  1. Good point several topics tagged Writ Of Mandamus http://candleforlove.com/forums/tags/forums/Writ%2Bof%2BMandamus/ Interesting indeed. My case status was recently updated as well. But as we have seen, that can happen many times still, before something concrete happens.

  3. A lawyer told me that the recent Supreme Court decision does not preclude mandamus actions in cases where there has been a huge delay and there is simply no answer (the usual "stuck in administrative processing" crap).

I saw the following relevant quote: "The Supreme Court held that because Berashk is not a U.S. citizen, he did not have the right to get a court review, and his U.S. citizen wife also did not have a due-process right to get the visa denial challenged in a federal court. Steven Yale-Loehr, a law professor at Cornell University, said the Supreme Court’s decision on this case has a much broader impact on immigration to the U.S. “If a U.S. citizen marries a Chinese citizen in China and tries to petition through the green-card process to have the foreign spouse come over to the United States, and if the U.S. (consulate) in Guangzhou were to deny the visa because the foreign spouse is a former member of the Communist Party, or they allege maybe the Chinese citizen committed some crimes in the past even though it is unproven, that would not be reviewable in the U.S. court,” Yale-Loehr said."
  6. At least it shows the case hasn't been completely thrown away, I suppose! We experienced the same thing, the status date updated immediately once we got an email reply from them.
  7. Felicia, looks like we are waiting together on approximately the same timeline. We also had a Guangzhou interview in April, and are also waiting on CCP issues. So let's keep sharing information. I am not too optimistic, and only hope we can go to the US by the end of 2015. September would be optimistic.

  9. TS, thanks for the good wishes. LG, yeah, it makes the job hunt very frustrating for me and my spouse as well. In related news, the online status checker is showing an update. But I wonder if that update just means they answered my question by e-mail. Do other people experience that as well, that the status updates whenever they contact the GZ Consulate?
  10. Thank you, I had not seen the one that had taken 180 days. It is disheartening that if that happens, we have to get another medical report and police report.
  11. Still waiting, of course. Trying not to go crazy researching how to find immigration lawyers and how one would go about filing a writ of mandamus in the first place. In life I always try to imagine a strict worse case scenario and then go from there. I suppose the worst case here would be having to do that, and not being denied, since the law is so obviously in our favor. What is the WORST case for CCP administrative processing you guys have heard of? We've seen a lot of people stuck in limbo on this board over the years (and very unjustly so), but has that ever happened to someone whose only issue was CCP administrative processing? (Assuming, as warpedbored said, that no one has heard of any permanent denials because of this.)

  14. I am really sorry for your pain, and I hope that there will somehow be a good solution someday. I'm not qualified to give advice, since my spouse is still in Administrative Processing, but I hope that the collective brains and experience on this message board can find a creative way to resolve your problem.

  17. Thanks. And I'm really grateful for the resource that is this board, and the time that you and the other moderators and administrators spend on this public service. The law (the INA) and the facts are both on our side, and I will exhaust every appeal process if necessary, including hiring legal counsel. But first we'll see what happens in 4-8 weeks. What does everyone here think will happen when we are contacted in 4-8 weeks?

Perhaps it will save us time that we gave them the form today, rather than having to CITIC it to them. I was really happy when I saw that your spouse and child were approved. My spouse's job is attorney (for a company, not the government). Perhaps that had something to do with it, as well. Thanks but Randy had a good letter guide I took advice from. What kind of company or technology is at that company? Was their plenty of evidence of relationship? I forget if you posted the interview questions and mood of the officer, & etc. It's a big multinational in food/consumer goods. Nothing sensitive. Yep, the officer seemed satisfied by the evidence of relationship, as well as evidence of financial support. But I suppose we'll see what happens in 4-8 weeks. The question were fairly standard, my spouse is telling me right now. How did you meet, where have you been in the US, stuff like that. It was going well until they asked about the CCP. My spouse hasn't paid membership fees in a while, and we have provided a letter stating my spouse's status and why we should be admissible. As with everyone here, I guess we will see what happens. Sure enough, the online status tracker has already been updated to say that we are under administrative processing.

  20. My spouse got a blue slip in Guangzhou today. No reason for the denial was given, but it was likely due to the CCP issue. We provided a letter explaining the membership to them at the interview, and they didn't request any other documents. The officer said it would be 4-8 weeks before they will contact us by e-mail. It's confusing that some people with CCP get preliminary approval but some get a blue slip. There seems to be no rhyme or reason. Edit: In my moody state I didn't say that obviously the letter said that the direct reason is Section 221(g) of the INA. But what I meant was that no further reason was given other than that, when the officer was asked why.
  21. Congratulations! Very happy for you. You said you brought both your wife and your passports into the interview - it was just your wife going inside, right, so in the end was it necessary for her to bring your passport on her person? Doesn't seem to be in any documentation that this is needed, and it also seems a little dangerous to not have proper identification on your person as you are waiting outside of the Consulate, no?

  25. Thanks! Funnily enough, at the same time I saw your post, I got an e-mail back from them saying the same thing. They said to "allow one month." When you say "by phone + email," do you mean a call or a text message?
