  1. Thanks everyone. I feel light I've been in a five-year-heavy-weight match and my invisible opponent just politely walked away. I'm not really sure of what to do with myself. It's over. I know what you mean Tsap. I leaned over on my kitchen counter-top and felt the weight of the world lift off. I guess it's time to "spring clean." Lesson here, "Never give up on Love."

  3. We did it !! For those of you who've been there all this time.Thank you. It took three interviews and one month shy of five years but, we were finally successful. I must admit the third interview was hardly an interview. It went something like this: "Wow, you two have a long history together. Looks like mistakes were made. Let's get your Visa so you can go be with your husband." And just like that, the fight was OVER... Yan will join me in the US just after the Chinese New Year. Happy Holidays Everyone ! Terry
  4. We've been at it for over two weeks. When my attorney called for assistance they said it would be 48 hours. So, when they called back on the third day they told my attorney that they had sent him two e-mails. One included a password. He told them that he only received ONE email and did not receive the one with a password. They said a Supervisor would have to help him with this. That will take another 24-48 hours. It's now the third day and we haven't heard a word. It looks like that is just the beginning of trouble after reading your post. WOW. Five years later and this is how its ending?
  5. Wow. I know every word you say is true. Thank you very much for that. It means a lot tome. If I were thirty and not just reaching fifty I would have already moved to China. But the fear of trying to plug back in to the US workforce from China seems daunting at best to me. NoTsap. we never had to rebut anything. In fact, everyday I would come home ready to write whatever they asked and it never happened. They reaffirmed our case and we waited for what seemed an eternity to get another shot. When they placed it in 'adminstrative processing' last September we figured it can't be all bad and continued having faith. I gotta say we were upbeat about April's call back to GUZ. So one can imagine and probably heard our hearts shatter and crack around the world. I'm going back May 9th so we have that in front of us. I promise you, I already dread the airport scene before my departure to return. It cry to think of it already. Another aspect of the process that I don't care for is they've NEVER spent one single second speaking to ME. And, for my hard earned money spent to go about this the honest way at least they could tell me why for God's sake they're keeping us apart. The world and news are full everyday with people who don't want to be together and look at us. Who are these people and why can they get away with this? Maybe those coming in illegally have been reading my posts. They must give a decent man bad thoughts. Thanks again. I know my employees are ready to see me truley smile again like I did when we first began this process. They tell me all the time, "Lord bless your faithfulness."
  6. I'm lost guys. I never imagined all this heartache. My attorney wrote the following to GUZ... "Thank you for your response. What is mind boggling is that after the first appointment you had issued a request for additional evidence however you did not request anything further after the second interview. You placed the case in administrative proceedings and after almost 7 months denied it without any further comments. I respectfully request that you provide us with specific grounds for your denial so that the case is not further delayed by the petition review. It's all a bad dream. It took eighteen months to get the case back to GUZ and it was heading back to the USCIS in four days flat. Here is GUZ's reponse... Thank you for your inquiry. The case has been sent out to USCIS via National Visa Center for review and possible revocation. Additional specific information regarding the reasons for this decision can only be acquired during CIS review process. We recommend that further inquiries be directed to the USCIS office, as they will be able to best assist you going forward.
  7. I couldn't believe my eyes so I went and searched and found the other one that came after Yan's first interview on 3/15/2010. Actually, one is dated 06 AUG 2010 and the other 12 APR 2012... exact same letter.
  8. My wife sent me a copy of the letter she received in GUZ last week. I was expecting it to read something like "Thank you for flying Immigration Airlines...we hope you've enjoyed your flight." But, what I find is the exact same letter they gave us 3/15/2010. It states our realtionship is not bonafide and our case is being sent back to CIS. To spell this out clearly, they have already sent our case back to the CIS twenty-five months ago and it has was "Re-affirmed." This has to be a clerical error.
  9. That would be a dream come true. Unfortunately, my mother is in her upper 70's and just had her second heart attack. Glad your mom is doing well.
  10. A little off the subject: Does anyone have any thoughts of the possibility Yan could get a visitor Visa and at least get to meet my Mom sooner than an appeal would take. My Mom is quickly aging as this horrible injustice rages on. She loves my wife as the Daughter she's never met. I dream of those two being able to spend time around one another for many reasons. I never was never married before and I feel like its appropriate to my Mom. I still haven't received any paperwork from Yan on the reason for denial. She states that the paper looks like the others... I told her to send it ASAP that it may hold clues for us. We're really at a crossroads. Thanks for everyones thoughts. As soon as I see the GUZ paperwork I would feel better about approaching Mark again. He has done a little for me before. Good day.
  11. I am waiting to hear and read everything that took place those days. I'm lost. The way they treated her just turns my stomach. I will know how to proceed when I have more information as to their decision. Yan has left GUZ but we will be there together early next month. Maybe I look into finding her then.
  12. My wife Yan originally interviewed on March 15th 2010 . They said it was not a bonafide realtionship and sent our case back to Customs and Immigration and National Visa Center for them to "reaffirm our petition" to Guangzhou. We had her second interview Sept, 22 2011 and this time no YES... no NO ...just "administrative Processing " It seamed like forever until last week when Yan was invited to come back to GUZ. She traveled 1572 km spent two nights and meet with the Consulate on two seperate occassions. They made her wait for four hours in a crowded room finally calling her to a window and DENYING our petition. They never asked a question. It has taken us 39 montyhs to get to this answer and they had no need to put my wife through the long travel and lodge charges etc... Just to say NO. I'm not sure the reason and I am sure we can appeal it but does anyone here have any advice for a story like ours. We we married 12/9/08. I have no reference point to match my emotions. It feels like somebody has killed a love one but no one is dead.... I'm lost. Anybody got anything for us?????????

  14. After our intial "Not a Bona-fide Relationship" on March 15, 2010 it took eighteen months before the second interview on September 22, 2011 in Guangzhou. The second time around we were not denied and got the old "Administrative Processing" line. We thought this was positive and felt a little relief but this has turned to misery since we're now going on three months since that rotten day. We just celebrated our three year anniversay apart. What would it hurt them to tell all of us what's happening with our cases? Are they afraid of hurting the feelings we have left? What a nightmare. God Bless all of you!!
  15. Never received a NOID. They reaffirmed and never told us what the original problem was. I did present an avidavit answering three questions the V/O had asked but that was over a year ago. Surely they had read it before yesterday.
  16. Blue letter in GZ on second interview.... Admin Processing - not a yes or no and they don't ask for any other evidence> Just ADMIN PROCESSING. Anybody know anything about this fork in the road?

  18. Thanks everyone... Yea, I plan on passport with multiple China entries and I have her Federal Tax ID # paperwork etc... I plan on a sucessful outcome this time around.

  20. Ok, we've fought hard and now we have another day in court. I have a two week trip already planned from 9/1-9/14. It's pretty much in stone since I used up my vaction time on back surgeries earlier this year. So these are the days.... I cannot stay in GZ until 9/21... There isn't any way for me to be present for her interview. I can however take her for her medical examination etc... What do you think of going to the Consulate and at least introducing myself and explain I was already booked to leave China on the 12th to return to my job when we received the ill-timed notice. I wish they kept us more in the loop. Is it enough that I was there a few days before her interview?????? Anyway... were HAPPY. We just want everything to go better than the first time... Any Candle friends got two cents you wanta chunk in?
  21. Thanks everyone. I guess it will be important for me to attempt to be present (downstairs) for the next interview as well. I don't plan on asking Yan to go through it all by herself again. Hopefully, she won't need all the immunizations this timearound as they made her sick the night before the interview from hell took place. Tsap seui... I hope everything goes smoothly in GZ. I'll be keenly awaiting your feedback.

  23. That is great news buddy. I am glad to hear your case was reaffirmed. Many folks don't understand that GUZ does not have the actual final say in a case, yes they can knock the wind out of your sails and make you wait 18 months to 2 years until the case gets back to the USCIS but it is the USCIS who has the final say. Good luck with your upcoming interview. I know it will be a while before you get a date but it should be worth it and you should get your visa this time. According to what my wife and I went through on a failed K-1 case that got reaffirmed by USCIS who never even sent me a rebuttal letter stating why we were denied (we married after 23 months of waiting to see if our case even got sent back to the states and nullified the K-1) it took our case 6 months from the USCIS reaffirmation letter to another interview. I hope your wait is much quicker. The word is, once USCIS reaffirms a case then GUZ can not use the same denial reasons on your new interview. tsap seui I love the sound of that!!   24. Well, many of you listened to my cries on March 15th of last year when the Visa Officer denied that our love was bona fide. Our case was sent back very slowly to Customs and Immigration for what seemed an eternity before they began to process it. We just received a letter advising us that our case has been reaffirmed (approved) and it's going back to the Department of State.... then Guangzhou for our second interview. I hate to get excited about anything at this point but it's been almost eighteen months since we had any positive news.... so, I'm sharing it with the group. My wish is that no one else is going through the hell that we are but I know you're on this site with the same experiences. Never give up. Don't let them win? Who are they? I'll keep you posted... I'm sure it will still require many months so I'm flying to Shanghai in September.
  25. I hired him to look over our case and tell me his thoughts. He and his assistant in China interviewed my wife and I both. I appreciated his input. Marc said there shouldn't be any reason why we can't be sucessful next time. He felt we had a strong case.
