  1. My wife's 2 year green card will expire in February. Will we get something in the mail from USCIS telling us to apply for the 10 year green card? or Do we just voluntarily send in the fees and application? I had heard that you want to get this done within 90 days of the expiration date. Can some one point me to a link to the process? (sorry I have been a bit under the weather, on NyQuil and am a little "foggy", so I want to be sure I get the most recent link to instructions. Many thanks to everyone here for all of their help.   2. My wife's 2 years GC is expiring in march and she wants to go to china for chinese new year but is wondering how long before it expires can she renew it so that we dont have to risk it expiring while she is out of the coutry. Any ideas on this ?
  3. 1 - I was under the impression that these letters just needed to be signed and notarized, but one of my friends who is writing one brought it to my attention that it says, "Affidavits sworn to or affirmed by..." which is apparently a different thing entirely, requiring different language in the letter itself and swearing to God with one hand on the bible... My mother is a Notary, and she said there is a difference between a notarized signature and a notarized sworn affidavit. I already have two notarized letters? Can anyone tell me if I need to have them redo the letters as sworn affidavits instead?? 2 - I notice that the intructions call for "The original affidavit must be submitted..." so I assume this is one of those exceptions where the want the originals over copies..?? Thanks in advance for your help!
  4. Wow, I feel like such a newbie having to post this! My wife has been here on a Fiancée Visa for about a year and a half now. She's nearing the end of her two year green card and we have to start preparing to file for her 10 year green card. I'm lost... Can someone tell me what the form name/number is or a description of what I need to look up? LOL - Is this just an AOS or is it called "permanent residence" or what? Thanks... This forum is the best.   5. I have a friend from China who married an American and arrived in the United States a year ago. She is a good girl, but married a guy who is emotionally abusive and a real jerk. When she was unable to live up to his unrealistic expectations, he decided to divorce her. She received the divorce papers yesterday, and broke down in tears. He is trying to bully her into returning to China by threatening to withold any support unless she leaves the country. Furthermore, he told her that she will never get her ten year green card because they are getting divorced. Is this true? If he divorces her, will that prevent her from getting her ten year green card? Will she be forced to return to China?
  6. Just looking ahead to the future application for the ten year green cards for Rong and her two children. I have downloaded the forms and instructions and quickly perused them. My questions are...does the mother and both children (who will be age 13 & 20 at the time I send in the application) all apply for the 10 year green card on the same I-751? If so, the letter(s) of bonafide relationship and marriage from friends who will write them, can the validation of everyone be taken care of in a single letter?, or does there need to be a separate letter for each applicant?
  7. I've read some posts on subject before, but can't seem to find them now. We are just about to mail I-751 Removal of Conditions and we are considering name implications. Situation Spouse entered on K1 and we married here. For all immigration related items (EAD, advance parole, 2yr GC, etc), my spouse has continued to use only her Chinese name. Also her SSN is in Chinese name only. For everything else (Driver's license, banking, credit cards, insurance, mortgage, etc) she has taken my married name with her Chinese family name as middle name. She's also had her Chinese passport updated by Chinese consulate to include the "Also known as _________" statement with her married name. So the question is, what name to use on I-751. If she wishes to have 10yr GC in married name, can we just fill out the paperwork with married name, even though 2yr GC is in Chinese name only? Frankly, it doesn't matter a big deal to us either way, just wanting to understand our options. Also, would either option cause any kind of complication at this stage? Thanks

On our I-797C, Notice of Action it reads, "NOTE: Conditional resident applicants, including conditional resident dependents residing overseas pursuant to military or government orders WILL NOT receive an ASC appointment notice. Should not there be a comma after "dependents" to make this sentence more clear? Secondly, am I correct in assuming my wife will receive a ASC appointment notice since we are NOT overseas. Thirdly, my wife's conditional resident status was extended one year. Will we receive a new Green Card with an UPDATED EXPIRATION date? Thank you. Pat
  9. Help me if you can. I have a friend who has applied for her 10 year green card 3 months before her 3 year one expires. Well it's been almost 3 months and her card expires soon. She has not heard back from anyone in regards to the status of her green card. Does anyone know how long this is taking on the average now and what happens. When her 3 year card expires, is she then illegal and need to leave or does dhe get a grace period until she hears from INS as to if she been approved or denied. Also what the deal with getting an interview or not getting an interview. Do they interview everyone, randomly select people to interview. Thank you for any help you may offer my friend.
  10. We are preparing for my wife's Removal of Conditions and the most recent I-751 form that I have found was revised on 8/25/08 and has an expiration date of 10/31/09. I will be sending the form mid March. Will this be acceptable or is there a more recent form I have not located yet? Thanks Clayton
  11. Ok here goes: Long time member, but long time no see - hey all! Our 90 day window for the 751 removal of conditions just opened. I am worried I am light on documentation... What I have: Utility bill - power Utility bill - city svcs bank records (I bank online, but it can be printed) Home/auto insurance SSN (and ITIN before that) Green Card 1.75 years left on Chinese passport Tax returns What I don't have and why: Mortgage - they wouldn't add her without another refi and they wouldn't put her on the first one because she was still in China and no SSN (my rate is 5.5, so a refi would cost more than it is worth, even at 5.25 now) Driver's License - she hasn't wanted to learn. Car - Own it. Registered in my name since she has no DL. Motorcycle - Own it. Registered in my name since she has no DL. Cable - Don't have it Phone - company pays for it Internet - company pays for it Employment records - she applied for a job once, and hasn't since. Children - want them, but reversal was a dud. Saving for more expensive surgery Are we going to have a rough go at a removal of conditions? The worst that can happen is bad, but isn't their middle ground of a renewal of her 2 year green card? Is there a site with some examples of affidavit formats that we could give to people as guidelines? I hope to use my brother and his wife since they live down in Spokane (80 miles). My mom would also gladly do it, but she lives in CA, so I worry they will think it is contrived. Her friend and our former next door neighbor (the only other adult Chinese woman in our town) just moved away to Tennessee and their address information is transient until they get settled in, so they seem like a shaky reference. Needless to say, I am stressing over this ALOT. Is it a big deal? Do we have enough to overcome this obstacle? Do they want month after month of evidence, or is a single month's record enough? Is the key to just flood them with paperwork, or have a representative sample of the evidence you do have? Is there an interview, as there was for the original green card?   12. Hi, you all. Long time no write but starting our new lives here in the US has been time-consuming, to say the least. Getting hepatitis the second week I was here ~ a parting gift from the P.R. ? ~ definitely didn't help. Daoqun and I know we will have to complete an Adjustment of Status sometime, perhaps soon. We will have been married two years this May, 15, and the "two year" thing seems critical. But the stuff we got from Immigration when we arrived talked about two years after the Conditional Permanent Resident status was conferred. That would make June, 2010, or 90 days prior to that date the critical date. Which date is correct? Also, how do you go about doing that and how much does it cost? I heard a figure of $1,000 bantied about. If you have advice, direction or just a comment please write to my e-mail, OK? No Internet access at home . . . A Merry Christmas to all . . . Wally & Daoqun
  13. I'm surprised I didn't see this issue crop up in my quick search here. So we filed the Removal of Conditions in March 2007. The latest NSC processing time is June 2006. So technically we shouldn't get a result on our case until Dec 2008 at the earliest. Problem is my wife's green card expired last May. So what can we do between May and December? We were planning to head back to China this summer for a while. Is that possible?
  14. Hello everybody... I almost feel guilty for only posting when we need help... We received a RFE for Jiening's I751. There is a deadline on it of March 26. I have a post office receipt showing delivery on February 26. So far, there is no record of the data being entered in the USCIS system. It does not show on the website or the automated phone system. I was transfered to somebody with the title of 'Officer' and she told me that I should not expect to see this information online, as I751 receipts are not viewable there. She put me on hold for a minute and came back to tell me the same thing. No record in the system. Normally, I would not sweat this, but we are leaving for China on March 26, the same day as the RFE deadline. My concern should be obvious by now. What happens if we get to the POE at LAX on April 13 and the information still has not been entered? We have the original receipt letter that extends her green card for a year. Will that be enough? Should I worry?
  15. Hey all, Situation. My wife has a greencard with 2 year conditions. We sent our I751 form to Texas Service Center the early of Feb while living abroad ( I tool a job overseas) and my spouse's gc expires May 5th. We received the appt. letter today at our US address stating she must go to the biometrics appt. Apr. 1st. Question: 1) After this biometrics appt, will my wife get 10-year green card directly without extention letter or just get greencard extention letter? 2) if my wife can get 10-year green card after this biometric appt., how hong will it take? 3)If my wife just get greencard extention letter after this biometric appt., how long will it take? and is there any other appt. before they issue her 10-year green card ? I thought we'd get that letter first and then the biometrics appt. later but evidently I got that one reversed. Any ideas will be appreciated. So we can put together our travel plans. Thanks Chad
  16. Well, we're at the final step for permanent residency. I-751 application was mailed a little over a week ago to Vermont. We were almost 60 days later than we could have been in mailing, but still well within the period required. Would have mailed it sooner, but (1) we wanted to file our 2007 taxes first so we could include a copy with our application; (2) waiting on friends to get their acts together in letters we requested from them; and (3) well, I tend to move a little slowly - e.g., my wife and I knew each other for 11 years before we finally got married (dated for 6 ... and 1 and 1/2 of that was waiting for the visa paperwork to process ... so it wasn't all me!) Anyway, the check cleared my bank yesterday and my bank lets me see images of cleared checks online, so I printed out a copy. Our address was handwritten below our names by them (we didn't have the bank put it on the checks, because we thought we might have moved ... not yet ... maybe someday ....) and I thought that was interesting. Anyway, the receipt number was written across the top of the check - EACXXXXXXXXXX - but I can't make out all the numbers! Oh well, I suppose the NOA will be in the mail in not too long - just would have been nice to start tracking now ...

  19. Hello, I am going through my package of evidence for the removal of conditions on my wife's 2 year GC. There are a few items on the list of suggestions from Visajourney that we don't have, but overall, we feel like we have enough evidence to pass. I am just wondering if anyone can think of some other suggestions that proved to be helpful? This is a list of the evidence that we have: - Credit card bill with both names on it. - Copies of actual credit cards showing same account number. - Two different bank/investment accounts showing joint ownership - Three travel itineraries/boarding passes, showing our three trips that we took together in the past 2 years, including a trip to China, and two other domestic trips. - 2 Affidavits from friend and relative asserting our genuine relationship - Healthcare plans (3 different ones in the past 2 years) showing both our names together. - Life insurance plan showing my wife as beneficiary. - 2005 and 2006 tax returns. - Lots of photos from our trips together. Some items that we unfortunately cannot provide: - Utility bills showing both names - Unfortunately, they all show my name only. - Birth certificates of children (we don't have kids yet) - lease or property titles - we live in my parent's home right now. Some ideas of what might be good to include? - My VerizonWireless bill shows two phones. Unfortunately the entire bill is in my name (that's just the way it was enrolled, i guess). But we can add a note that says that one of them is my wife's phone number. It also shows a phone log showing that these two phones are calling each other regularly (several times a day). I am wondering what people think of the evidence that i currently have? Is that sufficient? Is there anything else that might be good? Thank you very much!
  20. hello... how have you all been? anyone still here who remembers me? ... it's been only forever since i last posted... =) things have been going relatively well for us... the biggest news (which i don't think i mentioned before) was the arrival of our son Isaac last year, Nov 30. yep... it's been that long, he's almost one yr now. life has really been great, we just can't get enough of our little kid. the good and fun times sure out weigh the "bad". suppose it helps given the fact he is smiling 99.999% of the time. i'll try to post some pics or update my profile sometime so you can see the little dude... now for *real* question... is it safe to travel after we send in the removal of conditions? i know there is a biometrics thing, but i don't know how/when that gets scheduled? what about the i-751 "approval"? is there an interview? edith and i would like to travel to china early next year, but that is also right in the time frame we need to file the i-751. we just don't know if traveling is a good idea. any experience/advice anyone? thanks ryan
  21. Dannie and I will be going to China in Dec thru early Jan 2008. We have to file for the 10 year resident card end of sept (90 days before expiration). Will the card be sent right away (hahaha), can we travel and return to usa with an expired 2 year resident card? Or what do we need to bring with us? Dannies son will be getting married and so we have to travel then. Hope someone can help answer. thanks Mark
  22. hi, friend of mine came as a K1 then her son came 6 month after. Her GC expire in march 07, her son's GC expire in july 07. When she filed her removal of condition she included her son on the papers, ... however she is wondering if she need to file a removal of condition for her son as well or is hers joint with her son's ?
  23. Do any members have recent experiences/suggestions/recommendations when filing their I-751 (Petition to Remove Conditions on Residence)? Specifically how much of the long list of "proof' items is USCIS really looking for and does anyone have an expample of an appropriate affidavit to accompany this form?

Yates /s/ Acting Associate Director for Operations Bureau of Citizenship and Immigration Services SUBJECT: Extension of Status for Conditional Residents with Pending Forms I-751, Petition to Remove Conditions on Residence Background The Immigration Marriage Fraud Amendments of 1986 (IMFA), Pub. L. 99-639 (November 10, 1986), were enacted to combat fraud perpetrated by aliens who marry only to obtain immigration benefits. The IMFA amended the Immigration and Nationality Act by adding a new section 216, which imposes an initial 2-year period of conditional residency on a person who acquired permanent resident status based on a recent marriage. Section 216 also provides a comprehensive procedure by which a conditional resident may have these conditions removed by filing a Form I-751, Petition to Remove Conditions on Residence. Currently, a conditional resident who files a Form I-751 receives a Form I-797, Notice of Action, extending his or her status as a conditional resident for a 1-year period. This Form I-797 also advises the conditional resident that travel and employment are authorized for that 1-year period. Thus, conditional residents with expired Forms I-551, Permanent Resident Cards, may present their expired Form I-551 and their Form I-797 as evidence of their status in the United States. There is no guidance concerning what documentation may be given to a conditional resident who has received this 1-year extension, but whose Form I-751 has not yet been adjudicated. This memorandum provides that guidance. Memorandum for Regional Directors, et al. Page 2 Subject: Extension of Status for Conditional Residents with Pending Forms I-751, Petition to Remove Conditions on Residence Documenting a Conditional Resident’s Status According to the regulations at 8 CFR 216.4(a)(1), “Upon receipt of a properly filed Form I-751, the alien’s conditional permanent resident status shall be extended automatically, if necessary, until such time as the director has adjudicated the petition.” Thus, any conditional resident who has filed a Form I-751 remains a conditional resident until a decision is made on his or her Form I-751. Such conditional resident is eligible to receive evidence of his or her conditional resident status. If a conditional resident whose I-551 has expired and whose I-797 has “expired” or is about to “expire” requests documentation of his or her status for travel or employment purposes, the Bureau of Citizenship and Immigration Services (BCIS) officer who is processing this request should first check MFAS. If the Form I-751 is still pending, the BCIS officer should collect the expired Form I-551 and issue either: • A temporary I-551 stamp with a 12-month expiration date in the conditional resident’s unexpired, foreign passport (if the expiration date of the passport is one year or more); or • If the conditional resident is not in possession of an unexpired foreign passport, a Form I-94 (arrival portion) containing a temporary I-551 stamp with a 12-month expiration date and a photograph of the conditional resident.
