I guess I will weigh in on this one, It didn't matter in my case, divorced from a Russian woman in Jan. 05 married my Chineese honey in July of 05 and went thru the process in 8 months, My new wife and son moved here in April 06. Best move I ever made, never knew what it was like to live with a woman in harmony. My wife is a such a wonderful woman and mother, I feel her love and frienship everyday, I was a big man also (350Lbs ) when I married and she just a small (90 lbs) when we married. She was 39 and I 52. Since my honey arrived here she gave me a new purpose in life and keeps me happily busy, she is a great cook, and feed me a diet that has helped me loose 60 pounds and continuing to loose. Her food is tasety with alot of vegies and soups, the bigest change was minimal starches in the evening and alot of matress polo . I am sure happiness has alot to do with weight loss too. If this is the one for you I say go for it! I would visit again then file, this would solify your new relationship after divorce and may be easier to justify to the VO when questioned about your relationship with your new honey. Also during the interview my wife was asked many questions about my prior marrage, I told her everything and she answered all the VO's questions and was granted her CR 1 &2 visa. What ever you decide good luck to the both of you!
  2. Folks Please be careful with this case. This woman has a bad situation. However there are a few of us out there that are close to this situation and know what has happened. All I will say is beware of all the tears and poor me talk. There are 2 sides to this story, many people have tried to help this woman and her son with money, a place to stay, marrage counceling to mention a few. Her behavior is a problem for her, I hope she can make her life better in the future

  4. In my opinion $1500.00 is expesive for just the preparation of an interview. If you have all the required documentation and your relationship is solid you should not have any trouble have any trouble. It all boils down to you and your honey's comfort level and how deep your pockets are.
  5. Why wait? If there is a concern put her on a plane ASAP! before the establishment has time to realize she is leaving. 2 weeks is a long time to give officials to stir things up! Just my 2 cents worth for all its value.
  6. WOW, This womans world was turned upside down, she probly gave up a job, house or appartment and may not anything to go back to. I wonder if she can file a law suit to recover money to get set back up in China again? I know in some states if you promise to marry a woman and you change your mind you can be sued for breach of promise, in some of those cases there is not as much documentation as a K-1 visa where you nearly sign your life away to move a woman to the US let alone all the time wasted. With out knowing all the happenings in this case one can't be sure. If a USC brings a woman here then sends her back home then he should make her whole and help set her up back home again. On the other hand if this man is willing to treat her in this way she will be better off not marrying the jerk any way.
  7. I thought I lived in the most expensive state New Jersey. 1 old pick up and 1 new pick up. perfect driving record 2100.00 for 6 months. Add one inexperienced driver the rate doubles. boy that sucks
  8. Congratulations on your wedding. Boy aint those Chinese Wed-Dings great! I like the way they do everything. They decorate the wedding car insted of trashing it. My god at the food. Our diner cost about the same as yours, we had 35 people attend our wedding. Its always good to see the happy stories on this site. Good Luck in the future. Let the waiting begin.

I agree with donahso, This situation occured with my ex-russian wife, she wanted a divorce only after being in the US for 1 year, she left and moved in with a old russian boy friend I wrote the INS explaining my situation and they made my letter part of the adjustment record. I never filed for removal of conditions. 6 months after the removeal of conditions was due I received a letter from the INS saying that my wife was out of satatus. She later went to the INS office to try to change her status and they told her she had to have me to fix this problem. She lost her job then her drivers license, then she found work as a waitress and then she didnt have any money to fight any more. she returned to Russia then I filed for divorce in absentia in Florida. It took a wile however in the end she paid for her bad behavior. I am not a lawyer, however I would never cop to something I didnt do no matter what the cost. Everything you have done in good faith then I would put the responsibility on her to prove you where guilty. I would save my money. Consult with a good Immigration lawyer and form a plan to get through this. She needs you to get her conditions removed. (this is why they put this program in place). She has to prove you abused her. For this she needs proof to convince a judge. So if you are innicent I would make this her problem. Layers dont work for free. ( most of the time) so maybe you can just delay and wait her out. Just my 2 cents worth.
  10. In 1998 I filed a K-1 and K-2 visa for my second wife, (from Russia). we divorced in Jan 2005. I found my current and final honey in China at the end of 2003 we wrote for many months and became close friends. After I divorced, I found that this woman in China and I clicked very well. We married in July of 2005 and are very happy now. I finally found out what it is like to live with a woman in peace and harmony. I feel I was very lucky. My second wife applied for her citizenship and this made it easier to not have an outstanding I 864 hanging over my head. The step daughter from this marrage returned back to Russia to become a nun so she never finished her AOS process. I found during the process the only information I needed to provide was her current address (this was on the divorce document). I filed my new wife and stepsons documents in August of 2005, we completed the process on April 18 2006. Everything went very smooth no problems We came back to the US on April 28th on a CR1 and CR2 Visa. We are done until Removal of conditions in 2008. I hope this helps.
  11. I was wondering? When you filled out the G325 and the I 129F there are sections of these documents that are required to be filled out in the native language. So if you filled out these sections to reflect what your sir name and given name are, then if their is a conflict that Immigration and NVC folks cant figure out then I am sure they would sent you a letter. I recieved such a letter on my stepson, I got his names backwards on the application, they wanted an original notorial copy of his birthcertificate, I sent it and all went well. Hope this helps
  12. Maybe you could help us understand her situation better. How long was she with her husband after she arrived in the US? Does she have her marrage certificate.? Is her divorce complete, and does she have the document or decree? Did her husband file the required AOS (adjustment of status) after their marrage? Does she still have commication wit her husband? This is a complicated situation, with no easy answer. Her best shot at getting what she wants in her current situation, must be worked out following the path she came to this country on. She may have some leverage with her husband if he filed the required I 864 support document, this document has legal teeth as a few folk have found out in this forum. This man is responsible for this for a loooooooooog time. I belive, for 40 quarters of work, or she leaves the country, she dies or becomes a naturalizes. So once he takes a look at what he is facing MAYBE he might want to think outside the box.
  13. Yep yor honey is quite right, they already dont accept passports by mail in NYC Chinese Embassy. Because of the problems with documentation theft someone has to take and pick the passports up. there are passport ggents that will deliver and pick up your passport in person for a fee. This is simular to obtaining a visa. Best thing to do is call the embassy and ask about the rules, or go on line to the website for the one nearest your location. I just brought my wife here in April an her passport expired in December, we just had hers updated, we went to the Chinese embassy in NYC turned the passport in and returen in a week and picked it back up. The 6 months rule is a pain in the rear, but they hold you to it. Hope this helps
  14. Hey, Try Dish network, Direct TV, local cable providers, they are always looking for help and pays not too bad. Just need to get past the application process thy will train for the position. Do this in conjunction with english classes. Also the local courts look for persons to be Gardian at Lidieum, these program are at the lower end of the pay spectrum but it's a starting place. I think she should be happy that TJ Max gave her a shot everyone has to start some where. TJ Max will start you out low but as soon as they see you arte a performer and you have great work ethic they will want to keep you. as any where the more valuable an employee you make yourself the better off you are. It was mentioned before but some of the upscale Chinese eaterys will give a good starting place also. It is not easy and only a very determined person will pull this off. Good Luck!

I agree with M-Coon, I think that CR-1 , K-3 is a good approach, I also will tell you I think it is all a crap shoot on processing time, the better prepared your documents the quicker you are able to turn around your responses to the INS, NVC and GUZ folks the quicker your case will reach its end result. In my case, once Min and I decided to get married, (we met in 2003, I had visited her in Feb 2004) I went to chengdu last July 4 weekend and got my single certificate from the Embassy in Chengdu, I presented my certified copy of my divorce document, my fiance's ID card and passport and in 10 min had my single certificate. They did ask me a few questions after they took my future wifes Id, what is your future wifes name?, what is her birthday? Don't laugh because there was a guy at the counter before me that was there for the same reason but didn't know his fiances current last name or her birthdate and they told him to try again in 90 days when he knew his fiance's, Bio information better. Next we married on July 5 2005 I had prepared all the forms and documents needed in advance had my wife and son sign everthing just left off the date. Upon return to the US I filed the I-130's with Vermont service center, on 30 July 2005 . We went to the K-3 inteview on April 19, 2006, Our CR-1 was ready so The Guz embassy asked my wife if she wanted to take the CR-1 instead, ofcource she said yes and they asked her if she had all of the completed forms necessary and she did it took an extra 3 hours to make the change I was waiting in the coffie shop on the fourth floor sitting on neddles and pins as it was 12:00 pm and finally one of the other ladies that got her Visa came down and found me to let me know my wife was approved but it was a CR-1 instead of K-3 so it would be a couple of hours more, she finally emmerged around 2:30 pm with her pink aproval slip . (thank god for being prepared) my CR-1 total process was 8 months total. The other thing I did was act as as the agent for both my wife and son which sent all the documents to me first. I was able to turn the responses around overnight. The GUZ just sent the P-4s to my wife on March 25. I choose to go to China and help my wife move, and to say her goodbyes to her family, This was a priceless experience, It went well but extracting a well connected Chineese woman from China and her family was quite a lesson in humility for me. I was also happy to bring my honey home to New Jersey with me on Friday the 28th of April We move 6 large suitcases and 6 carryon bages and now my training begins, I hope this information helps. I also don't think anyone need a lawer to complete this process (too expensive and too many oportunities for mistakes) Just get the forms and follow the directions. If you have questions just throw them to CFL I find most of these people have the know how to answer your questions or direct you to the right answers.
