  1. My wife and I got married back in July, I have a stamp in my passport that I entered the country on July the 7th. I did not get a residence permit until October because I needed to wait for my school that i'm attending to handle that, but I have had a stable residence here since July. Will I be able to file in January like I had originally planned? Second question: The DCF guide mentions that these documents need to be included in the filing at the point of the interview: Notarization/translation of beneficiary’s birth certificate Notarization/translation of beneficiary’s hukou Notarization/translation of beneficiary’s criminal background check Notarization/translation of beneficiary’s marriage certificate Notarization/translation of petitioner’s marriage certificate Notarization/translation of child(ren)’s birth certificateAll of these are no problem, except the part that confuses me is the birth certificate and hukou. My wife does not have a birth certificate, but she of course has her hukou. Aren't they considered the same thing since she was born before 1991 (when they started making official birth certs). How do I go about helping her obtain one. Third question: Where does she get her criminal background check from? We live in Wuhan (Hubei province) and she is from Xianning (which is also Hubei, just an hour or two south of here) Thanks so much, I did search with the search bar, but didn't get the results I wanted.

  3. Finally almost done preparing the I-130 petition! Yet I always seem to be coming up with questions about these tiny bits and pieces... (sorry) Quick background: My husband and I met and lived in South Korea for the majority of our relationship. We did, however, move a lot in 5 years and while we always considered Seoul "home", we also spent a significant amount of time visiting my family in the US and his here in China. I already know I need to include an attachment to fit all the addresses in, but should I include our parents' addresses to fill in some gaps in time? For example, we spent 4 months visiting the US last year (mostly traveling and for the holidays) before we came to China. My husband was on a travel visa so I don't want to make it look like he lived there. The same goes for me visiting China for a month a while back. Except for the 4 month visit (we came to China afterwards), we maintained our Korean residency status but didn't have an address there while we traveled. I was thinking of including our parents' addresses followed by a " (Family visit) " note in the address column...would that work or is it unnecessary? Thanks again! This site is so helpful. ^^
  4. Hello! I have downloaded the I-130 form but there is no barcode when I download from Google Chrome and Firefox . Does this form need a barcode? Does the G-325A need a barcode? Thanks for your help!

Hi everyone i am working on our cover letter for I-130 , we are going to DCF our petition , i want to know which address should i write down on cover letter as petitioner's Address ? state side mailing address or current residence address in china ? if wrtie down current residence address in china does it have any conflict with showing domecile at time of interview? i also did a search on this website and could not find a cover letter for DCF in china, how can i find a cover letter sampl for china's DCF ? Hi everyone i am confused about form I-130 section C question 22 , we are going to DCF our I-130 petiton in China , how should we answer this question ? i also want to know what is the best way to compile our documents for filing? do we need to use a binder with some plastic protection sheet inside it and put related documents inside one sheet ? are we allowed to staple related documents and papers together, for example, staple the whole copy of our house lease pages together or just use paper clip to keep them together ? any detailed advice for documents compiling ? Thanks for your help
  7. As part of the bona fide marriage part proof, we have about 30 photos documenting our 9 year relationship, including the past 4 years of marriage (2 wedding cermonies too). Do I just include them loosely in all the paper work, or should I tape them to sheets of paper so they can be punched and bundled by USCIS? Currently, I'm planning on giving them a heap 'o paperwork with a cover letter for them to bind as the please - they seem to be so darn picky. Is that ok?
  8. hi everyone i have some questions about DCF and I-130 , hope you can give me some information . 1- in addition to the translation of civil documents like marriage certifacte , birth certificate , should we provide any certified copies of them sperately ? or just normal copies are sufficient ? would you please point out which documents need to have cetified copy ? 2- at form G-325A we need to fill out applicant's residence last 5 years , i was living in china in last couple years , but i have travelled to my country couple times (while i had my valid chinese visa and kept my lease in china) ,are all travles to my country considered as residence ? or it depends on how long i have stayed there ? 3- at form G-325A , what should beneficiary and petitioner mark for "this form is submmited in connection with an application for : 1- naturalization 2- statuse as permanent resident 3- other (specify)" in their seperate G-325A? 4- how many pictures are appropriate to be included in I-130 ? i have thousands of them 5- our house lease is in chinese , translation office wants a very unreasonable price for translation , can we translate it by ourselves or it has to have Official traslation stamp? thanks in advance for your time and help!
  9. Hi guys. Very frustrated with the process of gathering white books and records for filing the i-130 in Guangzhou. We got married the other day, and went to get the white books the same day. The people at the office told us we would only need the white book for one of our marriage certificates, because both marriage certificates (red books) are essentially the same, the only difference being who's name comes first. I decided better safe than sorry and got white books for both of our marriage certificates despite their advice. Now my wife has just gotten her white books delivered for the police record and birth certificate... but with no original certificates, only the notarized copy and translation (white book). They apparently said that we won't need original copies, only the white books. Is this right? It doesn't sound right to me. Thanks!!
  10. Hello all, Jocelyn of Speaking of China introduced me to this forum, and after exploring for quite some time, I am still utterly confused about a DCF petition. Let me be specific about what I am confused about. My husband and I got married earlier this year, and we have only recently decided to go to the States. I've been living and working in Xi'an, Shaanxi for four years. I am aware that the following documents are needed (or somewhat optional) for a I-130 petition: - I-130 form - two G-325A forms (one is mine; the other is the husband's) - copies of my birth certificate or my passport's biodata page - copies of hubby's birth certificate or his passport's biodata page - copy of hubby's hukou and notarized English translation - copies of my residence permits (2010 to present) - four passport photos (husband's and mine) - affidavits of our marriage - photos or other documents to show we have a bona fide marriage Am I missing anything in my list? In addition, as far as the filing is concerned, I am confused as to which jurisdiction I fall under. For the eligibility for marriage notary, I went to Beijing. Therefore, I am uncertain whether I should file my petition in Beijing and let them pass it on to Guangzhou, or go directly to Guangzhou. Does anyone have contact information (as in phone numbers) for USCIS or the Beijing embassy? I've already attempted to contact them via email with virtually no luck. I still have a couple of other questions regarding the I-130 form. As for my address, do I put my physical US address, where I still receive mail, credit card statements and the like, or should I put my mailing address in China? As for the affidavits of marriage, do they have to come from US citizens, do they have to be notarized, and who are usually the best options for the affidavits? I ask this because my family, with the exception of my youngest sister, have met my husband. As for organizing all these documents, is there a preferred mode, as in one envelope or should some of the smaller, more likely to get lost items be separated? As for photos, do they need to have a printed date on them or is it acceptable for you to write names and dates in pen? Will they accept a scrapbook filled with photos and letters written to one another? What are the "other documents" that show a bona fide marriage and perhaps should be included in a petition? Is there anything else I may have overlooked about the process of DCF? I am fully aware that I am asking a lot of you all, so if you could even just direct me to a particular discussion within the forum that deals with one, or several of the questions I am asking, I will be content.   11. Hey guys, Need a little bit help here. Here is the situation: My husband stayed home taking care of his uncle for the last 5 years, meaning my husband has been unemployed for these years with 0 income. After his uncle passed away, he succeeded his money and properties. Currently, we are at NVC stage and we are selling the primary residence house to have the money in the bank as asset for I-864 because we are moving to another state after I get back. We also are getting our friend as co-sponsor who earns a very decent annual income. The reason we didn't have families as co-sponsor is either because they dont earn enough or they are retiring in a few years. Info abt me: young, healthy, BS degree in Engineering from a famous US college Our questions are: 1. Will the CO accept our friend as co-sponsor since he is not a relative of ours? 2. Is our I-864 in good standing? 3. Any suggestions? Best Wishes, Jack
  12. Hi again, sorry for the flurry of recent posts, I'm filing my i-130 day after tomorrow. I'm going to write an evolution of relationship letter because the evidence I have to prove that it's a bonafide marriage consists of mainly pictures, train tickets, two affidavits from my family members, and our baby's ultrasound. We won't have the writing under the ultrasound translated, but it will be attached to a post on Facebook that I made with the same pictures announcing that I was going to have a baby, which I'm hoping is sufficient. I'm wondering where to put the letter within the order of the packet? Does the order really matter? I assume it would go with the evidence I will include. Thanks!

  14. Question on immigration procedures. My wife's friend came to the USA to visit her. While here, her friend starting seeing a guy and now is very interested in marrying him. She has a child in China and will be going back to settle matters and bring her child to the USA. The child already has a visitors visa. if after marrying in the USA, what is her next step? Where do they file? Where can she wait pending the review? Must she go back to China? Can she interview in the USA? thank you
  15. Hi all. I'm sure this has been discussed (though I'm having trouble finding it) so feel free to forward me on, my apologies for any redundancy. 1. Could someone please tell me exactly how to format and attach an extra page for our address? We both live in the same apartment in China, but it is a long address so we'll need extra space. Should I write in the space "see attachment"? What should be written on the attachment page other than the address? 2. Given that we live at the same address together as written in line 2, lines 19 and 21 (your relative's address abroad, and last current address shared) would be the same answer. Shall I fill them in anyway (write it on the same attachment page)? 3. Should I wait to sign at the bottom until I am at the embassy? While I'm at it, I have a question about photos. How many passport sized photos will I need for this process in total, including medical check and interview? We'll be going to get our pictures done tomorrow.
  16. hi all just found this forum and relieved to see there is a community put there for advice/support i am a US citizen in SH with a residence permit for work (Z). i may transfer to my company's HK office this year if i submit the I-130 at the USCIS BJ office, immediately move to HK (work visa), and my wife moves with me (HK spousal visa), is there any negative consequence to the immigration process for my wife (PRC citizen)? if so, then is that negative consequence eliminated if she continues to reside in SH (we would maintain and apt there, she would get a HK spousal visa but not move with me, she and I would visit each other often)

Possibly a silly question due to worrying a bit too much... but we are changing apartments here in Beijing in the coming 2 weeks and I have an appointment to file the I-130 petition on March 19 but am not sure which Chinese address to use in the form for where I reside here in China. I still have the temporary residence permit for our current/old apartment, but can easily get the new resident permit for the new place because we've already signed the contract but just haven't moved in yet. While we will be residing at the new apartment for at least another year or until we get the green card (knock on wood), my concern is will using the new address/residence permit work for or against me in establishing my 6 months or more in China qualification for DCF? Or will my work contract(s), past resident permits, work visas, etc. from the past 4 years plus we've been married be enough? Gosh as I write this, I think just get the new resident permit for the new apartment and use that, right? Also - one additional question, although my husband and I have been living together here in beijing and he's been on the rental contracts since we've been married, his offical hukou still has him listed at his parents place in Beijing. Is this going to be an issue? Or do I just put the same Chinese residence address as mine in the form? Thank you!
  18. Hi guys. My fiancee is 7 months pregnant (Due May 8th) and we are beginning the process of the CR-1 Visa. My work visa here in Shenzhen lasts until July 10th. My head is starting to spin thinking of all that needs to be done and knowing that I have so many questions about this process. We have to go to Nanchang (hopefully next week) to actually get married, after which I will try to DCF the I-130 petition as soon as possible. I have a lot of questions that I would greatly appreciate your help with. 1. About the process of actually getting married. From what I've gathered from my fiancee, we need to go to Nanchang because I'm a foreigner and her hometown of Ji'An won't process a marriage with a foreigner. Do I need to do anything special to make sure the marriage is properly registered after I marry in Nanchang? 2. I read that when I bring in the I-130 to Guangzhou, I will need a notarized marriage certificate. I've also read that I will need to bring a notarized translation of the marriage certificate. Where can I get these notaries completed? Do other documents need to be notarized such as birth certificate and police report? I read that her birth certificate, which I think we only need for the interview not for for the I-130, must be obtained by a "local notary public office", and I'm not sure what that means. Does she need to go to Ji'An to get a notarized birth certificate? 3. Since my visa expires July 10th and I doubt the process will be finished by then, what can I do to make sure I'm able to stay in China until the process is complete? Should I go to Hong Kong and apply for a tourist visa? Or is there a longer term visa I can apply for since I will be married? Can we still stay in Shenzhen if neither of us are working or would we have to live with her parents? I'd really like to avoid that because they live in a tiny village in the mountains and I'd rather not bring my newborn baby there. 4. For filling out the I-130, I know this question has been answered before so forgive me, but line 1, 2 and 3 about name address obviously is meant for names and addresses in English. Do we just attach a form with her name and our adresses written and write "see attached form"? Should we use Pinyin or Chinese characters? Line 20 says to write the name and address in relative's native alphabet, so I'm assuming for line 1, 2 and 3 we would use Pinyin. The next few questions are concerning the interview, which I know is in the future but it would help put my mind to rest having a few things cleared up: 5. Does she need to bring both of our "police certificates" or criminal records with her? Or is it just her police certificate she needs to bring? If she needs mine, would I need to provide one from America and Suzhou (where I lived last year) and Shenzhen? 6. I read that her medical examination must be completed in a designated place, but I didn't see it written where that designated place is. Will we have to go all the way to Shanghai to get the medical check done? I'm worried that because the baby is due in early May it will be complicated for her to be travelling around and getting vaccinations. 7. I don't think I'll have a job lined up for when I get back to the US. We've saved up some money and I was planning to go job hunting once I actually get back to the US. I will have a joint-sponsor (my mother) because I would not qualify. Will it be a problem that I don't have something lined up for when I get back? Is one joint sponsor enough (she is well above the poverty line but not rich). Okay that's all that's coming to mind right now. I'm sorry for so many questions, but I'm just feeling very overwhelmed especially with the baby on its way. I'm sure that as I go through the process I will think of a few more. A little about me - I'm American living/working in Beijing for over 8 years, met my husband 7 years ago, were married in China 3 years ago and now are ready to move back to the States. I'm trying to get all the paperwork/forms and steps straight and am really struggling where to start. How to go about it all? Step one - file the I-130 in Beijing and then...? Thanks, Jen
  20. Hello, I hope this isn't a repeat- I looked at some of the topics, but didn't seem to find what I was looking for. Anyway, I'm filling out the I-130 for my wife, who is currently living with me in the US, and so I haven't entered anything on line 19, (Your relative's address abroad), because she is living here. Line 20 asks to write her name and foreign address in her native (Chinese) alphabet. Does she just have to write her name, since she's living in the US, or leave it blank? Thank you very much! Bill

I have studied most of topics here and they are really helpful , thanks to everyone. me and my wife are living in China at thee moment and we have decided to DCF I-130 , but there are some confusing parts in the form that I really need help with. My questions about form I-130 are as below: 1- most foreigners after entering China pick up some Chinese names , some are really chinese and different from their orginal name , but some are just made according to the orginal pronounciation of the foreign name(with different pinyin) , if your chinese name is just made according the original pronounciation and has been used in some official documents is considered as "other names used " which is asked at C-7 of I-130 or it is not considered as other used name because the pronounciation is the same ? 2- Do students need to fill in section C-15 which asks " Name and address of present employer "? is the university which you are studying at the moment considered as your employer or do we need to write n/a? 3- what is the difference between C-2 " address " , C-19 "your relative's address abroad" and C-20 "Foreign address in native alphabet" in form I-130 ? we are living in China now. 4- should we write address in chinese style (like : country then city , then road ) or in american style ( first write number then road and then city ..)? thank you in advance for your help.
  23. Hi folks, First post. (I hear the groans already!) I'm in need of a reality check. I did what I thought was a lot of digging before submitting my I-130 for my lovely Yifang and her son. (kinda) Short version.... I live in the US, she lives in Hunan. We met through a mutual friend online in May of 2014 I flew to China and we married on November 27, 2014 While I was there, we gathered a lot of white books, copies for both of us. Working through RapidVisa, I got 4 affadavits for the bona fides for the package. They reviewed and passed on the package. I submitted the I-130s in January of 2015 Received the NOA1 January 26, 2015 from the NSC. Found you guys on February 1st. I was under the impression that the other items I'm arranging for the bona fides were to be added into the package when the NVC gets it. I have a lot....Pictures with her and her family, emails, chat transcripts, plane tickets, hotel receipts, etc. that add up to a few pounds of paper. I'm also planning my second trip there in april or so, and plan to be there during the interview. In the process of writing a letter to show our timeline of romance! The worry I have is that it seems as though the one chance I had to put in evidence of a relationship was in the original submission of the I-130. This is the impression I get from reading a lot of posts here. Did I pull a bonehead move, or do I have the opportunity to add in this evidence later at the NVC stage? I'm starting to sweat now after reading a lot of horror stories! Any advice? (besides don't be a bonehead?). Experiences and direction gratefully accepted.
  24. Hey all, What are your experiences bringing your spouse with you to the Embassy or Consulate when initially filing your petition? I talked with the Guangzhou DHS/USCIS phone operator and they said that of course the spouse can come but it isn't a requirement. I figure it would be helpful if there are any questions that need to be asked, but it's really quite expensive traveling around China at this time (specifically coming back from Guangzhou because of all the migrant factory workers returning home for the holiday). So, I wanted to know your experiences having or not having your spouse join you when filing. And a second question; have any of you used passport photos from China on filing? The quality is usually horrible and they do so much Photoshop work that it ends up being fakey looking. -J
  25. Hey all! We're working on our petition paperwork and I've come up with a few questions that I'm stumbling over. Research on CFL and VJ hasn't yielded anything, so here it goes: [i-130] I'm currently living with together with my wife in China (we've been living together for the last 2.5 years actually) and I'm not sure if I should put my Chinese or US address in section B of the I-130. [i-130] Section E of the I-130 calls for a phone number, but it's formatted in US style. Should I just leave it blank since I have no US phone number because I currently reside in China?[i-130 and G-325A] The only address that should be in Chinese should be where it specifically calls for it on the I-130 section C. #20, right? Thanks all. If there's some huge resource of filled forms for China DCF petitioners that I've missed I would sure love to know about them. My research has turned up jack. -Jake
