As a general rule, if the K-2 child interviews with the parent and gets the visa, he/she has 6 months to use it or lose it. If the child does not interview at the same time, he/she can interview up to a year later and get the visa. Vincent's post suggests there may be a third option.
  3. I had a similar problem with the P3. Jingwen never received the first EMS. I e-mailed GZ after about a week or so, and they informed me again that they had sent it on such and such a date. I asked them to please resend, and they asked that I fax her address in hanzi. I did this and nothing. I e-mailed them again, and this time they said to e-mail the address to them. Despite the fact that their website says it doesn't allow hanzi characters, I e-mailed them the new address. After a day or so I followed up, and they finally responded that they had re-sent the P3. Jingwen finally received it a few days later. To this day, I still don't know what got them off their duff, but the moral of the story is to keep the heat on them until you get results. And, like Carl said, this is no time to worry about pissing them off.

  6. Dean raises a good point. The general rule is that K3 applicants may opt at any time to process the CR-1/IR-1 rather than continue with the K3 application. I don't know if GZ would slot you for your current K-3 interview, but doing so might defeat one of the reasons for opting to go CR-1/IR-1 - gaining a little extra time for the Canadian police clearance to come it.

The Triggster is correct - from http://uscis.gov/graphics/i-693faq.htm : "...If you were admitted to the United States as a fiance(e) (K-1), child of a fiance(e) (K-2), Spouse of a U.S. citizen (K-3), or child of K-3 (K-4), and received a medical examination prior to admission, then you do not require another medical examination as long as your application for adjustment of status (Form I-485) is filed within one year of your overseas medical examination. You will, however, be required to submit a vaccination supplement with our adjustment of status application. The vaccination supplement must be completed by a designated civil surgeon..."
  9. Yepper, I know what you mean. Jingwen's and the kids' EADs were pending for 90 days - nothing. I finally got on the phone with the 1-800 people. When they asked to speak to Jingwen, I gave her the second phone so I could listen in. They asked if she was Jingwen. As she spoke virtually no English at the time, she looked to me as I nodded my head. She answered "yes". A couple of other questions and a few head nods got through the "verification" process. When I finally got back on the line, we were instructed to go to the USCIS local office with a copy of the I-797 showing receipt more than 90 days ago. We went down without an appointment (no InfoPass at the time), got in line, and were issued temporary EADs on the spot.
  10. I'm not sure you really need to do anything other than to take care of your own well being. If I am reading your timeline correctly, she was K-1 and arrived in the US 7/21/05. You guys did not get married and she left the country within 90 days. Presumably, her I-94 departure card was taken when she left the US, and a record of this is or will be in the system.
  11. Congratulations on getting the interview date, but it is very important that you get that P4. Your fiancee will likely not be allowed into the consulate without her appointment letter which is contained in the P4. I think a few others had to follow up with GZ to get the P4, so keep on top of them to make sure she gets it. On the follow to join question for the daughter, did you list the daughter in the I-129F that you filed with USCIS? Also, did she receive her own P3? If so, chances are good that she will be expected to attend the interview with her mom and complete all the forms, etc. If she is interviewed and receives a K-2, she will have 6 months within which to use it or lose it. If she is not planning on going to GZ with her mom for the interview, make sure GZ knows this. If this is the case, she will have one year from the date her mom's visa was issued to get hers. And, yes, she will probably have to go to GZ for a separate interview and complete all the forms, etc., just like her mom did. Maybe others with actual "follow to join" experience can correct any of my errors.

  14. Ah, another Frank. Go to have you aboard. Can you tell us a bit more. Are you talking about the packet received from the National Visa Center (NVC) sent to CR/IR-1 immigrant applicants or the Packet 3 sent from Guangzhou (GZ) to K visa applicants?
  15. Looks like you're on the last leg. Good luck. I'm with the others here. The schedule is a little tight but workable assuming no problems. You can pay a few extra bucks for an expedited exam if you want.
  16. Welcome Bill. It looks like a horse race between your K-3 and your CR-1. Thanks for the info on passports. I needed additional pages and used this as an opportunity to go inside the consulate when we were in Guangzhou, look around, and meet a few people. From the consulate's website: "...Those only needing to add visa pages to their passports will submit an Application for Additional Visa Pages (DS-4085). This service is always free of charge." Good luck.

  18. I've read about this too. Consider this as well. If Jingwen is correct in saying that the registration is linked to the prostitution laws, imagine what the effect would be on the visa process if your SO had to disclose an arrest/conviction when applying for a visa. What do you think the VO's reaction might be?

  20. Wow Tony. What a way to start the weekend. I hope the "no interview" holds up. Both Jingwen and her daughter were adjusted without an interview. I hope the same holds true for my step son. Good luck to all whose case were transferred to CSC.

Specifically, it says: "...Aliens with properly filed applications for adjustment of status under both sections 245(a) and 245(i) of the Act will be considered aliens present in the United States under a period of stay authorized by the Attorney General..."
  22. I don't want to get too technical here, but the Department of Homeland Security (DHS) is a cabinet level department and is separate from the Department of State (DOS). USCIS is part of DHS while the embassies and consulates are part of DOS. Petitions are filed with USCIS; visas are issued by DOS. Confusing? Yep. Inefficient? Yep. Governmentally bureaucratic? You betcha.
  23. Betty, I am creating a new topic for your questions. First welcome to Candle. I assume you are the Chinese beneficiary of the I-129F petition filed by the US citizen. If I am wrong, please correct me. Assuming your American boyfriend lives or lived in Illinois, the Nebraska Service Center is probably the right place for him to file the petition. I'm a little confused though. When you say you sent the petition via EMS, I read this to mean that you sent the application from China to the United States. Does your boyfriend now live in China?   24. You should send GZ an e-mail and politely inform them that your fiancee has not yet received her appointment packet (P4). Make sure you let the consulate know that the P4 was sent on such and such a date and that the interview is already scheduled for October 31. Request that they promptly send another P4 to her and provide them with her address. Forget about your getting the P4. Focus on making sure she gets the packet.
