starwalker
My wife petition was denied. We are currently our appealing the decision. Does anybody have any information on the appeal process? Link to comment
pbatt
Very sorry to hear about your denial. Some more information as to what type of denial would be helpful, a blue slip asking for more information or a white slip out right denial. There are many with much more information than myself, but if is blue slip then you need to provide them with what they ask for in the blue slip. If its a white slip then is a good time to lawyer up and try to solve things, someone that knows the inner workings of Guangzhou Consulate.Marc Ellis is highly recommended by many. I am sure there are others. There is a good link under the interview process section for what to do if is a white slip. Good Luck Link to comment
Scott@Hong
On another forum you posted the denial was because of Adam Walsh Act, if true there is little advice people on these forums or any forum can help you with. You need a discussion with a good attorney just to find out your options. Link to comment
dnoblett
K3?? It has been a very long time since a K3 petition makes it to the consulate normally the NVC kills the K3 I-129F and proceeds with the I-130 CR1 visa petition. Was this denied at the consulate Visa interview, or denied at USCIS? Details please... Link to comment
dnoblett
If petition denial was due to Adam Walsh act, details please... Will suggest a lawyer.. One member dealing with this is Reddragon75 has been in appeal process for at least two years, and at the moment gave up waiting apart, and is in the process of moving to China, or is already in China. http://candleforlove...petition-deniedhttp://candleforlove...l-this-ever-endhttp://candleforlove...34717-good-news A denial over Adam Walsh will be a LONG road to overcome.. The Adam Walsh act was put into place to protect prospective immigrants from situations like this: http://candleforlove...but-real-story/ Visa Journey has a forum that covers extensively IMBRA and Adam Walsh: http://www.visajourney.com/forums/forum/126-imbra-special-topics/ Edited December 30, 2011 by dnoblett (see edit history) Link to comment

dnoblett
What ever happened to the Red Dragon you were speaking about?Sounds like very long odds .Last he indicated he is moving to China, probably to teach English while waiting out the USCIS. http://candleforlove.com/forums/index.php?app=forums&module=forums§ion=findpost&pid=580668 http://candleforlove.com/forums/index.php?app=forums&module=forums§ion=findpost&pid=577643 http://candleforlove.com/forums/index.php?app=forums&module=forums§ion=findpost&pid=569794 http://candleforlove.com/forums/index.php?app=forums&module=forums§ion=findpost&pid=569789 But yes, when dealing with the Adam Walsh denial, it can take years to overcome, in this case the petitioner has to convince the USCIS that they will not endanger the prospective immigrant.
