What you could have done, is to have waited until March 2008 to apply for AOS. You could then have skipped the 2 year card, and gone directly to the 10 (this happens even when submitting the I-485). Actually, as long as your AOS application is approved AFTER your 2nd anniversary, it will be a 10 year card. But to answer your question, yes you are right - you must now wait until 90 days before the 2 year card's expiration to apply to remove conditions. -
One for each application - AOS, EAD, and AP - and separate each application with a manila folder, tabs, or whatever.

If it's been less than a year since your wife arrived in the US, he can get a K-2 fairly easily. I don't think there's any problem with abandoning it without filing for AOS. If it's been more than a year, you can file an I-130 for your step-child ("child for immigration purposes"), which would result in a green card when he arrives. Abandoning the green card by returning to China might affect his future immigration prospects. There is a pinned topic on Visitor's Visas for relatives. Check it out -

I agree with what's being said, but to let you know what you're up against, I found this on a web site titled "Finding Free Legal Advice" I do not see the restriction on a representative being "accredited", but this is by attorneys, so what do you expect? . . . and here's the list!- 27 replies

But he's not doing that, and I'm guessing would not, if the law were followed correctly. But, yes, it may be difficult to cut through that when even lawyers interpret it that way (see AILA)- 27 replies

It is your choice. The W-4 affects the amount withheld from your paycheck. You are responsible for making sure you pay enough withholding or estimated payments by Jan 15 to avoid paying a penalty. If you will be filing married filing jointly (say yes here), claim "married" on the W-4 so you won't have too much withheld. If you wish to make a short term donation of money to the IRS, claim single.

Some offices will let you talk about your wife's case, with or without your case. But, yes, that same interpretation (only applies to lawyers) is used at (some) other offices as well. You can try the USCIS Ombudsman. I agree - it's borderline criminal to use a worst case interpretation of the law against you to throw up a road block.- 27 replies
