we could have shorten that time but I asked Guangzhou to not give us a interview date until after the 15th of November and I guess they complied since our interview was on the 20th of Nov. So the new way and with new timelines will let people decide what is the best visa to get........ Tom and Ling
  13. Hi Pommey, This is not true. If one goes to the timelines and does the calculations for the different Visa you will find the following. Based on our timelines only and about the past five for each, and form CFL's timelines. K1 visa = 6 to 8 months with K1 being fastest. K3 visa = about 8 months CR1 visa = 11 to 12 months with 15 months not unusual. ***These are rough calculations only***** With electronic processing of the CR1 visa than it might be a lot faster but one has to have a lot more CR1's processed before one can say that the CR1's have become as fast as K3. Tom and Ling NOTE: USCIS has been approving both I-130 and I-129F in K-3 cases on the same date. And I have seen many cases where the petitioner responded to the NVC packets (I-864, and DS-230) in a timely fassion and get the CR-1 case to the consulate BEFORE K-3 interview getting the K-3 DROPPED in favor of the CR-1. A Technique that insures this is to be slow in responding to K-3 packet 3. Well, the timelines do not suggest that right now, and If electronic processing speeds up the I-130 ,,than I would say that one should go with the I-130,,,,but all the visa's have different advantages and one should pick out the Visa that is good for them. Until the USCIS does away with the K3,,than the K3 is good for some people. Tom and Ling A voice of reason, thank you, however, the USCIS cannot do away with the K3. It will take an act of congress to terminate the visa since it was created under the LIFE act of 2000. Until then, the K3 visa is still a much viable visa for individuals to obtain. Hi samsong, I would not want to get rid of the K3 visa anyways,,there are enough reasons to keep the K3 verses getting rid of it.... And as Randy has said,,,,,dnoblett likes too sale the I-130....   17. Hi everone, Well since I am registered for notification by e-mail at the USCIS. I received two e-mails that the boys I-765's were approved on 7/2/2009. So two of the seven applications were approved. They will be sent within the next 30 days. At least I know the photos and fingerprints for the boys came out alright. Tom and Ling

  19. Hi yuliki, I only get the Texas Service Center and the Vermont Service Center that lists the I-751 and their processing times are 6 months. I think I would call around and ask whose got your I-751,,over a year is way too long.you can also schedule an Info pass appointment and ask what is going on. Tom and Ling

  21. Actually it is federal law that resident aliens have their residency card on their person at all times. However in our case we don't, my Yu nearly lost her card a year ago, since then the card remains stored in a safe place and she carries a state ID, only when traveling do we carry the green-card. A biometric may happen of prior BIO is old, if not a new card will be generated using prior BIO. As for how long, USCIS has a back log on card printing. Permanent Resident Card Production Delays Hi dnoblett and everyone else, I don't care whether it is a federal law or not I am not going to have any of my family carry it on a regular basis.
