Chinese Documentation Needed for N-400

Fantastic - helpful as always. I suppose for the CCP issue, it shouldn't be a problem as long as we deal with it the way that got us through the immigrant visa process. It looks like facing "double jeopardy" for that issue isn't usually a problem...except for that denial thread from 2013 here where someone was denied citizenship because he said he joined the CCP for a "better life." Really an odd case in so many ways, since that guy already got through the immigrant visa process after all... -
For the purposes of making sure people get all the documentation they need in China before leaving, is there any Chinese documentation needed for the N-400? I suppose you need: "White book" (notarized copy of "red book" marriage license), just as used for the green card process - is that right, actually? Anything else? Anything needed for anything else besides the literal N-400 would also be worth thinking about. (I've read the document checklist, but just unsure about exact requirements.)

Haha, yup. I think also smart to show some documentation from the GZ Consulate which shows the date, rather than just the Chinese marriage certificate! Also, I think in the worst case, we can do this: "If it comes as CR1, file I-90 with a fee waiver (USCIS error) to replace the card"

Interesting - and happy to see that you won by living life well, as your signature says! Update: Visa is in our hands now. 1 issue - the visa says CR 1 on it, and we also got the CR1 letter. I know that if we arrive in September (we got married in August 2013), we *should* get the IR-1 instead of the CR-1. I'm wondering if this actually happens, though? The visa doesn't give our data of marriage on it - how would the officer know to give it to us?

Update today: Passport has been received from the consular section, and is currently being processed for delivery

Another status update: as of today, the status was changed to be: "Your passport is still with the US Embassy/Consulate" Thanks for the support guys. Yup, after P5 I didn't have any real doubt any longer. Just posting all the updates so that people who follow after will have an additional data point! I agree about how bad government websites are. Just getting your IRS return transcripts is a huge nightmare. Took me about 100 tries to get it (literally). With the recent security breaches, too, ironically, information becomes insecure AFTER a security clearance. Just Kafka-esque!

After I submitted my spouse's passport to the expedited CITIC bank location in Shanghai this Wednesday, the online tracker at US Travel Docs now say that "your passport is being delivered to post." (ie it's on the way to Guangzhou, which the CITIC employee told me would take 3 days) So the system is updating properly.

This delay would seem to merit filing a mandamus action. Although I've now gotten the P5 (98 days in total), our plan was to spend what it takes to file a mandamus action after 1 year had passed.

Ok, I just basically created a new application, for "registration," and I now have a document delivery address. The odd thing is that we did it before - selecting a document delivery address. But we did it again, and now it shows again in the system, I think. I now have the blue bar at the top again. It's confusing, because we originally had the blue bar before the visa interview in Guangzhou, but it then disappeared afterwards. One thing that's also confusing - in the appointment history tab, the Guangzhou interview says and has said for a long time "Scheduled," never "Completed" or anything like that.

Also/alternatively - is it possible for my spouse to first go to the US now in late July or early August, then come back to China to wrap things up at work for a few months? I suppose the difficulty would be having to stay in the US long enough to get issued the physical green card. Has anyone else done this? Any problems with re-entry?

I also just want to express my thanks to everyone on this board for all your help, support, advice, hand-holding and more throughout this process. I'll do my best to give back to this community as so many others have done. In the end it was 98 days. Seems to be a magic number that comes up a lot here.

Some thoughts/questions: If my spouse enters the US after our 2 year anniversary, will we definitely get the IR-1, instead of the CR-1? We got married in August 2013. So it's not 2 years yet, but it will be if we enter the US in September and not earlier. If they give us the CR-1 instead of the IR-1 then by mistake, can we get that changed to the IR-1 without a hearing, as it would be a mere administrative mistake? The letter said to only submit a new police report and new medical report if they would expire one month after we can give our passport (right?). But there's a bit of awkwardness around our timing. Our medical report expires mid-September. I only get back from a vacation to the US mid-August. We want to have at least a bit of room before the visa expires and when my spouse enters the US. (We don't want to enter the US on the last day the visa is valid - just in case there's flight delays due to weather and the like.) And I have to give 30 days notice to my employer, as required by Chinese labor law. Is it possible for us to just get a new medical report and submit it so that we can get a visa that lasts longer?

I think we got it. I was scared out of my mind, because the e-mail began: "Under the section 221(g) of the Immigration and Nationality Act, the Consulate General is unable to issue you an immigrant visa at this time. If you have already submitted your passport to the Consulate General, we will keep your passport with your file pending the issuance of your visa. Further consideration will be given to your visa application after you meet the following requirement(s): 根据移民国籍法案221(g)条款，本馆目前不能批准你的移民签证。如果你的护照已经提交至本馆，本馆将会保留你的护照及档案，直至签证批准。在你达到以下要求后，我们将对你的签证申请作进一步的考虑： * Please submit the following documents and this letter through CGI’s designated agent CITIC Bank. For instructions on how to submit the required documents, please refer to the “Application Pending Further Action” page in the Immigrant Visa Section of http://ustraveldocs.com . 请通过CGI指定的中信银行提交以下材料及此信。关于提交材料的指引，请参照网站http://ustraveldocs.com 移民签证信息页面上“需进一步处理的申请”。 " But that actually means we will get it, once we submit the required documents, right?

Hmm - very interesting. They never answered my questions like that at all, even though I asked for specifics. Looks like your husband is a smart guy - he knows how to word things the right way! My spouse and I just had a long and very productive conversation complete with written matrixes and charts regarding multi-variable scenario planning. The variables which interact with each other include job status, pregnancy, and visa status (approved, denied, continued purgatory). It was very useful to at a high level discuss our default reaction to each conditional eventuality as it occurs, and I recommend it to anyone early along in this unpredictable process. We even planned for the unthinkable, of course, which is an outright denial. It should never happen to us given that the law, facts, and regulations and precedent is all on our side, but weird stuff always happens. But our default plans are as if that does not happen, because we cannot assume that the worst happens, as we would then be trapped here and we could not then make preparations for the most common case, which would be getting ready to start a new life in the US. So it's full-steam-ahead with finding jobs and such in the US, with the thought in the back of the mind that it all might be for naught due to abuse of the system by the Guangzhou consulate. So far things have occurred all on schedule, and according to inquiries with the GZ consulate and the online status tracker our case is still live. But we have to at the same time consider the possibility of the unthinkable, while not being consumed by it. I'm sure you are all used to it by now! Appreciate any tips or thoughts.
