We are going K-3, even though the CR-1 is also ready. The wife did not want to go back to GUZ for the interview, they were very tough on her, plus the denial. At least I can attend the interview at HK very shortly, and I really have all the "ducks in a row" this time. We are waiting for the P-4 package. Plus today is our 2nd Wedding Anniversary.

Mace, Let the denial fall by the wayside. I wrote a letter to withdraw/cancel my K-1 petition. They wrote back with an appeal form and said that I was married and that petition was just sitting there doing nothing and thats where its going to stay. I wrote back the director of VSC and said I just wanted to make sure that petition was not going to interfere with my new petition. I will bring that documentation to the interview with my wife just in case. So thats where the old petition stays on file. I will keep you posted when we both go for the next go around, should be soon now in HK.

You treat the I-130 as a brand new never before applied for application. Where it says have you ever applied, naturally you say yes and give the reason "not a bonifide relationship" and thats it. Only send them documents they want. Its all in the system they know all.

I believe what she is trying to say is that she does not believe she can apply for K3 visa thru US consulate at HK, unless you can send her proof to show the contrary. If you got married in HK you will have interview in HK. Look at my timeline. I am waiting to go there now with my wife.

Sorry to hear about your denial. What was the circumstance for the denial? You can appeal it and if you do keep that file in China no matter what. Knowing of the economic times you have to pass the poverty test, for sure $17,500 the minimum per year. It will take a while to do the I-130 route, so the next time you have to show some type of wages or it will be a no go, unemployment wont cut it for sure. The other is to get a sponsor to help you along.

All they are going to do is look at the USCIS website and then type you a letter saying they are working on it, trust me I know whats happening there. They can do NOTHING !!!!!!!!!!!!!!!!!!!!!!!!!!!! been there doen that.

I would think if you did not know the name of your husband or the country of the petitioner, red flag, anything else at interview purely subjective. nothing really definitive. At GUZ your in a different world, believe me. If you didnt floss your teeth the day of the interview, denied. If your left foot hit the floor first when getting up in the morning, denied. They are very very tough there. You are at their mercy.

All the Docs my wife signs, she prints her name in English, no signature yet in English, we haven't got that far yet

I went to the HK Consulate website and now I am in info overload. I cant tell what forms the wife needs to fill out, new forms on that site. I know she would need a new physical exam and police check from Shenzhen. What else and what forms, I dont know.

They would have gotten my letter today for the BD thingie !!!!!!!

Finally, received letter from NVC with HNK (hong kong) case # and will forward to HK Consulate within a week. I am so darn excited, just maybe finally my treasure and I will make this happen.

Dont worry if it doesnt show up on the USCIS site, my most recent update does not show up on mine, but I know NVC has it becasue of a letter. Thats not the one I want processed, i want my K-3 processed.

Is this something that's typically done? What methods should be used to contact the congressman (phone/email/letter)? Is there any feedback about the results of contacting congressmen? Does it actually expediate the case? Thanks, I have a date of a couple weeks shy of year for my I-130 to process. Its just a gruling waiting game here. As far as expedite service GOOD LUCK, if the expedite is not exactly worded in USCIS language and proof then its a no go. Trust me on that I have tried and sent proof and they said tough luck. Your Congressman and who ever else is of no help they look on the USCIS site just like we do, and then they send your a letter saying its being processed. The system needs to be overhauled for sure. Hang tough......and good luck......its a pretty long haul .....look at my time line.

This is crazy, I sent an addendum to VSC becasue the wife has moved. The addendum had the new address, now I get this paper work and they have the old address. What now?

Just got the letter from NVC for a $70.00 fee and guess what......I HAVE A GUZ NUMBER..................NOT HONG KONG. Another screw job I will receive.

Am I required to send in 2008 tax forms, because my book keeper wont have that done till late march, or, can I just send in copies of my 1099's for 2008. Or can I just use 2007, 2006, 2005 to send in. The last go around I sent in copies of the whole return for 3 years.

If your petition was sent to CSC it is much faster than VSC, if anyone one should know I would, look at my time line. This is a never ending process !!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

There is no bias there at GUZ, they do whatever they feel like doing, they do not care or have one bit of commpassion. Everyone that goes before them spell FRAUD.
