Good day Candle For Love, Wife, and I submitted her I-751 October 10, 2018, and December 16, 2019 our case status updated to "New Card Is Being Produced - On December 16, 2019, we ordered your new card for Receipt Number SRC1990016942, and will mail it to the address you gave us. If you move, go to www.uscis.gov/addresschange to give us your new mailing address." From what I gather this means our I-751 has been approved, "without further interviews", meaning we are "finished" and she will now be on her 10 year GC. Big sigh of relief. With above in mind, I would like to sincerely thank all the amazing people that contribute to this forum. We made it all the way from her AOS from B visa through I-751 lifting of conditions without any hiccups, or need to waste any money to hire outside help. I know this certainly wouldnt have been possible without all your help. Thanks CFL, sincerely.... Please disregard any typos, this a quick note while I'm at the office.

Above should be fine, maybe have some hospital records if the officer would like to dig a bit deeper as to why she has been gone so long. I live in New Orleans, but many China bound delta flights depart from DTW.

** UPDATE ** We had a small mountain of evidence but ultimately didn’t require any. Had a fairly quick conversation with the CBP officer at DTW as to why she was gone so long, he was a bit rude but we shrugged it off (pick your battles). Overall everything went well. Thanks to everyone for their input.

Thanks again everyone. We will go through together. Will hope for the best ( a wave past), and prepare for the worse. Im bringing a copy of our lease, some credit card statements, medical bills, copies showing her teacher / tesol appointments in china showing the spacing, and will have photos from our ceremony.

Thanks Randy, I belive we will be just fine. I will bring documentation to prove connection to the USA. My only concern is CBP always splits you up when going through immigration, so I cant be with her if they try to ask any entrapping quesitons.

Hello everyone. I have been reading that if an LPR spends more than six months consecutively outside the USA, the immigration officer at the US entry checkpoint may question them regarding their “intention to abandon their LPR status in the USA”. My wife has been in china for nearly 7 months. We knew for certain her trip would be under a year, so maybe a bit naïvely on our part, did not file for a re-entry permit. We did not realize this may become an issue. Some back info: My wife is an LPR, and we are in the middle of removing conditions. She has, and is fully within the NOA I-751 extension letter parameters for her green card validity. My wife returned to China Febraury 26th, and will return September 21st with myself, and 3 of my friends from the USA. Originally she intended to return early July, but varying items came up that delayed her return: My wife makes money teaching & tutoring English to Chinese children. She returned to China end of February to renew her Chinese teaching license, and complete becoming fully TESOL certified. The process should have taken about 3-4 months. Furthermore we have been married for 3.5 years, but have been so busy we have not had time yet to hold a substantial wedding ceremony. We were planning to finish the trip by holding a larger wedding ceremony in her home town (Chongqing), and both returning in early July. Per her family tradition, they visited a fortune teller that told us we need to have our wedding September 16th. So, we obliged to keep her parents happy. We have our ceremony planed for September 16th, and a small vacation planned with her family, friends, and some of my friends that are coming from the USA as well. We decided that instead of spending the extra $1500 on a flight to return for 1-2 months, we would just wait it out, this also allowing her to attend to some business matters before returning. I have decided to bring some basic documentation (our apartment lease, US credit cards with her name on it, drivers license, ceremony pics, etc.) to show as evidence of being anchored / established in the USA. Has anyone / or their loved ones experienced being questioned about abandoning their LPR status in the USA? Can she potentially be denied entry, or do we need to plea at a later day in immigration court?? Any input for proper documentation to bring? Many thanks in advance to everyone.

Havent gottent he Biometrics appointment yet. She will be heading back to China end of February to September. Hoping we get it before then.... You can reschedule them correct?

Just an update to original concerns. I751 NOA was received. She went to China November 1st. I followed November 30th, we both returned to the United States December 15th. All went well without issue. Happy to be together for Christmas! Thanks all for your advice, etc.

We received the 18 month extension. From what I have read, it is standard procedure now..... I'm just hoping they will waive the 2nd interview. I'm getting a bit tired being treated like a science experiment.

She should take the original, along with at least ONE copy. That way, she can SHOW the original if requested, and submit the copy. Understood. Thanks Randy!

I have searched but have not found anything specific. Further to above, does she need to carry the original I797? Can she carry a copy? Seems like a bad idea to keep the only original document showing your legal prescence on you when traveling all around. My first instinct was to get an I-551 stamp, but we have been informed the USCIS will not grant them until the I797 is within 30 days of expiring. Anyone had any issues on the Chinese side using a I797 to board the plane?

Just following up. I-751 / documents were received Friday October 5th 2018, and we have now received I-797 Friday October 26th 2018. Exactly three weeks from submission to receipt of NOA. Wife will fly out this Friday. Thanks for all the input guys!

Let me know when you received anything... I have been hearing that 2-3 weeks is the norm for receiving the NOA, but that seems fast for how slow USCIS is moving these days.... Heres to hoping for quick, and smooth roads from here! haha...

We have submitted the I751. Per tracking UPS they have received the petition. We are waiting for the NOA. She will plan to retun to China from late October to mid Deceber (pending NOA receipt). I think we should be ok with the biometrics appointment. Regardless if it comes up she will just have to return for it. Either way, thanks again CFL. Couldnt have done all this without all your help / advice.

Hi Wawster. Many thanks. Rock, and a hard place. We are sending the petition + supporting evidence via courier overnight AM thursday. I guess we will just have to wait it out and hope we get NOA back quickly.

Good day Candle for Love! In a bit of a pickle now, and was looking for some advice. Wife, and I are getting ready to send off I-751 petition in the next couple days. Her conditional green card expire November 9th. (I know a bit late filing, but life has been crazy lately). I understand we will receive I-797 NOA extending her LPR for a year upon petition acceptance. Here is the issue. Her grandfather has become ill, and she is looking to get back to China soonest possible, but we understand I-797 can take up to a month generally to get back. Could we mail off the petition, confirm USCIS has received it via tracking number, and get her on a flight ASAP while waiting for I-797? I plan to fly over and meet up with her end of November and could bring the I-797 with me for re-entry… If they see that she is out of the country while waiting for I-797 do you believe there will be issues? I know its all shaky ground but kinda a crappy situation we are in… I also posted this in the squak box. Any input would be great. As always, thanks all!

Good day all, Wife, and I are nearing time to file I-751. It has been a crazy couple years, and through my job we have moved 5 times. I was reading over the I-751 to start prepping. Question 22 of Part 1 asks "Have you resided at any other addresses since you became a permanent resident? If 'Yes," attach a list of all addresses and dates". Upon reading this I realized CRAP I THINK I forgot to file one of the address changes as per below. Address 1 (Original File Address) -> Address 2 (AR-11 Submitted) -> Address 3 (AR-11 Submitted) -> Address 4 (Forgot To File AR-11 "I think") -> Address 5 (AR-11 Filed Current Address) Is USCIS going to give us crap about this? Should we submit a memo explaining we forgot? Should we just leave it, and play the "we have been so busy we must have forgot" if they ask?

Although this is not geared toward Chinese immigrants, it really tugs on your emotional strings. My wife is soon returning to China for 3 months to take care of some family business. I can only imagine the feelings of those who may have had family get caught up in this mess. It's pretty alarming how quickky things can change on the whim of the man in office.

Oh right. Thanks for clarifying. She was already in the country. We filed 130 / 485 / 765 / 131 concurrently. She didn't have any involvement accept for the youth league which was when she was very young, and was required for the school she went to so we were advised that it would be best to answer "no".

I spoke with the people offering, and simply explained the situation. Told them I want to wait until after the interview to accept the offer, they said it's not an issue. Her interview being the 9th, we were planning to move into a new apartment the 11th. So if we get approval at the interview I will need to inform the new apartment my intentions, and go find a place in the new town. Move her to the new place then I will stay at a motel in Tampa to confclude my 2/3 weeks resignation. Kind of hectic haha. Really hoping we get approved on spot, and don't have to play any waiting games after. I have heard horror stories of months, and months of waiting after the interview. I have also heard that is becoming less, and less the case, and we should have a decision at the interview or shortly after.. Anyone have experience with this? Please excuse my poor typing. Fat fingers little phone.

Good day, My wife has her I-485 interview the 9th of November in Tampa, FL. I am looking for opinions. I have been offered a job in my hometown (about 300 miles away). I can potentially make 2-3 times what I am making now. My worry is if it will reflect poorly on our situation hat I am changing jobs shortly after her interview? Not sure if in the right section.

From what we have been hearing, if the annual dues are not paid you are automatically withdrawn from the youth league. This means she would have been out before her 16th birthday. We are taking the stance that neither are applicable for her situation. Going to answer "NO" to question 6, and as it tells you list groups etc from age 16 it wouldn't be appropriate as she would have been out before age 16. I think that is probably the most reasonable course of action.
