  2. The IO told him that IF APPROVED, it should arrive in about 3 weeks. This is a special process on the removal of conditions approval process that got kicked upstairs at USCIS and the IO can only make a recommendation from the interview. Their supervisor must make the call on whether it is approved or not and there was no time frame given on how long it would take for the supervisor to come to a decision.
  3. As I recall the IO said he would recommend approval, do you have any confirmation that it has been approved? Most times the case will show card production ordered online and then the card usually shows up within a month or two.

  6. That's generally the life cycle of events in China. It goes from complete screw-up, to complete overreacting and finally, on the third attempt, to moderation. Third times a charm, just wish the US had those kind of results.

  8. Given the symptoms and treatment I would imagine many doctors are treating their patients. Whether they report the cases or not is up to them. I believe this may be what is concerning some.
  9. The first claim in patently false. I watch the news every day and I see the numbers updated on one source or another on a daily basis. I'd like to know how they define "US" when they make the accusation that the US is suggesting that China is overreacting. Just because a few bloggers or pundits suggest it hardly constitutes a whole country. Seems like just more of the typical propaganda the CCP-controlled media passes off as information. This is probably related to the CDC no longer performing blood tests on every suspected H1N1 A case and having doctors advise people to stay home if they display symptoms and prescribe flu medication.
  10. Congratulations Based on my non-scientific method of calculating timeliness I'd say your about half way there. A week or two at NVC then off to GUZ to sit in "Customs Hold" as part of your right of passage. Then the magic day when you discover P-3 has been sent, hopefully in less than 3 months from now. Sometimes I forget the lovely days of waiting on the process and how it consumed every moment of my life as if someone had hit the pause button. I'd get busy working on the P-3 & P-4 paperwork and while your at it you might as well fill out the AOS forms as you will need all of the same information again. Also, depending on your housekeeping skills and the amount of junk you have accumulated over the years you might want to start cleaning and getting rid of the junk that has been in boxes for more than 2 years because time is getting short and you might as well get it done so she doesn't get to see how big a slob you are.

  12. A couple of questions, which service center sent you the letter and was the letter giving you 33 days to respond on Blue paper? Just trying to connect the dots on which service center is doing this. Also, I'd advise you target having it delivered by day 29 with delivery confirmation, the 33 days is 30 days plus 3 for mailing, but you don't want to risk it being recieved late or the game is over. Priority mail offers this at a much lower price than FedEx or UPS.
  13. This is your RFE opportunity to challenge the NOID, Did Guz return your K-1 to CSC? Has it sat there > 6 months?, Expedited review request at CSC. NOIR Letters for CR-1/IR-1 - CSC, Time-frame processing NOIR letters at CSC This is your opportunity to challenge the NOID recommendation and get the case returned to GUZ with a recommendation that they continue processing the K-1 visa. Failure to overturn this decision could result in a denial on her record that would need to be overcome in any future visa case. Read Marc's posts carefully as he gives some advice on what needs to be addressed, basically you MUST prove a bona fide relationship. Forget trying to prove the VO was wrong, it won't do anything to help overturn the NOID. You wanted your chance, well here it is. Successfully overturning the NOID gets the case transfered back to GUZ and a new interview date schedule in most cases. This is the fastest method to get the K-1 visa. BTW even if you have married since the NOID the general recommendation is to get the NOID overturned so it does not become a stumbling block for you on the visa process. Time is limited, no extension and you have only one shot. Take your best shot and do this with a cool head and lots of well organized relationship evidence. They will not just take your word that you have a relationship, you MUST prove the VO was incorrect in their finding with EVIDENCE of a Relationship. In the past overturned NOID cases have had a great success rate on the second interview. PS - You need to get your girl to get a new Single Certificate at the Notary and get it to you FAST (EMS, FedEx, ...) you will need this evidence to prove she is still single, they will not take your word for it and YES it must be a new one, they have already seen the one provided at the interview and have asked for a new one. This time send an original. Have her get 3 of them when she goes to the Notary so she has a fresh one for a new interview in the event you get this overturned. Yes, this is very hopeful.

  15. Our biometrics appointment was less than 30 days after we filed, but that may have been a speed up in the process that the USCIS discovered and decided to delay a bit since then. Unfortunately the receipt number for removal of conditions is a temporary number and will not show up on their on line processing site. They will assign a new case number with biometrics. I'd give them another 30 days before taking any action, if you don't have anything by that time I'd suggest making an info pass appointment and see if they can give you an update. Since the receipt arrived at the correct address I doubt you have any problem, they probably have changed the timing of the process again.

  18. That's not really a surprise, is it? I mean, I know very few Einsteins make it to Congress, but why wouldn't a creditor cut back on lending? All major US credit card companies are slashing credit limits and pruning out less creditworthy cardholders. The "China Credit Card Company" should be doing the same. Now what would be truly newsworthy -- and funny as hell -- would be to see the US Government slash government salaries, benefits and perks. It's about time the government started practicing what they preach and live within its means. Yeah, like that's gunna happen anytime soon.
  19. As Randy said it is highly doubtful anyone has a case similar to yours with all the peaks and valleys. Usually the interviewer makes the decision, but in your case it must go through a supervisor review, so you will need to wait for their decision.

  22. Nope, your preparing for the first green card interview. The 21 month clock starts on the removal of conditions once they receive the first green card. I understand, but there is a possibility that we may not have a 10 year GC interview for the removal of conditions? Sure that is possible and has happened for many, but you need to prepare everything so that if you have an interview you are prepared.
  23. People just don't get it, China is on the opposite side of the world so why wouldn't we expect things to be the opposite of what we experience here? Depending on the reviews of my logic I may need to see if I can get a book deal going.
  24. Ah come on Dave, customer service in China? And, I can't help but think that we're talking pennies here and not enough to get all riled up over. If it were me and they'd reimbursed me for the ruined shirts at the price I had purchased them for...cripes, give them their 5 yuan and walk away happy. You must have missed that they gave him 70% of what he paid for the shirts and was already taking $169 loss for the privilege of using their service. We need to start a business together, 'cause you aren't going to get riled up over minor discrepancies in the cash account. I need a partner like that.
  25. I have no idea where to find case law concerning immigration cases, perhaps a law library. The IO's use 8 CFR as their guidelines for interviews of all sorts, the difficult part is the information is scattered around in various places. Try taking a look at the Adjudicator's Field Manual Chapter 10 - An Overview of the Adjudication Process. Chapter 15 - Interview Techniques. Chapter 15.5 - New York City District Office (¡°Stokes¡±) Interviews Chapter 21 - Family-based Petitions and Applications. Chapter 23 - Adjustment of Status to Lawful Permanent Resident. Chapter 25 - Petitions for Removal of Conditions on Conditional Residence. Chapter 26 - Rescission of Adjustment to Lawful Permanent Resident Status. There is a large amount of information available, but this should give you a starting point.
