  1. hello to CFLs i am confused about poverty line , in order to assest the income whether higher than 125% of the Poverty line , which item in Form 1040 is the refrence ? item No.7 in "Income " section or item No.37 in "Adjusted Gross Income " section ? if USC's foreign earned income be higher than 125% of povrty line , do we still need co-sponser ? we have decided to DCF and move to US together after visa issuance ,so we will not have any job or income in US at interview time. thanks
  2. Hello, Both my mother and brother will be joint sponsor's for my wife. In his I-864 he only sent me his 2013 1040 tax returns. It says on the I-864 that 3-years is optional. Is that necessary to have 3 years worth of 1040 tax returns? Thank you for your responses. Best regards, Julian
  3. I am a US citizen. My wife is Chinese. We have been married for seven years. She has a 14 y/o son (Chinese citizen) and, together, we have a 2 y/o daughter (US citizen). We live in China and have for the past eight years. I am filling out the I-864 and I am form challenged. Do I fill out one I-864 for my wife and one I-864 for my stepson? Do they then each become the "principal" immigrant in Part 2? or what? Part 1 line 1. Is this for my name? last name first, first name last? Are petitioner and sponsor the same? I mean are they synonyms and used interchangeably? 1.e. There is a "sponsor/petitioner", a "1rst joint sponsor", and a "2nd joint sponsor". Does that mean 3 people can be sponsors? The "sponsor/petitioner" can have two additional people to assist in the financing? Part 2 line 5. I have a GUZ and an AA confirmation number. What goes in the Alien Registration area if I don't specifically have an Alien number? Part 3 line 1. and 2. Since I am sponsoring both my wife and stepson do I check both 1 and 2? Line 2 has a note stating: Do not include any relative listed on a separate visa petition. Well, I filed an I-130 for my stepson as required so do I put my stepson as Family Member #1 or not? Line 7. If I check line 7 does it mean that I don't have to file a separate I-864 for my stepson? This ties back to the first question..ie: Do I file separate I-864's with duplicate supporting documentation for each? Last query (for now) My sister is going to co-sponsor (joint sponsor is the same thing?); Does my sister simply fill out ONE form with both names and include her financials? Finally, thank you all. I really mean it. You have to be a paralegal to get through all of this. I understand the intent, it is the clarity of the instructions that tend to be less specific and more generalized. Once more, thanks. The empirical data available in this forum is priceless.
  4. My wife had the interview today and did great. She said she was one of the only few speaking English the entire interview. So proud of her! Even though my fathers income as reported on his I-864 exceeds their standards, they requested an I-864a from my mother. Few questions: First, I planned on submitting her passport with the documents. Confirming this is the correct course of action. Second, my fathers I-864 would technically be incorrect since we did not include my mothers income. Should I worry about this or assume they can do the math? Third: how much time does this usually take? Thanks
  5. Howdy, Please note, I am doing DCF in Guangzhou. I feel bad posting a thread every day, but I honestly don't know what to do when my searched turn up nothing or conflicting answers for some specific questions. But please know that I've been researching these questions for over a day and am still coming up short on answers. They're pretty brief questions, so here it goes: The Guangzhou Consulate website says to also bring the beneficiary's passport when filing the I-130, or if you don't have it you should bring the birth certificate. Is this true in practice? By beneficiary doesn't have a passport yet, but will have one before the interview... My father will need to cosponsor the beneficiary. I have a few questions regarding this:My father also lives with my mother in the household, but my mother doesn't provide any income. Is it necessary for my mother to fill out an I-864A?It's okay to have a co-sponsor when filing DCF, right?My father isn't going to be asked to be present at the time of filing nor interviewed, right?The household size would be 4 on both my father's and I's I-864, right? We intend to live in my parent's home (my father, mother, myself, my wife).I'm concerned that my girlfriend's hukou city (Changyuan, Henan which is near Xinxiang and I guess technically "belongs" to Xinxiang) isn't going to have a clue with regards to translating the necessary documents. I've read that the translations need to be done at, at least, a city-level notary. Changyuan is like a county. We are going to need to go to the designated notary in Zhengzhou to get our marriage certificate(s) translated, could this office also translate the rest of the documents we get from her Hukou city?I've heard from some Chinese friends that they received two marriage booklets and that is their marriage license. Exactly, what document(s) is/are received after registration of the marriage?Finally, I've read the filing guide on the Guangzhou embassy website and also the FAQ that states: I've read a bunch of reports of people's experiences submitting their I-130 petition and they included a bunch of evidence with it. So, in practice, is it necessary and/or helpful to submit as much evidence as you can at the time of petition filing? Thanks a ton, guys... All the best, Jake
  6. My wife and I have been married since 2011. During this time I have been filing my taxes as "Single" under bad advice from an accountant who I had handle back taxes years ago. After reading that this would be a red flag for the immigration process, I attempted to ammend my last 3 years of tax returns by filing 1040x for each year along with an explanation for the incorrect filing status and a copy of our marriage certificate. This was months ago and the changes still aren't reflected on my IRS tax transcripts. Would it be acceptable to provide full printouts of my past 3 years tax returns along with the 1040x's attached to the front? This is the only item I'm worried about when time comes for my wife's interview and I really want to make sure we don't get screwed over due to it.
  7. My mother is our co-sponsor and has completed the i-864 form and provided her tax transcripts for 2013 as well as proof of income and birth certificate. My parents are both retired, married/live together, and file their taxes jointly and I'm wondering whether I need to supply an i-864A for my father. If so, does he need to provide the same documentation as my mom? (tax transcripts would be the same, but birth cert and income proof?) Their income far exceeds the poverty line due to pensions and social security.
  8. I'm planning on filing the I-130 about the middle of January. I need my father to fill out the I-864 as well as me. Part 7 requires the adjusted gross income from the most recent 3 years. Problem is this: Taxes for 2014 aren't due until April 15, 2015. W-2's for 2014 aren't even required to be mailed before January 31, 2015. Will I need to worry about the 2014 tax year? For my father, there will be no significant difference. The 2014 tax year for me would look better, but not nearly good enough to file without a co-sponsor.
  9. Hi everyone, First of all I would like to say thank you for all of your helpful posts, it has really helped me and my husband during this long process. We are in the final stages and have our interview scheduled in 2 weeks. I just have a few questions about the AOS form. I am the petitioner and my husband (French) is the beneficiary. We have been living in China for the past 5 years and now are planning on moving back. We will live with my mother upon immediate return and while searching for new jobs. My salary now does cover the poverty lines, however I do understand that this will not really be considered as I will techinically be unemployed when we move back to the US. I have a few questions below and confirmations: 1. Since my mom will act as the only joint-sponsor and her income is above the poverty line, does she need to fill out the I-864A or just the I-864? 2. When she does fill it out, is her household 2 or 3? Myself, husband and her would be living with her, but I am not a dependent legally, I think it should be 2 only, my husband and her-but not sure 3. Since I am filling out the I-864 as I am the petitioner, would my household be counted as only 2 since it will be me, my husband and mother too? 4. Also, since my current job here in Beijing will end shortly, do I even put that in the section under Sponsors' Income and employement, under the 'individual' income as I am still employed until we leave for the US? 5. #10 is the current annual houshold income (compared to poverty) if mines does not reach the lines, which currently does, will not when moved back to the US, does this matter as my mom will be filing as a joint sponsor and her total number will be higher? I imagine that I should fill it out with my current employment information and it will be supplemented with my moms? Thanks for your help!
  10. Hi All, My fiancee is getting ready for the interview soon. I have the I-134 completed with pay stub and employment verification letter from my manager. Is this enough or I need to give her copies of my tax return for the previous 3 years? The tax return forms are required for the interview? Thanks!
  11. I found myself very frustrated. The I-864 part II requires an address, presumably to be complete enough for me to recieve documents mailed to me while my wife and I are in China. The problem is, the street address simply will not fit. If I can use a P.O. Box, my address looks like this: P.O.Box 603, Chang'an South Road ... well, that could fit. But isn't the requirement for a living address? But my real address is like this: Room 17, No. 1, Foreign Teacher's Apartment Building, 637 Chang'an South Road I seem to be limited to 30 alpha-numeric characters. I cannot write Chinese there. If documents are to be sent to the address, I want to receive them. This is the first United States Federal form I have seen that was so foolishly designed. All others have two lines for street addresses, usually with the ability to put more information in each line. There are common abbreviations I can use, but those still would have me go over the limits of the form. So, what am I to do?
  12. I was unemployed during 2012 for a year thus my income wasn't higher than 125% poverty level. I make a good living in the software industry so all other years I should be good. Is my unemployment in 2012 going to be a problem for my K-1 application?
  13. When I emailed the affidavit of support form it says : you much send all documents in one package, but keep the attachments below 5mb. What's the one package meaning ? one email ? or several emails at the same time?

  15. hi, after paying the fees. i am submitting supporting documents. pictures and proof of our relationship was turned in, along with our marriage certificate and our divorce papers. am i to resubmit these papers at this time? can i submit pictures from recent time together and / or conversations since i turned in the petition?

Hey guys, In the never ending saga that is my wife's CR-1 interview preperation, I'm now filling out my i-864, something I didn't realize I would have to do since I have my grandfather's i-864 joint sponsorship form (and my grandmother's i-864A). As usual, I'm confused some about what to check and what to fill out and what not to, but let's start with an easy one: Part 3, item 1: I am sponsoring the principal immigrant named in Part 2. Do I check "Yes" or "No," considering I do not at all meet the income requirement for this. No notes "Applicable only in cases with two joint sponsors," which is confusing because I guess I have 1 joint sponsor (my grandfather) plus the i-864A (my grandmother). - Sam
  17. Hello everyone, there has been so much great advice and commentary in this website, I thought I would post my own question to get some more opinions and suggestions. We had our I-130 approved just last week from Beijing USCIS, and now we are preparing for the interview in Guangzhou. Regarding form i-864 Affidavit of Support, I wonder what people do when the husband, me, is unemployed at the moment and doesn't have a job lined up in the US yet? (I left my job recently and will definitely get another one later, but at the time the interview happens there will be nothing to show as current income) The form says we can use other assets to meet the income requirement. has anyone done that before? Like using the value of our home in China? or using my wife's (Chinese national) bank account? Does that suffice? In the interview has anyone ever been asked where the money in a bank account comes from? how specific are their questions regarding source of money, or do they just need to see that you have money?   18. Hey guys, So as I've posted before, I'm preparing for my wife's CR-1 interview just weeks from now (Nov. 20th). I have just about everything ready, and I'm using a joint sponsor (my grandparents) for the financial support requirement. But I've recently learned that, despite using the joint sponsor, I need to fill out form i-864 myself, as the petitioner. So my problem becomes that I didn't file taxes for the last two years. For 2012, it's no big deal -- I was still in the U.S. for that entire year, unemployed, so I just filled out a standard 1040 and will attach that to my i-864 with a note explaining that I was in school that year. For 2013, I was in China -- i arrived in China and started work in February (on a tourist visa, eep). I worked for the entire year (I stopped working in June 2014), and my income, as calculated, was roughly 68,000RMB. I know I need to fill out another 1040 for 2013, and I know I need to attach to that either a 1116 or a 2555-EZ. I think it's the 2555-EZ that I need. I finally found the 2013 2555-EZ (thanks, Daniel), and am now struggling to fill it out. Line 11a of 2555-EZ in particular, at the moment, is confusing me: "List your tax home(s) during 2013 and date(s) established." I don't know if i fill out with like the countries listed and the dates I was there in parenthesis after or what, and of course the instruction PDF for 2555-EZ doesn't list anything about line 11a. I arrived in China on Feb. 17th of 2013. I was on a tourist visa until I returned to the U.S. from June 1st—June 11th to get my work/Z visa. I returned to China on June 11th of 2013 and from then on to this day I have remained in China. If Randy is out there, I could really use your help with this damn form! - Sam
  19. Hi, I am ready to email the I-864 to the National Visa Center. But, i still haven't received the Alien registration Number that is listed on the form. When and where do i receive this number?

Will I need to submit the cover sheet as well with the I-864? Also, some of the douments that are listed on the cover sheet, i have previously submitted. Do i just mark the cover sheet as not applicable? I am currently visiting my wife for a second time. Can we submit pictures taken from this trip as well? Alsowhen will we receive our Alien registration number

  22. Hi there, Is the A-number 8 or 9 digits? The number I found through USCIS is 8 digits but the I-864 shows 9 spaces. I think I have the right number? Is the case number the A-number? Best regards, Ben
  23. Hello there, I am new to the forum and am seeking some advice. I am a US Citizen, I have been working in China on a Z-visa for 3 years with a net income of about 20,000 RMB a month which is deposited into my Chinese bank account. I don't send over any money to my inactive empty American bank account. I have about 50,000 RMB in my local bank account. I don't currently have a job waiting for me back in the US and am working for a local company. My girlfriend and I have been dating for one year and we are getting our hukou in Harbin in October. After the hukou, I plan to apply for her to immigrate to America (I-130). Can anyone tell me what minimal financial standing I or she needs in order for us to to get approved? To be specific: Should I send money over to my US bank? Does she need to have any money in her own local bank account? (I deposit some money over to her every month to help pay bills/rent to the landlord) I am planning to ask my mother (home owner/ my residence in the US) and brother (high income) to apply for affidavit of support with me. Another note is I filed bankruptcy about 5 years ago but I've been maintaining several credit cards and building back my credit. All of your input is very much appreciated. Best of luck to all of us.   24. Dear Mams and Sirs, My specific situation is this.... I earn a foreign earned Chinese income and can't count it (not enough to meet the 125% requirement anyway), and can't get a joint sponsor. However, my wife has deposited money into a U.S. bank account, in her name, the last time we traveled to the U.S. on a travel visa. Part of this money was provided by her father. The money is in her name only and surpasses the 125% X3 requirement for using assets. She is the beneficiary. I am aware that we are required to include deposits, bank statements, a letter signed by a senior bank official and proof that money can be moved and anything else that shows the movement of money for the previous 12 months if we report money still in China. 1. But I wonder if this proof is required of the beneficiary if the money is already in the U.S.? 2. And the other concern is the fact that a large portion of the money was provided by her father. Again this money is in a U.S. bank account. Will this be an issue? 3. One more dimension to this question.... Since we are totally using assets, more specifically money, to meet financial requirements and no personal or sponsor's income, are we going to run into problems? I know these are crazy questions. Thanks to anyone for help!!!
  25. Sorry for all these questions...about everything. I'm needing to fill out the I-864 for the visa process for my wife's daughter. My wife is the petitioner (she sent in the I-130 for her daughter), I'm going to be the sponsor. Do I just fill out the regular I-864 or ? It gives these options.... You can use the I-864EZ if all three of the following are true: You filed a Form I-130 petition, for your relative (I didn't file the 130. My wife did.)There is only one applicant on the Form I-130 petition, and (There is only one applicant on the 130, her daughter)All your qualifying income comes from a salary or pension and shows on one or more W-2 Forms that you receive (All the qualifying income does come from my salary and shows on my tax returns I'll be sending in.)Then it gives this.... If none of the above apply (but some of them do apply) and you can use the regular I-864 So my main question would be is my wife the sponsor and I am a supporting sponsor? Or am I the sponsor as it's 'my' income it will be based off of. And what form do we use????? Sorry. Maybe I have "form overload" and they all scare me!!! Or at least making a mistake on them does. Thanks again!!
