Squonk Posted August 4, 2008 Report Share Posted August 4, 2008 My fiancee, her 8 yr old son, and I went down to the SSA on August 1st. She had no problem in submitting her SS application. However, her son's application was denied because they needed additional information from USCIS regarding his age. They stated that the Chinese birth certificate was unacceptable because it was notarized.They also stated that his passport along with his active I-94 was unacceptable. The SSA was not clear about what information they needed, but they stated that the USCIS would know. I contacted the USCIS and they were clueless. dnoblett Posted August 4, 2008 Report Share Posted August 4, 2008 Sounds like SSA officer was confused and using any excuse other that the correct one about K-2. Since K-2 is NOT work auth, they cannot issue an SSN until K-2 has EAD or green-card. Link to comment

Go back with a copy of the SSA's internal memo about K-1's (I can find it tonight if someone else doesn't). Or better yet, just go to another office where they might know what they're doing. According to USCIS, a K1 or K2 cannot change status to another category, even within the K series?You were dealing with a clueless person at SSA, some just go back to same office and apply in maiden name, and deal with changing the name on SSA card after getting green-card or EAD, or others just go to a different office. K-1 can apply for SSN within 76 days of entry to the USA, marital status has no barring on this. Link to comment

Based on the POMS Reg's, she's authorized without an EAD but only for period of 90 days or until her K1 Visa expires? Accordingly she should have her EAD card by that time unless USCIS (MSC) is dragging there feet to process the application? Also while we were there, this person did state that his wife is an USCIS adjudicator, I really need to gets this guys name, as I see this as a conflict of interest regardless that they both work in 2 seperate entities (Gov. Agencies), it would be hard to prove is they are able to be unbias in there decisions? Link to comment
