  1. postmarked before 30th via USPS. I'm not sure with FedEx. I don't think their date system counts as a postmark. It better make it to Chicago by July 28th to count if using FedEx. oh, i'll just use usps then and send it tonight if i do, which the wifey is now pushing for. she think i'm exaggerating!

"For example, if your application fee is $325.00 and you arebetween the age of 14 and 79 (which means you must befingerprinted), the total fee you must pay is $395.00." damn u!! ok, does it have to be postmarked before the 30th (USPS), or do i need to overnight this using fedex if i do do it?

That doesn't sound like they will simply return my check and documents, it sounds like the case is denied without a fair chance, and then I'd have to mess with overcoming or worse. If worst case is I get the docs and check back and have to resubmit with all the required docs, that's not a big deal. I haven't heard of a denail coming out of the initial filing. There are 3 things that people have reported happening: They accept the I-485 and begin processing They accept the I-485 and send you an RFE which defers processing. Return the I-485 and Check because of a major flaw in paperwork.(Refuse to accept) The returning of the application is not a denial because they did not accept it to begin with so there is no case to deny. A denial is done by an IO and my understanding is the Chicago lockbox is a processing center for applications and they only assure the USCIS that the paperwork is complete. They have nothing to do with approval or denial. You mentioned 2 missing documents, the I-693A normally generates an RFE. What is the other missing item? I completely agree with Lee on this. USCIS doesn't just take your money and then deny you outright for lacking a piece of info or two. At most, you'll be required to submit RFEs. As bad of a reputation as USCIS has, it is still the US government and they have rules and regulations to follow. They can't just outright deny petitions/applications for no good reason. They have to have very compelling reasons to deny you. Your lack of an I-693a supplemental certainly isn't a good enough reason to catagorically deny your wife's AOS application. yeah, thanks guys. i have one more day to thinkg about it before sending it off air express fedex. i'm leaning toward doing what it says though, as another recent post of mine got wrong advice/information, so i'm kind of having second thoughts on doing what others think. appreciate the responses though. cheers!

  7. Ok, I'm missing two important docs for the AOS. One being my wife's medical records (i163 stuff), as she didn't do the shots in China. We will eventually have the missing docs, but for now we're trying to submit everything so we can beat the deadline (she insists$$, but I don't care). Well, after the her signature it says: "Note: if you do not completely fill out this form or fail to submit required documents listed in the instructions, you may not be found eligible for the requested document and this application may be denied". I was thinking that I can just submit what I have and if they want something else they will do an RFE, but this I485 seems much different than I130/I129f in that they clearly state the application might be denied. If so, then i'd be in a world of ****. Anyone know if that ("maybe be denied") actually means that, or if they mean they will just RFE me. Should I just wait till I have all the requested material? Also, if it were denied, does that mean she has to leave the country, or we have to do some overcome BS?

Because K-1 is entering the USA as a fiancee, to marry, and in many localities, in order to get a marriage license both parties need SSN, in fact there is a federal law on the books for that a is subject to a broadly varying interpretation from state to state, and county to county like in Minnesota. Ok, cool, but i'm k3. So do you know if i do a change of address? The path using the online form seems to suggest no, not for me I don't. But am I changing it for her? She's been here a week and hasn't moved of course since. using the online form it wants to know her old and new American addresses...the fields are for american addresses (e.g. drop down menu for state), so it seems it's not for her either, as she hasn't ever lived in more than one USA addresses, though the new address is different than the original address i used when submitting my i130/i129f. I'm wanting to file the AOS and EAD this weekend before prices go up, but don't know if i need to change my address with USCIS first or not. I moved out of state AFTER my i130/i129f was approved. And at my wife's interview they never asked where i lived at all, so basically nobody knows i've moved. those are some details that may be useful in understanding my situation.
  10. cultural misunderstandings overhyped i think, and probably more of an excuse to not put forth the proper effort to learn about your mate. just be preapred for a long process...make sure your relationship can handle this, and that you spend the proper time to get to know each other and will probably be well for ya in the end. good luck!
  11. jesus, maybe i'm getting this whole thing wrong. am i doing this for her or for me? i thought for me previously, but now i'm thinking it's for her. i did move out of state AFTER both the i130/129f were approved, which means USCIS has my old addresses. Guz never asked my wife either. [end misc. info]

Next Step Is your case still Pending? * Yes, my case is Pending * No, my case is not Pending"" the asterik choices are to continue (above post), where when I click NO, it is NOT pending (i130/i129f have been approved), it brings me to the above post's quoted info, which is a dead end...no button/link to continue with the change of address. is this strange? does anyone know for certain that a change of address needs to be done if the petiions (i130/129f) have been APPROVED, not PENDING?? i know, i know, i could call my friends at USCIS, but that'd take out of my precious lunch hour....
  14. -You need to apply for the EAD if your wife wants to work. If she isn't interested in a job, then forget about the EAD. Save yourself some money. She can get the SSN after she gets her GC. -You need to submit the change of address form AR-11. You're supposed to submit it shortly after you move; in ten days, I think. It's the law. The USCIS could make life miserable for you and your wife on that technicality, if they wanted to. Send in the AR-11 ASAP! -You, as the petitioner, also needs to send in the change of address form I-865. I thought I had to wait 90 days before our 2 year marriage anniversary before we can apply for AOS? About changing the address, I thought i was told or read it doesn't need to be done until she gets here, which she just did last week. I was hoping to confirm that, but you say otherwise... ...tikc tock goes the clock... so i'm changing my address using the online form and it says: "U.S. Citizens who do not have an application or petition pending with USCIS are only legally required to notify USCIS of a change of address if they have previously submitted a Form I-864 on behalf of someone who has become a permanent resident. Mine is not pending, and I've not submitted an I865...so there doesn't seem to be any reason to fret until I subit an I765 or AOS docs, right?

  17. that's normal. gross, but normal ;-) they don't have ranges/ovens for the most part, though it is becoming more common on the mainland with new generation condos. they rarely use a grill, so there's nothing else to cook with. and, they almost never eat their veggies raw like we do...so even vegetables will be cooked in oil. sometimes they steam the foods, but that's it. cantonese, from what i hear, do more steaming of foods than mainland, but all depends on the part of china. and, soups are very common at nearly every sitting. suggestions: -try to use oils that are better for you like olive oil. you will have to experiment with that as oils burn at different temperatures, so the food needs to be cooked slightly different in some cases depending on the oil uses and its weight. -try cooking more soups and fishes as well, and less starchy foods especially if you are all ready eating rice often. too much rice is fattening and turns into sugar/fat. -use less meat like they do in china. one thing that i like from china that's easy and not too fattening is cauliflower and chicken(can be ommitted). use a little oil, throw in the cauliflower, salt, sliced garlic...wait a few minutes until a little brown, throw in thinly veiled cihcken breast meat, wait a few mins, add a little chinese vinegar and a little water and let simmer for few mins until chicken is cooked and cauliflower soft but still firm. something like that will have oil, but most of it will be at the bottom of the bowl, especially with the little water added. chicken breast is not fattening, cauliflower, even though cooked, is still good and of course garlic is good for ya. we also cook most of the dishes as vegetables and normally only one meat dish, and little meat at that.
  18. The EAD takes 60 to 90 days to process - file I-765, K-3's may file for EAD before filing for AOS. unreal, we have to wait 60-90 days to get EAD just so we can get a SSN. thanks for the info...just amazing why i didn't expect more insanity just because she is here now.

I celebrated my wife's BD at her parent's house in China last year, and we had a cake with the cool little chinese firecrackers on them, and a dinner which i cooked. she had some small gifts from friends and from me as well. for her friends we did the same thing, but brought the cake and gifts to a restaurant, ate, and got wasted on KK beer.
  20. GREAT...why does k1 get EAD but not k3? makes absolutely no sense. so applying for EAD is NOT the same as applying for AOS, right? how long does it take to get this EAD crap done?

  22. One thing that probably makes a huge difference is their age. A older woman that has lived in the big nasty city her whole life will probably welcome the slower lifestyle, clean air, and trees, but a young Shanghainese might not be keen on the idea of not having shopping districts at her feet.

  24. My concern was her having to sign the returns and me providing information about her income. I will file single. More importantly, I think I have to show myself being married on the tax return she will take to the interview, for safety sake in my situation... I didn't know I should have done it before or I would have. My wife actually brought this up to me... She talks on 001 quite frequently. who, me? i already got my taxes processed and returned in about 6 weeks, including her ITIN. when you file in the states you submit the W7 with the federal tax return to the Pen. state address, not the Austin address like normal. They process your W7, produce an ITIN and attach that to the federal taxes for processing as either MFJ/MFS. You don't need to submit for a W7 first, wait for it, then submit the federal forms.
