  1. Hi all. My wife had her AOS interview about a month ago and because of some problems with paperwork, my step son's interview was delayed. His interview is later this month. Any ideas on how we should prepare for his interview? His AOS is based on hers, which she already has. Not sure how an interview for him will go down or what we would need to bring. We brought marriage doc, bills....etc for my wife's. Any input would be appreciated. thanks all
  2. Hello all, I have been reading a lot about how to adjust status from K1 to green card. And I am following those steps right now. I am having a very detailed question regarding to form I-765. So I was in U.S on a student visa before. And after I graduated with the master degree, I applied for one year OPT(Optional Pratice Training) Becuase of this OPT, I had this Employment Authorization Card only valid for one year. And this was A# coming with it. My question right now is on the form there is a question asking: Have you ever applied for employment authorization before? Should I answer YES? And if yes, there are following questions as Which USCIS office? Dates? Where can I get those information? The card didnt contain that information. BTW, another general question, for my understanding so far, it might take a while to get the green card. But for the work authorization, how long does it usually take? Thanks

My boyfriend has just proposed to me and now I need to decide whether we should get a fiancee visa and get married in US or if I should go to China and get married there and then bring him here as my husband. I understand that fiancee visa may be faster, but my concern is that I am significantly older than my boyfriend. Will this raise a red flag for a fiancee visa?
  4. On question 25 of the I-864, the box says "I have filed a federal tax return for each of the most recent tax years. I have only been working for a year and a half so that's not applicable to me. My parents are joint sponsoring my wife, so they will provide their past 3 years tax returns. Should I still check the box and attach my tax returns for last year or should I just leave that space blank altogether? Thanks! Mike
  5. Hello, We have a couple quick questions regarding the I485 form. Lili came to the States on a KI Fiancee visa on Dec 22nd. We married on Dec 29th. Here is our questions: Part 1. Question - What is your current USCIS Status? What do we put here? K1? Question - Expires on? What do we put here? The I94 expiration date? Part 3. Question - In what status did you last enter? What do we put here? Question - Nonimmigrant visa number - Is this the control number on her visa? Question - It says to list your present spouse and all of your children. Do we put my name here since we are married now? Part 3. Processing Information It says to list present and past membership with every organization. I assume they are asking for CCP information again, correct? We then answer a bunch of yes or no questions. One question is about the communist party. We answered yes. Should we include our CCP letter of explanation again? Thanks, Matt and Lili
  6. Hi All, Its been a crazy and hectic last 2 weeks. But all worth it!!! I flew to HKG to get my love, spent a week in the Rockies (UT) and got married :)Now the next steps and I have a few questions..... 1)Is there a link on here on what exactly is needed for AOS? Do we need the actual marriage license for this? I only have the marriage certificate thus far. Maybe another 2 weeks before we get the marriage license in the mail. 2)When can I get her a SS Card/SS number? What is needed? 3)I assume we cant do her name change yet. We need the marriage license first, correct? 4)We are planning to go back to China the end of March for a Chinese wedding.I dont think we will have her green card by this time. What is needed for Lili to leave the States for the China wedding and get back into the states after? 5)Finally, we currently live in Texas. However, we are moving to Utah in March. How will this effect AOS (any)? Thanks, Matt and Lili
  7. Hello, Parents in US on visa, will be doing I-130 and I-485 while they are here. My concern regarding documents is the following: On birth certificates: Is the white book(notarial certificate)enough evidence as a birth certificate? The Department of State Reciprocity section states that these are at best considered secondary evidence. has anyone ever had a problem or RFE because of not providing originals, and/or other evidence? On marriage Certificate: Parents marriage certificate (white book) has copy of red book and translation. But my concern is that translation states "The above mentioned persons apply for marriage which is in conformity with the provisions of the Marriage Law, the People's Republic of China and are hereby permitted to register and this certificate is hereby issued." Does this mean that they are married or just that they are permitted to marry? Is this document enough evidence of marriage for parents? Also have notarial certificate of spousal relationship for them. I appreciate any help you can give me. Thank you.
  8. Now studying up on all the AOS phase processes. Everything in the FAQ is very clear on the last name change and is easy to accommodate, however at the same time we want to legally change her FIRST name to her chosen english name. From what I have been able to determine, this must be done at your local courthouse with a petition for name change. I got the info, no problem. I presume we do this after we get married so we can demonstrate the last name change as well. Seems ok to do this even with no green card yet. In the state we are marrying (Florida) they don't appear to ask what your married name will be but I presume you can't change a first name at that time anyway? She already has a Michigan state ID and SS card with her Chinese name from the time she studied in the U.S.. Very helpful... so no rush on the ID and SS card. She won't need to work or drive. I imagine after we get the name change approved, then go get a new Washington State ID and then file for AOS referencing the new first/last name as the married name (and include a certified copy of the name change I imagine). That should get everything processed through them with the new name. At this time can start using the new name on everything else... bank account, credit cards, etc... But do NOT file for the name change with SS until we get the Green Card from what I read? It will go smoother if they get data from USCIS on this first?

  10. My friend Jeff is getting married to Chinese woman on June 26,2010. Here is his question. My fiance came to the US on Apr 29th. Her son did not accompany her but wants to come later. Can someone please tell me what he has to do since he has turned 18 since her arrival. Also what do we have to do on this end? What forms need to be filled out besides the I-485? He was included on her original K-1 visa application. Thanks, Michael

  12. thats another 355 and then the I-485 1010 I never seen this on any post here or visa journey I think she just wanted me to pay more money.. so before i file was she crazy or did i miss something..   13. If I bring my fiancee to the US on a fiancee visa and end up marrying her and she becomes a US citizenship will she lose her Chinese citizenship? Or can she have dual or what? If she does lose it what are the implied ramifications that I should think of? Probably in light of the fact that we plan to later move back to China.
  14. Hi Everyone, We are in the process of adjusting my wife and son's status. We got married in December, and filed I-485, I-765, and I-131 for both of them on February 14, 2009. I received notice for their Biometric appointments about two weeks ago. They will be here in Virginia not far from where we live. Today, I received another notice of action for my wife and son (I-797C) in relation to their I-485s. It says: Notice type : Transfer Notice This is to advise you that in order to speed up processing we have transferred the above case to the following USCIS office for processing: California Service Center, 2nd Flr, 24000 Avila Road, Laguna Niguel, CA 92607-0111. That office will notify you of the decision made on the application or petition. Please read the following information before attempting to contact the National Customer Service Center for an update: Please refer to the USCIS processing dates webpage, via the USCIS home webpage http://www.uscis.gov/graphics/index.htm, to locate the processing dates for the specific service center that your case was transferred to. If the service center is within processing time for your particular application or petition, USCIS cannot provide an update on your case.   15. We filed $1010usd worth of stuff (sorry) a few months ago. Then,we received a letter instructing to go get fingerprinted in Tampa. Then,we waited. Then,the EAD Working Card arrived in the mailbox and my wife started LEGALLY working a couple of months ago. Thats it. WHATS NEXT??? Have I forgotten anything? I assume the next thing to happen is a letter will come instructing to go make Medical Exam (in USA) should arrive? Theres nothing more I can do-right? Just wait for the Med-Exam instructions to come in the mail? My wife has started pestering me about this so I had better have an answer for her tonight! (I think we are supposed to just wait for that Med-Exam letter,but every time she gets around "new" Chinese friends,and they start giving her "advice" about her Green Card,she starts getting impatient and militant towards me.)   16. I have no idea what's going on with USCIS...... My husband entered into US thru K-1. As is informed, we just need to submit I-693A. However, after waiting for 4 months, we got a notice today that request him to submit the original DS-2053 (which was given to the custom when entering into the US) or HAVE THE MEDICAL EXAM AGAIN! Basically the reason for that is no medical exam could be located. We are living in NY. Anyone else has the same case? I guess we 99% will end up having another medical exam, which is really ridiculous!
  17. I posted this question over at VJ with no luck. So I'll try here. I had a question about the marriage certificate. On the I-485 instructions, it says to send in a certified marriage certificate, but I could only get certified copies of the marriage LICENSE. When I went to my county marriage office, they said the certificate is only for decorate use; there is no official use for it. When I had tried to get another "certified copy" of marriage certificate, they took my original one and gave me a new one which had nothing written on it (therefore I still only have one and this time it's unsigned and blank, strange eh?) So I just took back my original certificate and left it at that. I wasn't sure to send in the original certificate + another certificated copy of my marriage license? Or just a certified copy of the marriage license? Thanks!
  18. When the petitioner and beneficiary are married the child is over 18 but not yet 21. The petitioner can not file I-130 for the child, as the child was over 18 when the marriage took place. The petitioner files I-130 and I129F for the beneficiary. The child is listed on the I-129F and can come to U.S. with the beneficiary after visa approval. What is the process for Adjustment of Status for the child without the I-130 being filed by the petitioner? Thank you for your time.
  19. I applied for fiance visa and arrived in USA in Jan. Before I came here, I had my medical exam that required by US consulate for visa interview. Now I am applying for the adjustment of status and Form I-693 needed to be filled by doctor. Does anyone here know whether I need another medical exam for adjustment? Thank a lot for kind help.

Hi all on 10-17-05 my so (K1) and her son (k2) recv notice from uscic (calif serv center) request for more evidence- pertaining to I485 application, my so's letter stated that they req, evidence for bonafide relationship, as well as I-693 medical. so's son's letter stated req. for evidence for marraige cert, and I-693 med. also. we stop by our local dhs office to clarify, and was told that being k1/k2 they dont need to repeat the medical, just need vacinations( I-693 suppplemental ),(which we did back in jun-05) ,because their medical was done in GUZ prior to their interview and placed in the sealed envelope ,which we gave to customs upon entry to usa. anyway,, now i dont know what to do or believe!! has anyone who is k1/k2 had to go thru this before? I am willing to get the medical's done again if it will satisfy things! but not needlessly! please some help!!!!!!!!!! anyone!!!!!!! feb-04 1st trip ,chengdu-engaged apr-04 2nd trip ,chengdu ,filed I-129f vcs may-14-04 1st noa,I-129f jul-04 p3 recv, sentback same week oct-04 3rd trip to chengdu, (to wait with so) dec-04 p4 recv, feb-2-05, interview,,passed!! feb-3-05, pick up visa (and get the heck outa GUZ!) mar-23-05, arrive home !! so and son apr-14-05, married apr-05 so gets SS card( in NJ its easy) apr-25-05 filed I-485,I-765, (for so and son) may-10-05 recpt notice of above may-23-05 recv. yellow paper req for additional evid(box checked submitt supplement to I-693 vacinations) box not checked for I-693 medical. jun-05 vacination complete sealed envelope sent to DHS lee's summit MO. jun-05 biometrics done for so and son jul-6-05 so and son recv work cards sep-22-05 recv notice from DHS (calf. center) satting that their I-485 applications have been sent back from DOS to serv center for further review ???? oct-17-05, so and son, recv blue paper from DHS(calf center) req for more evid as stated on the top of my post

I recv'd a noa from hls. stating that our case has been sent back to them from the state dept. for further review. we are here and making a good life in boise, idaho my so got her dr licience work card that whole 9 yards, were very happy, we arrive here mar 23 2005. got married in apr, i filed I-485 in apr. was recv;ed, now were in wait mode. here is the letter: Application Type: I485, Application to Register Permanent Residence or to Adjust Status Current Status: On September 21, 2005, we received this case back from the Department of State for further review. We will mail you a notice when our review is complete or when we take other action. is this normal! to date all my paper work has been impecable! has anyone ever dealt with this. hope to hear from anyone soon! thanks the most, mike& Xia
  23. well, thanks for the CFL, I got the K3 visa yeterday, but my adopted daughter did not get, the reason is when my husband came to China to marry me, she is over the 18 years old, so yesterday when we went to the American embassy in GuangZhou to pick up the visa, I was told, my adopted daughter can not get the K4 visa, because she was over the 18 years old when my husband married me last year, so now how can I do? shall I apply what kind of the visa?? on website of 001, I was told , my husband need to apply for her for the 130 form, but need to f2a, what is the f2a?? now my adopted daughter is 19 years old. Thanks for the CFL family, I realy love this website, so I need all the help, thank you for all, have a nice weekend.
  24. Ok I'm a little confused. I've completed all the forms for AOS except the I-693 which if I am reading it correctly means that Bing has to have another whole physical exam. If so what did I pay 100 bucks for in China? We have the Vacination records she got after visa approval, but don't they put all the medical records in the mysterious brown envelope? all we have is a little 3X5 booklet of her medical exam. Is this what we take to the civil surgeon along with X-rays?
