Just started the process
Randy W replied to Robertw711's topic in General Visa Discussion & First Steps
One more - If she is here already on a student visa, can she file to Adjust Status as the daughter of a K-1 without getting a K-2? It seems like a second visa would be redundant, and may require a trip to China without having a return visa in hand (student visas are single entry). 234903 Randy....maybe you are right.... I'm not an expert If the daughter can be given a visa number without an I-130, you could be right. But if she needs an approved I-130, I think there may be a problem. Read the instructions to the I-130 Sec. 3? Again, I hope I'm wrong and the process for getting the 20 year old daughter here goes without a hitch. Family belongs together! PapaBear B) 235009 The I-485 instructions also say that you can file an I-130 with the I-485. I'm not sure, but I think that's only necessary if it's been more than a year after the K-1 was followed. That is, the "follow-to-join" status is still valid. Section 2 of the I-130 says that you may file for the daughter (under 21) of an LPR. I don't think we've heard from anyone who has experience with this, so be sure to check with an immigration lawyer. The two saving graces here are the K-1 "follow-to-join", valid for one year after the issuance of the K-1, and that she can file the I-485 simultaneously with her mother for LPR status, as opposed to applying as the step-child of an American citizen (again, this is my own understanding). -
Tax Transcript or 1040 ?
Randy W replied to RivaRich's topic in General Visa Discussion & First Steps
I'm under the same impression because the transcripts are the IRS's summary of what it actually received. However, copies of the actual return are more than adequate. You do not need to order transcripts if you have the copies. The W-2's pretty well complete the picture. -

The form I-485 seems to say that she can simply file for Adjustment of Status with her mother: while the instructions say : -
No, you won't go. (Don't)

This does NOT apply to K-2's (only K-4's). If you are applying for a K-1, her daughter will be k-2. -

If her daughter is already here on a student visa, she has a year after graduation to get a job with a company that will sponsor her green card. If that works she can get it on her own. We are applying for my wife's son to come here. He turns 21 in Dec. -
Meeting Support requirements
Randy W replied to Rickmt57's topic in General Visa Discussion & First Steps
The minimum is 125% of the poverty level for a household of two, which I'm pretty sure the $22000 meets. You can also get a letter from your present employer to verify present income. -
Wow! Congratulations!

Lee..... When I write the simple words, "I am da boss", she still does not understand. Any suggestion??.... 234709 Chefy, quit using slang, what do you think she watched Seinfeld half her life? Try very precise English and spell check it carefully. I found that what we consider common jokes are not all that common and usually are not considered jokes when translated. Besides any semblance to you being the boss is all in your mind and she will be sure you fully understand that very very quickly. 234716 Have HER explain it to YOU.

But remember that the I-864EZ does not require notarization, and keep an open mind that things may be changing here.

Once again making it very clear how much our lives are in their hands. A sad story.

They don't want a family member who might answer for her. A neutral 3rd party is preferred.

From the link: By this, the marriage was "contracted" when she (the ex) made him (her "husband") her beneficiary. UNLESS - he was added simply as a beneficiary, and no mention was made of marriage until she had to get him off. What I'm thinking is that he was added as either a "husband", or as a friend. And then a life-changing event was needed to get him off, so she came up with the idea of a divorce. So is it possible that the only time they were represented as a married couple was for the divorce? This is complicated!!

Try saying a word like "dark" without adding an extra sound after the 'k'. It can be done, but it makes a very soft 'k'. Chinese people often hear the extra sound as an extra syllable, and say "dar-ka", especially Cantonese-speakers. If it's too soft, they don't hear it. In Chinese, the only trailing consonant sounds are n, ng, and r, which tend to not have the extra sound. I usually try to emphasize the trailing consonant at first, then say it softer so she'll get the pronounciation right.

K1: No affidavit of support
Randy W replied to Alexli's topic in General Visa Discussion & First Steps
Alex is a male Chinese - he is the beneficiary. His fiance (an American citizen) is the female (gf) petitioner. (from what I can see). The relationship between the brother and the beneficiary is her fiance's brother. This is not a blood relationship, but a relationship nonetheless. I believe it is very common for a petitioner to use their own relative as a co-sponsor. Very few Chinese beneficiaries have a blood relative in the US who can sponsor them. -
Sent to Chicago LockBox... Where now?

Try Fort Smith, AR -
Passport photo shops are very common, both here and in China, and will give you the photos on the spot. They are NOT asking for a picture of both of you together here. Be sure to download the current I-130. The 'ear' requirement is outdated.
