Got RFE today

David, as a side note: I read (on the VJ example RFE notice) that the RFE will be sent to the CSC address listed on the RFE notice. Because I was transfered from NSC to CSC would your take on it still be that I send it to the CSC adress listed on the RFE? I only ask because in the past I have read that correspondence should always be sent to the original place of filing, and that they will then forward it to the correct place.

send back to CSC... that's the center processing the petition at this point.

 

As another side note:

I read on VJ that CSC RFEs were sent out by now, if the originating submission was to CSC.. those transferred might not be sending out RFEs yet. Would be good to hear when someone who was transferred gets an RFE...

I should be getting it in the mail soon then, seeing that they are working on the CSC petitions first. I will post here when it is received. I would expect about a 15 minute turn around for me (fill out and make copies), UPS next day air return and in CSC hands about 9:15am the next morning.

I'm glad to hear you got your RFE. CONGRATS TO YOU!!! I hope to get mine very soon. I'm sure it will arrive any day now, as I was only a few days behind you in my initial submission.

 

Maybe we will very soon be moving forward in this process again.

While this may well be good advice for a police report, the USCIS and DOS forms provide specific instructions to use "none" or "N/A" as appropriate. This does not mean failure is assured when not following instructions but to follow the actual instructions is a far better policy than to do otherwise, IMO.

The questionaire has no box to check, does not apply. The lead in statement to the check boxes simply states "Check all that apply". Who knows only time will tell what they want. Merely an opinion of mine, not legal advice. It could go either way in court should it ever get that far. One lawyer could argue ommission is hiding something and or writing something means you have something in your past. this is a question for attorney, USCIS, or DOS probably to get a straight forward answer, if possible.

Yes, with regard to the RFE, leaving the spaces blank indicates they do not apply. The other visa forms request "none" or "N/A" as appropriate. This is distinctly different from what might be good advice for a criminal matter.

I finally received an RFE today concerning IMBRA.?I just want to be sure on Questions 2 and 3 where it asks about convictions of various crimes:

 

There are no choices to say "No" or "None" - so, just leave those questions blank, right??I have not been convicted of any crimes.

Glad to hear that they are finally starting to move on this IMBRA thing. Without seeing the form, how the question is asked, or how you are expected to indicate a negative response, it's difficult to understand what you mean. I am sure, though, that others dealing with this issue will help you figure this out.

 

You haven't been convicted of any crimes because I didn't take you to court on slander charges for calling me an ***** last week.

Here is the way the question is presented:

 

2. Have you ever been convicted by a court of law (leaving out some wording here) for any of the following crimes. Check all that apply.

 

___ Domestic violence, sexual assault, etc. etc.

 

___ Homicide, murder, manslaughter, rape, etc etc

 

___ Three or more convictions for crimes relating to a controlled substance or alcohol not arising from a single act.

 

 

That's it, it just says "check all that apply." It does not say to write "No" or "None."

It's not the perfect form, but adding your own method of clarifying what they are asking is asking for another RFE requesting the legal records for the items you marked in any way.

I agree.. by DESIGN, the form is setup to either check something or not.

 

Don't compare it to other forms which has a blank space for which you can legitimately enter [ No, None, N/A]...

I have received numerous emails and date changes, but when I log on to my account, it only shows June 17 as the last date the petition has been logged into for any reason. Nothing about the case getting an RFE or one being sent yet. Maybe it will just come out of the clear blue with no heads up.
