Not sure if this is the right place to start, but here I am anyways. As a background, I'm a US citizen, and my fiancee is a Chinese citizen. She's living here in the states on an H-1B visa. When we've talked about whether to change her last name after marriage (I understand that this is not normal for Chinese women), but my fiancee is very concerned about the hassle of trying to change her name while simultaneously applying for her green card. If we decide to change her last name to mine (its still not something we've fully decided on), we don't know anything about what this would entail. Would we need to get her name fully changed first (along with getting a new passport, etc), and then apply for the green card, do it the other way around, or do both at the same time? If it makes a difference, she isn't planning on becoming a US citizen in the near future. Thanks for the help!

Howdy all, When did you all add your spouses to your healthcare plan? I'm working on signing up for subsidized healthcare on Healthcare.gov to take advantage of those sweet sweet Premium Tax Credits but my wife doesn't yet have an Alien ID number, tax ID, or SSN... We're actually still present in China and will probably be sticking around until the summer, but I'd like to establish healthcare for the sake of evidence for establishing domicile during my wife's IV interview. Hey all, My girlfriend and I have been cohabitating for a few years in China and we're planning to get married in the middle of January, and then shortly after file an I-130 in Guangzhou. Of course, we need to provide evidence of our "bona fide marriage" but we are going to be married like a week before we submit the I-130 in Guangzhou. All the evidence we have is really just evidence of our relationship (pictures spanning three years, airline tickets, my passport exit/entry stamps, my residence permits and visas, copies of my most recent contracts, etc...), we don't have any stuff showing joint assets or anything like that. I was planning on getting affidavits from two of my coworkers here in China and my current employer, but after researching around I've found that the affidavits that they'd write would need to be notarized (i'm assuming that they'd need to be notarized by the US Embassy or Consulate). But we live in Henan and it isn't practical or really possible to ask them to travel with us to the Embassy in order to affirm/notarize their documents. I guess my question is: how screwed are we? -Jake

Hi All, First time posting, hope this isn't a repost. My situation/question is. If I (US citizen) get married in the states to my Chinese citizen wife while she's on tourist visa, and we leave the states after the marriage. Next time entering the states, what type of visa does she need? If to enter just for couple weeks will another tourist visa suffice? or will we run into trouble with that. The situation is that we like to get married in the states but don't plan to live in the states in the near future but would like to keep our options open. How will this effect her future entering and exiting US? What do you guys think the best route to take and any suggestions is appreciated. Thanks James

Her Visa expires in July. we want to marry in May. What do I need to do to marry her and keep her here. thanks to anyone that can help.

I found this list for marriage in Shanghai online. Is this outdated? My concerns are #'s 3 & 4 under foreigner requirements regarding the cert of marriageability. http://www.shanghaiexpat.com/phpbbforum/procedure-for-marriage-in-shanghai-china-t8799.html I'm a US citizen, she's Chinese and is going to change her hukou to Shanghai. Hopefully this won't take long. Anyway , I have a couple questions: 1) Do I need both 3 and 4? I was thinking it was 3 OR 4. Is this written wrong? Hopefully it's out of date. 2) is #4 correct in saying that one must live in China for 6 months to be able to obtain this at the consulate in shanghai? 3) If I'm able to get my single cert in Shanghai at the consulate, will it be acceptable for marriage in Shanghai? My Fiancée read somewhere that it needed to be the version from the states(#3). 4) Does anyone have a list that's current? Thanks in advance for any help

I am hesitated to change my name after marriage. The reason is that: My AOS application is on the process for 3 months, including I-485, I-765 (EAD) and I-131 (AP). If I change right now, I have to notify USCIS to name change and that will cost me another $450 for filing fee and biometric if my research is right. And I have to change my SSN card name although it is free. And I am going back to China this October with AP. Does it effect my trip? Also, I wonder if I change my name, does it effect my Chinese ID card, banking account, insurance etc in China? Fortunatelly I have not opened account or get employed by any company at the moment. So it is seemed for me only need to change the name on SSN card, green card, EAD and AP. If I decided to change my name, shall I take my husband's name as my last name and keep my last name as middle name? Or just take his last name as my last name without middle name? Which one is more common practise? Could you guys share me your experience? Thanks again!

So as some of you may know, I finally officially proposed in February. We took a little bit to think about how to go about the process of getting married, and immigration. We decided it would be best to do it in China as it would be easier for her family to attend. We wanted to do it in May, but her cousin is getting married that month, and we don't want to hypothetically steal their thunder in a sense. So we were thinking of getting our certificate in May "essentially a courthouse marriage" dressing up a bit, and having a small, but nice dinner with some family members as a proto-celebration. I will then return to the United States, file for her Immigration Via CR-1, and return in October to have an official celebration and ceremony. By the time her interview comes we will have had the ceremony, and have some nice pics and so on. My question, do you think this may raise any eyebrows in the embassy? Would this create any problems?

Hi, It has been a fun ride in China so far, I have almost been here for two years as a student, but I need a bit of help going forward for the marriage process. I got engaged last month and will be filing the marriage paperwork in China tomorrow. Included are some sort of specific questions: Is it wise to wait a certain amount of time after marriage to apply for the I-130? Last school semester I studied mandarin in China, but I am now on a travelers visa. This will soon switch to a marriage visa. Will this cause any problems? Would I be safer to simply go back to school for next semester as the DCF procedure plays out? When I received my last residence permit, it was a simple piece of paper (no blue paper that goes in the passport). Is this normal? Does it matter that I will be switching from one city to another city and before filing (therefore, not being a current resident of my current city when I apply)? My fiancee traveled with me to the USA late last year to visit my family. Of course, she returned to China at the planned date. Is there anything else I might need to do to make this process smoother? Thanks everyone for the help in advance.

Hi there, I came to the US via a B2 visa two months ago. I'm keening on getting married before birth of our baby, due in early March. Nonetheless, my boyfriend, a US citizen, was indicated firmly by his lawyer that marriage happened within 3 months upon arrival of the US is a suspected marriage to get a green card. Does the lawyer's word make any sense to you guys, or just an old wife's story? Following his instruction, we can't get married till late March and my baby will be born without a marriage certificate. Thanks very much, Qi

I'm looking over the Clark County Marriage Bureau Web site here today getting ready to order my CERTIFIED marriage certificate. We were married in Vegas. Their Web site offers certified marriage abstracts and certified marriage certificates. The odd thing is they say the abstracts are what the government agencies usually require while the certificates are what lesser entities usually require. But my understanding is for AOS they want a "copy of your marriage certificate" as quoted from the I-485 instructions. "Marriage certificate"...not abstract, correct? And while I'm on it because it says they want "copies" for the birth certificates and marriage certificates I assume they mean "photocopies" of the actual certified birth certificates and marriage certificates, right?? Not the originals? Original certified copies of birth certificates from China are not easy to come by as we all know.
