  1. We are going K-3, even though the CR-1 is also ready. The wife did not want to go back to GUZ for the interview, they were very tough on her, plus the denial. At least I can attend the interview at HK very shortly, and I really have all the "ducks in a row" this time. We are waiting for the P-4 package. Plus today is our 2nd Wedding Anniversary.

    Let the denial fall by the wayside. I wrote a letter to withdraw/cancel my K-1 petition. They wrote back with an appeal form and said that I was married and that petition was just sitting there doing nothing and thats where its going to stay. I wrote back the director of VSC and said I just wanted to make sure that petition was not going to interfere with my new petition. I will bring that documentation to the interview with my wife just in case. So thats where the old petition stays on file. I will keep you posted when we both go for the next go around, should be soon now in HK.

    I believe what she is trying to say is that she does not believe she can apply for K3 visa thru US consulate at HK, unless you can send her proof to show the contrary.

  5. Sorry to hear about your denial. What was the circumstance for the denial? You can appeal it and if you do keep that file in China no matter what. Knowing of the economic times you have to pass the poverty test, for sure $17,500 the minimum per year.

    It will take a while to do the I-130 route, so the next time you have to show some type of wages or it will be a no go, unemployment wont cut it for sure. The other is to get a sponsor to help you along.

  6. Confirming what Splinterman said. Also, call them back and have them fax the release form so that you can fax back everything at once. It will save a little time.

     

    All they are going to do is look at the USCIS website and then type you a letter saying they are working on it, trust me I know whats happening there. They can do NOTHING !!!!!!!!!!!!!!!!!!!!!!!!!!!! been there doen that.

  7. Hi all, I am asking this ahead of time as I am planning to file I-130 this week.

     

    What's the most common reason people got rejected at the consulate interview?

     

    Also, does my wife need to know English to attend the interview in Canada (we are permanent residents here) or China? Is there anything she should prepare or know ahead of time before going? Can I be by her side during the interview?

     

    I would think if you did not know the name of your husband or the country of the petitioner, red flag, anything else at interview purely subjective. nothing really definitive.

     

    At GUZ your in a different world, believe me. If you didnt floss your teeth the day of the interview, denied. If your left foot hit the floor first when getting up in the morning, denied. They are very very tough there. You are at their mercy.

    This is great news !!!! You get the birthdate thingie resolved?

     

    NVC to HKG should be about 8 days, then they'll open a physical file there within another week.

     

    The only thing that will slow her down, now, is 'yet another namecheck' . Hang in there, la...

     

    They would have gotten my letter today for the BD thingie !!!!!!!

  10. Hao Ran, Do you know that you are outside of the processing timelines? You should have your Congressman make an inquirey.

     

     

    Is this something that's typically done?

    What methods should be used to contact the congressman (phone/email/letter)?

    Is there any feedback about the results of contacting congressmen? Does it actually expediate the case?

    I have a date of a couple weeks shy of year for my I-130 to process. Its just a gruling waiting game here. As far as expedite service GOOD LUCK, if the expedite is not exactly worded in USCIS language and proof then its a no go. Trust me on that I have tried and sent proof and they said tough luck. Your Congressman and who ever else is of no help they look on the USCIS site just like we do, and then they send your a letter saying its being processed. The system needs to be overhauled for sure.

    Hang tough......and good luck......its a pretty long haul .....look at my time line.
