  1. I called the NVC and they said the same thing, interview where you got married, which is HK. (monday call) Today I called the Mesquite Center, the lady was great. She told me file K3 to the Dallas Office and after I receive a reply with my number file a I-129F and send that into the address on the reply. The Visa interview would be in HK where we got married. My question is why another form to file I-129F ? She also stated that my Fiancee App. would fall to the wayside filing the K3.
  2. I did call the National Visa Center and inquired about the goings on of my wifes file. Kelly, at the Center also stated, the file will go to the Consulate where we got married, which is Hong Kong.
  3. Thanks to AGM"S post........................I called the HK Consulate and the wife did also from Shenzhen. We both got the same answer.................Can apply for the K3 through HK with no problem, since we married in HK 2/28/07. I explained the A5 denial thing. They said they would request file and fill out K3 and send there. I also emailed then to make sure and they again said you can apply where you got married. Whats with a light through the tunnel !!!!!!!!!!!!!!!!!!!!!!!

  8. The Consulate is unable to issue you an immigrant visa, according to the section of the INA, section 5A, you do not fulfill the requirements for the petitioned visa. The Consulate has determined, based on your testimony, documents and any other evidence, that you do not have a BONA FIDE RELATIONSHIP with your petitioner. The Consulate will now return your file to Homeland Security.

  10. The wife was denied for NOT A BONAFIED RELATIONSHIP. Now I have to start from scratch again ??? Will the Consulate ask for the file back here in the USA ?? It has all the pertient docs in that file. Does it make a difference if I have the same lawyer prepare all this stuff again ? They did a great job preparing the file with no discrepencies. They have all copies on file with them and know the case. I fulfilled all the docs they wanted hand written. Its the Consulate said better luck if we were married, for what reason I don't know. Need some advice here.
