  1. This is for a DCF proof of residence, correct? We were submitting them as relationship proof, though perhaps that's what the consular official thought now that you mention it. hi yanglan how did you translate your leases ?by yourself or in official translation office ? did you translate whole lease with all of common conditions which all leases have or just trasnlated important info like names , address and date of lease , amount of rent etc ? thank you
  2. The married, filing separately status does NOT require that both spouses file a return if one is below the threshold. When you file married, filing jointly, you need to report ALL income. When you file married, filing separately, the foreign spouse does not need to report foreign-sourced income, unless he has filed a return in the past. See Publication 519, U.S. Tax Guide for Aliens and Publication 501 (for Filing Requirements) for more information. Thank you very much for your clear answer and explanation , my last question is on the foreign earned income form there is a question asks“ for what period your family has lived with you in tax year?” we have lived together for long time , and married since second quarter of 2014 which means became a family officially , what date should I write down ? all tax year that we have lived together(but for a part of that not being a family officially) or just date after marriage registration ?does it have any conflict with the other forms and documents which show we are living together for long time? Thanks
  3. hi guys , sorry for asking too many questions about tax filing as i said i am going to file my tax as "married filing seperatly " , but should my Foreign spouse also file tax while he has not have any US earned income or it is not necessary ? thanks
  4. hi CDFLs When filing my 2014 taxes (married filing seperatly) on Turbo Tax it wants me to enter my spouse's SSN. He doesn't have one. It is allowing me to leave the entry blank. Do we need to apply for an ITIN? He isn't going to file US taxes because he doesn't have any earned US income. thanks
  5. hi guys i want to know how long will the DCF process from I-130 filing to interview usually will take? thanks
  6. hello to CFLs i am confused about poverty line , in order to assest the income whether higher than 125% of the Poverty line , which item in Form 1040 is the refrence ? item No.7 in "Income " section or item No.37 in "Adjusted Gross Income " section ? if USC's foreign earned income be higher than 125% of povrty line , do we still need co-sponser ? we have decided to DCF and move to US together after visa issuance ,so we will not have any job or income in US at interview time. thanks
  7. hi i decided to ask my questions here rather than creating a new topic . 1) my wife is filing her tax , and i read here we need to file tax as " marraied filing seperately " or " married filing jointly " , what is the difference between them ? both of us living together in china and i dont have any SSN. 2) the second question is i am a student and i dont have any official job , sometimes help my teacher and get some money , and last year for some months i have got very little money from school as helping in living expenses which also there is not any official pay check for that , should i claim no income ? thanks for help
  8. thanks alot for your help . i like to fill in my forms through an immigration attorney , because there are some questions that i feel is better to be confirmed with an attorney and get some legal advices (jut helping in forms filling not filing and sending and receving documents to consule). do you guys know any good immigration attorney in beijing ?? thanks for your help
  9. hi CFLs , i am a new member and happy to be a part of CFL big family. I have studied most of topics here and they are really helpful , thanks to everyone. me and my wife are living in China at thee moment and we have decided to DCF I-130 , but there are some confusing parts in the form that I really need help with. My questions about form I-130 are as below: 1- most foreigners after entering China pick up some Chinese names , some are really chinese and different from their orginal name , but some are just made according to the orginal pronounciation of the foreign name(with different pinyin) , if your chinese name is just made according the original pronounciation and has been used in some official documents is considered as "other names used " which is asked at C-7 of I-130 or it is not considered as other used name because the pronounciation is the same ? 2- Do students need to fill in section C-15 which asks " Name and address of present employer "? is the university which you are studying at the moment considered as your employer or do we need to write n/a? 3- what is the difference between C-2 " address " , C-19 "your relative's address abroad" and C-20 "Foreign address in native alphabet" in form I-130 ? we are living in China now. 4- should we write address in chinese style (like : country then city , then road ) or in american style ( first write number then road and then city ..)? thank you in advance for your help.
