  1. We are preparing to apply for K-1 visa. I have a total of 3 misdemeanor DUI convictions 24 to 30 years old in Oregon and California (CA). According to the CA. Department of Justice (DOJ), based on my livescan fingerprints,there is no record of my CA conviction. I also checked with the arresting police department, their records department and also the courthouse and all indicate in writing that I have no record in CA. I have contacted 3 CA. law firms, that claim to specialize in arrest records, and requested they obtain this 1987 record for my K-1. All 3 firms advise me that if DOJ has no record then it's not possible for anyone to obtain this for me and they doubt that USCIS will find anything - that in 1987 files for misdemeanor DUI were paper files as were fingerprint files and most likely my fingerprints were never sent to DOJ which is why no record is found - they suspect my paper file is in the basement and was never entered into the computer database (all over the phone speculative advise/opinion). In Oregon I can only find record of my 1981 arrest from the State Police records (Oregon's clearing house for all arrest records). I have hired an Oregon lawyer to obtain the required certified copies of my 2 Oregon arrests. I am afraid that if I don't disclose my 3 arrests it will come up in the USCIS check and we will be denied, however if I do disclose and don't provide the required certified records (that I can't obtain) then we will be denied. My lawyer advises me to obtain the records but so far has not told me how to accomplish this. How do I obtain these required records? Should I disclose this at all? Please advise.
  2. I have a trip booked for this June and I am really troubled by the choices between: file immediately OR wait a few months for more front-loaded evidences to go with the I129 petition. We will definitely have a lot more photos and 'total time spent together' after that trip, but at the cost of 3 months delay to our reunion and I figure those new evidences will be available for the interview anyway. Will visa interview officer there already made up his/her mind when reviewing your case before the interview even started? Here is a brief overview of my current situation: I petitioned for a K1 Visa 9 years ago (2002) for my ex-wife (also from China). A legitimate marriage and we stayed married for more than 7 years. I was very young at that time (earlier 20s) and made a mistake. I divorced in May, 2010 and meet my current girlfriend (in person) around Oct 2010 in China. (5 months after my divorce) The two of us have been communicating with each other ( Skype, email, chat) almost daily since that. I took another trip back to China this February and spent a lot of time together. At this point, we have known each other for more than 6 months and we have spent more than 3 weeks together. ( I have another trip booked for June and will bring my engagement ring this time.) I think we have enough photos for the I129F petition (to proof we have meet in person), but I am little concerned about the negative impact of my previous K1 marriage and the length of time (6 months) we have known each other. Things that can help my petition in a positive way will be our age: (both in early 30s) and our job & education background. My income is way above the poverty line and have assets such as house & savings in 401K(and IRA) in US. My girlfriend studied & received her degree in UK and currently has a white collar level job with an international firm in China (She has traveled all over Europe for business reasons & personal pleasure during last 10 years and even worked outside China for a few years. However, she has never entered US before.) This will be her first marriage and my second, neither party has kid. So, should I wait 3 more months to front-load I129F after the trip? Or just sent out the petition now and let her bring the additional photos to the interview? I have always believed that ‘All the legitimate marriage will eventually be approved’, but started getting scared after reading some of the bad stories here. Are there any estimated success rate for K1 interviews at Guangzhou? (Would marry her in China then file for CR1 increase my chances because I have already done K1 once before? ) Thanks for any comments & suggestions.
  3. I'm not sure which forum this should go in. I'm still wrapping my head around everything that needs to take place, but I've really appreciated everyone's help in the past. This has been quite the journey. So my fiancee is coming to the US in a month. Is there a checklist somewhere I can consult for everything we need to do once she gets here? SSN, adjustment of status, etc., and the order these should be done in? At what point will she get a work permit and a temporary visa that would allow her to leave the country?
  4. Hi. This is my first time to post questions here. My bf and I are starting to make plans for the future. He is a US citizen. I was in the US with a J1 in 2009, and stayed for 6 months. I went back to the US twice with a B2 after that. I just got my new B2 in Jan. We are thinking to get married. There are several options for us. 1. apply for a K1 2. getting married in the US with a B2 visa, and apply for adjustment of status 3. getting married in the US with a B2 visa, I return to China and file for a CR1 Now the qustions are : 1. Can I still go visit US with my valid B2 wisa after we file for K1 / while K1 is pending? Would the immigration allow me to enter? 2. I know this may be a risky option as the adjustment of status may not be approved. Is the burden to prove "the intent" fall on the USCIS? or it;s on us to prove i didn't have the intent to get married on a B2? What questions would they concern to decide to approve or disapprove and adjustment of status? 3. It's really not a good option for us. We don't like the idea we have to get separeted after we are married. 4. do they concern/look at my bf's financial situation when we apply for adjustment of status (after getting married on B2)? I know, in K1, the financial sitution of the petitioner matters. 5. Is option 2 (getting married on b2 and apply for adjustment ) cheaper than option 1 ( k1)? Thank you in advance.   5. Hi All - I'm mostly active on the VisaJourney website but wanted to post here to get some opinions. We already filed our K1 in November 2010 so we dont have much of an opportunity to change anything in the petition, however for the P3 and P4 I have the following concern. My divorce was finalized on November 16, 2010 and we filed the K1 11 days later on Nov 27. The basic story behind this is as follows: JoAnne and I have been seeing each other since March 2006. I moved to China in July 2008 and lived there until March 2010. In May 2010, my wife and I filed for divorce and in California there is a six month waiting period. The Divorce was final on November 16, 2010. I was contemplating using the services of a lawyer but at this point everything has been handled on our own. The question for anyone with expertise or experience here is this: Is there any thing that I should prepare in writing that describes the events and what questions related to this should JoAnne be prepared to answer during her interview at GUZ? i.e. how can I minimize this fact from becoming an issue?   6. I'm applying for the K-1 visa and currently living in China. Just got the NOA2 over a week ago. Looking at the I-134 it asks how much income I derive annually. Well, as I'm living in China, the money I make here I am able to deduct. That's nice when it comes to taxes but if what I'm supposed to report on the I-134 is my adjusted gross income it means I have none! :/ I realize that my current income/salary will mean nothing when I go back to the States to get married and reestablish residence there. Therefore I do have a cosponsor. But I was wondering if the VO will look negatively on an application where the petitioner has no income to report and is 100% dependent upon the joint sponsor. Should I then fill in the amount I actually make and bring in my contract and a letter from my employer to verify it (and perhaps an explanation written from me regarding the discrepancy between the tax return and the income recorded on the I-134)? Or does my current salary (since it's foreign earned and will not continue when I go back the US) mean absolutely nothing regardless of what I bring in and should therefore just write $0 and not bother with it? Any input is appreciated!
  7. I want to thank everyone in advance for your help. I do not know how anyone without the information from you fantastic people here can get through the Visa process!!!! These might be silly questions but I am just trying to make sure everything is in order. A little background real quick. Started talking to my lady in June of 2009. Have been to see her 3 times now. Oct of 09...national holiday, Feb of 2010......Chinese New Year, and Sept of 2010......mid autumn festival. I just got home a few days ago..haha. I am putting the package together and have these questions. 1. Should I include the receipts of places visited....Great wall, Tianamen square, some other simple places in Beijing. I have the ticket stubs of many places we visited in Beijing, Hong Kong, Macau, and Xiamen. They are more ticket stubs than receipts. 2. I am listed on the hotels that we stayed at as 1 guest. Her name does not appear on anything. Possible problem? 2a. Should I include the bill of the hotel we stayed at with receipt of payment? 3. Did you include your itinerary with your boarding passes as proof of you actually going to China? now my last question....send to Lockbox in Dallas or the address? I want to have proof of sent. I will be sending everything Fed ex...not overnight but just the cheapest. Thanks everyone again for your help. I will be starting my time line here soon.   9. First of all is this the time when you "front load" your application? I remember reading somewhere about you only need to send in a few pictures at this time. If thats true when do i send in all the receipts, conversations and 100+ pictures? 2nd. How do you file the forms electronically when they required hand written signatures? I took the forms to her to sign while i visited. So can I just fill them out by hand and mail them in the traditional way?

I'm not sure if we have seen anyone in this situation but its one of the possible scenarios for us: - Interview date July 21 - Planned US visit July 29th - Aug. 11th Since a pink is unlikely, she will travel to the U.S. to visit with her in force B2 [understood possible POE issues, but we were ok last time]. So we have been figuring that if she does get pink, and they hold her passport, we would just postpone the visit for about a month or so for her to quit her job and get ready to move. But I was thinking, if her passport is sent back to Shanghai in time with the K1, will they cross out the B2 or is it still valid? Can she choose which visa to enter in and enter and leave on the B2 and then come back on the K1? That would be great to get the visit in and then have her go back and take her time to clear out her life there. Or can you only have one visa valid at a time? Lee
  11. For question #28, my in-laws to be want to pay for the ticket for my lady to come to the US. The question is, should we put them on the 156? If we do, is it likely to cause issues during the interview? Also, does anyone know about, or have any samples of, resumes for the interview? My lady has a MA English and a BA Economics, and she thinks they're going to ask her for a detailed resume because she's "learned too much" This process is so STRESSFUL! I've got grey hair now, that I didn't have a year ago... And I hate second guessing every idea
  12. Our I 129f was denied in July 08 and sent back to USCIS who received it on Jan. 21, 09 for review, (reason not a B/F relationship). Don't bother asking for a more detailed reason for the denial because we don't know, can only guess it may have been to short of time from last divorce, to short a time knowing each other. Only the denying VO knows the reason. Anyway my question is, in a little more than 2 months USCIS will have had it for a year. We have never heard from them during this time except to notify us they had received it. Should we just consider it has been left to expire? We since married and filed an I-130 and she has her interview on 9 Dec.09. Did the I-129f and I-130 ever cross paths while they were both at USCIS as we submitted the I-130 in Dec 08, so for a time the USCIS had both petitions. Also once my wife has had her interview, gets a visa, arrives in the US do these two petitions get combined into one file? I never heard what happens to petitions once they are left to expire at the USCIS.
  13. For a K1 visa. Does question 10 need to be filled in with SO's info from question 3 or would "none" apply to question 10? I am assuming the answer is "none" since it's pretty obvious this affidavit is executed on behalf SO name in question 3 and is submitted during the K1 interview. But then again, government forms are so obtuse it wouldn't surprise me if the answer is yes.

  15. Hello everyone. I've read through so many helpful topics here, and have read through the Guangzhou Consulate website, but the answer to this question is escaping me. There are references in several posts, that the DS-156 and/or the DS-157 Forms are needed at the medical exam. Yet, I can find no mention of this requirement in the information from the Consulate, or the excellent "Kitchen Sink" posts. Are these Forms required at the Exam? And if so, how many copies? My Fiancee will have her Exam at the end of this month, in Shanghai, and I hope that someone could clarify this, for us. Maybe I have misread something? Maybe missed something? Maybe I'm just burnt out....
  16. Ok....I am sure this has been answered but I am unable to find Instructions say: Two copies of DS-156 form with original signatures (with Chinese name and telegraphic code). Two copies of DS-157 form (Only applicants aged 16 or older need to submit this form). Does this mean 2 copies in English and 2 in Chinese...or 1 copy in each language? Robert
  17. The forms are from the K3 packet for processing a K3 visa. On the DS-156 form how to answer question 26?How long do you intend to stay in the US? Should the wife write down forever? I know this form was made for people traveling, business or going to school in the US. What is the most common answer in our case. On question 22. When do you intend to arrive in the US? Well, we have no idea since we don't know if the Visa will be approved or not and they strongly advise against buying plane tickets until the visa has been approved. Two more question that is on DS-156 and DS-230. "Do you intend to work in the US? I think we should write down No, since it asks for a employer and address, not sure though. In what occupation do you intend to work in the United States"? Is it best to write down some professional field? I'm not sure how the wife should answer this since it's kind of hard to predict what will happen. We will be filing the AOS when she arrives in the US, so it will be sometime before she even thinks about working if she choses to do so.
  18. My wife, origanally applied for a I-129f visa. It was denied for the not a bonafide relationship, and sent back to USCIS for review, USCIS received it in Jan 09 . After we were denied, I returned to China and we were married and now have our I-130 knocking on GUZ's door, the NVC sent it to them in Aug. What should we do if in fact we get a letter from USCIS stating our I-129f has been denied or revoked, especially if she is granted a visa on our I-130? Do we just reply that we have applied for an I-130 and no longer want to continue the I-129f process. Thanks, Gary
  19. Ok I should get a Fedex package from China tomarrow morning with the G-325a from from Hui. after I have that form I will have all of the required forms and supporting documents together. Now I have been reading the term "Front loading the application". What dose this mean? I am including in the application about 10 pictures, a EOR, all the banking and tax items.... Do I need to print out and send in the E-mail, MSN chat logs and Phone records at this time or is this stuff send in with her to the interview? What should be sent now to help my application? Please wise GURUS of CFL tell me what I should do.... Robert
  20. Hi, I heard about the new electronic processing option in NVC. I am a K-1 petitioner. First I read that the new pilot program is available for the other visas, then on this forum it says the K-Visas are automatcially enrolled, then I read someone here called NVC about it two weeks ago and were told that they are sending the case electronically to GuangZhou automatically. I called NVC last night to find out more. They told me the case will be sent via DHL, the old way. I am confused and hope that they would send files to GuangZhou via electronic means. Does anyone have any experience for K-1 visas regarding the new NVC pilot program? Thanks!
  21. FYI so others can avoid the same problem... We showed up in GZ with lots of confidence that things were well under control thanks to the good info CFL keeps here... However, it seems that some of the paperwork requirements changed. Formerly, it seems that GUZ let the applicant choose whether they submitted two copies of DS-156 and DS-157 in EITHER Chinese OR English. Now they insist on two copies in BOTH Chinese AND English... to be clear, this now is... * DS-156 (English) in duplicate * DS-156 (Chinese) in duplicate * DS-157 (English) in duplicate * DS-157 (Chinese) in duplicate I'm still recovering from the mopslap I got... and it cost me an extra day in Guangzhou. At least the kind folks at the Consulate let us come back the next day with updated papers. Mods may want to mention to USCONSGUZ that the GUZ forms page currently has an older copy of the "Letter to K1/K3 Applicant" that doesn't reflect the changed requirements.
  22. I do not think I have heard any thing about this... Can my Incoming Fiancee and her Son from China fly into any U.S. City/International Airport??? or do they need to fly in a certain Airport coming in with a K-1 Visa...???? I live in Tampa, Florida but of course always flew into Seattle Washington or New York coming in from China...before going to Atlanta and then Tampa... Thanks, Mark
  23. Hi guys, We have a disagreement over whether the passport style photos are are suppose to be attached to the DS-156 or not. I could swear, I remember reading that the people taking the documents attaches them, but I can't find it. Qingyun is showing me a letter dated 2003 that says you should attach the photos by stapling, glueing or taping. Help us out here! Thanks! Jeff
  24. Our I-129F is not even approved yet and it is a rocky relationship. If we decided to cancel, how does that work, just send a letter in requesting to cancel? I will need to take time to heal, but if I found someone down the road, how long do I need to wait before I even think of filing for another beneficiary. Thanks
