  1. After 2 years and 2 months of battling the snails pace of NVC, everything was finally sent to GZ and we have an interview date for Jie's parents. We're getting ready to ship original documents and I'd like to clear up a couple of questions. GZ is asking for 2014 taxes as well as originals of 'financial evidence'. I assume 'financial evidence' means completed/signed I-864, I-864a, 2013 tax transcript, taxes, employment letter, etc. 1) As for the I-864, I emailed those last year based on 2013 tax returns. In the interview letter GZ is also asking for our most recent tax return (2014). If I am providing the 2014 tax return, do I need to update the I-864 and I-864a to reflect 2014 or just send the original we did last year for 2013, and just supplement it with the 2014 return? I don't care either way, my main concern is screwing up GZ up by changing something already in the system. 2) As for the 'original documents' of the 'financial evidence', since Jie's parents will be at the interview together, do they need a copy of everything for each person, or will GZ accept one copy for both people? I know they each need their own I-864, however do I need to send duplicates of my paystubs, employment letter, taxes, etc? Hope that makes sense. Thanks!
  2. My mother is the co-sponsor for my wife. She (my mother) is not married, but she was married until 2013, so her taxes were filed jointly until then. My question is: does that mean my former step-father needs to fill out an i-864a? I'm guessing he doesn't, but since my mom provided her tax records from 2012-2014, I'm wondering if the embassy will be like... "What's up with that?". Does there need to be some kind of affidavit explaining the situation? Thanks very much. -Sam
  3. I posted two topics yesterday, and I've got a couple more questions to add. I'm just going to condense all my posts into this one and hopefully an admin can delete my earlier two posts... Sorry to clutter up the forum with posts. We leave Monday morning China time to go to Guangzhou. Really hoping someone can get to these questions if they have the time. Joint sponsor questions: 1. Should joint sponsor send photocopies of their birth certificate? Or is a passport photocopy enough? 2. I read on "immihelp.com" that the joint sponsor needs to provide evidence that they have resided in their home for at least 6 months AND proof of their relationship to the petitioner. Is that true? 3. My mother is the co-sponsor for my wife. She (my mother) is not married, but she was married until 2013, so her taxes were filed jointly until then. Is writing "See Attachment" in the boxes okay, even though it fits awkwardly with the spacing of the boxes? 5. Part 6. of i-864 - Income you are using from any other person who was counted in your household size. Should I include my wife (the immigrant) and her $0 income? 6. Alien Registration Number - We don’t think my wife has one, but on our I-130 approval letter that was sent in the mail, it says “Beneficiary A-Number: A000-000-000”. Am I supposed to write that on the i-864? 7. For Mailing Address and Place of Residence of petitioner, if I use my current address in China, should I then write an affidavit explaining that I am leaving this residence as soon as the visa is approved and have maintained domicile at my mother's address in the U.S.?   4. Hey all. Wondering if I should use the address that we intend to move to in the U.S. or my current address in China for the i-864. I know that I must establish domicile, which I've done through credit card statements, tax records, and an affidavit from my mother stating that we will be residing at her home as long as we need to once we arrive in the U.S. If I use my address in China, should I then provide a letter explaining that my domicile is established at a different address? One other thing - do I need a copy of the co-sponsor's birth certificate or will a copy of her passport bio page be sufficient? Thanks!

Hey all, My wife had her interview yesterday (May 13) and was preliminarily approved on the condition that we submit the original I-864 and I-864A from my parents instead of the scanned copies I had so foolishly assumed would be exempt from the 'all original document' rule. Oops! The officer also asked us to 'Submit a statement, written by your cosponsor, explaining why he/she is willing to agree to sign your affidavit of support form' and wrote 'Original' next to the bullet point. Since this is the first time my wife and I have heard of such a requirement, we are a little confused as to what exactly they want. A simple signed letter with a short explanation? A notarized statement with specific details delineating exactly why? Something in between? As always, your guidance is greatly appreciated!

While I've got all of the documents ready for my wife's interview (including last 3 tax returns for myself and the co-sponsors), I was wondering if I should include my 2014 return (not filed yet) as well? The co-sponsor's income is above and beyond the requirements for financial support ($100k+/year), but my last 3 returns are kind of shaky as I've been building a business (online) and living off of savings while in China. Either way, I'm planning on including a summary of the financials/evidence for my company showing monthly growth since June and even my personal daily income since November. Off topic: I've also been wondering if it's possible for me to go into the consulate with my wife to provide support and help during document intake? She speaks fluent English but I know it's going to be a stressful day and it would be great if I could be there to help.

Hi, Can anyone help me in filling out i864 form for my spouse and stepson age 19 and 20.i am U.S Citizen currently residing out side of u.s my question is do i fill out seperate forms for each immigrant? 1st form Principal immigrant will be my Husband 2nd form which box do i check for my step son's( part 2) do they also come under principal immigrant part 3: which box do i check ( i'am currently residing out side of usa and not working) so i have joint sponser part 5: do i have to check the box 1-4 ...example part 7 3...1 yourself 1 spouse 1 dependent 2 is that right. my stepson elder fellow is currently in U.S on student visa he went on 20th of Jan 2015, and will be turning 21 july7 ...so what do i do in this case.   8. Hi to all, I recently recevied correspondence from the Guangzhou consulate that my wife can begin scheduling an interview date through CGI stanley. I am not DCF, I filed my paperwork stateside with NVC. Through recent correspondence with the consulate, they said that I should "bring most recent year tax records for myself and sponsor to interview" (2014). What they didn't specify is whether or not the most recent tax return can be a photo copy or an official IRS transcript. According to the Instructions of the I-864, photocopies along with W2's 1099's etc. are acceptable. Does the Guangzhou consulate use the same guidelines as the I-864 instructions? Would I have to fill out a brand new I-864 along with the new tax record? This is important because I mailed my taxes rather than e-file, and would have to wait until the end of june to receive an official transcript. This would push back the interview date considerably. Not to sound supersitious (actually I am lol), I wouldn't irk anybody at consulate for contacting them with these question? I have already contacted them twice with other interelated questions, so I don't want to appear as a pest. Thanks
  9. Howdy, My father is joint-sponsoring my spouse. As such, I had my mother fill out an I-864A because she lives in the same household as my father and they file taxes jointly. (She doesn't have an income). Now, who signs the "sponsor's promise" part of my mother's I-864A? Would that be me or my father? I'm guessing it's my father, right? Also, what's the document intake process? Document intake takes place on the day of and immediately before the interview, right? Best, J
  10. My husband (Petitioner, US citizen) and I married in October 2013, he has been living in China for 10 years. The first 9 years he had a work residence permit, and the last year he has been using a dependent residence permit. Now we have decided to move to the US, and we are preparing to try to get my US residence permit via DCF in Guangzhou. My husband has had no income for the last tax year, so his parents will co-sponsor me, and they are both retired. We have couple of questions regarding to I-864: 1. Should he file his form I-864 and both parents file two forms I-864A?, or should he and parents file three separate form I-864s? Looking at the I-864 it seems like it should be the first option, since his domicile address is the same as his parents' address in the US. 2. His parents' retirement income is much higher than the poverty guideline (about 5 times), so is there any benefit to putting our assets and/or his parents' assets (e.g. savings, property, etc...) onto the form I-864 and/or form I-864A's? 3. When my husband fills out part 4 of the form I-864, should he put his US domicile address as his Mailing Address and his address in China as his Residence Address, or another way around?   11. Did some searching and while there is a lot about foreign earned income, my situation is a bit different. For the past few years i have been temporarily working in China for a US company and still get paid by them in USD. On my W2 it shows total wages which is well above the poverty threshhold. However, on my IRS 1040 Adjusted Gross Income is below the threshhold because the income is claimed as foreign income (due to my being out of the US for the entire period). Not sure about the specifics of how this works, as my company hires KPMG to do our taxes for us. Question is, can this be explained by my wife in the interview by showing both my W2 and the additional forms included in my return showing the foreign income? Also, which amount should I enter when filling out the i-864? The intructions state to use the amount from the 1040 form shown as Adjusted Gross Income, but that amount is not reflective of the true situation.
  12. Having a little trouble filling out the i-864. Here's my story summarized: I'm living in China currently with my wife. I am employed and she is not. My current income is not above 125% of the poverty line. My mother will be a joint-sponsor. She is unmarried and lives alone. We plan to live in my mother's house temporarily when we arrive in the U.S. 1. Part 4.2 and 4.3 (Mailing Address and Place of Residence) - should I use my address in China? I know that I must provide evidence of domicile in the U.S. since I'm living in China currently, but wondering if I should use my intended address in the U.S. when filling out this form at all. 2. Part 6.6 a through c (Income you are using from any other person counted in your household size) - Should I leave this section blank? From what I understand, to calculate the household size on my i-864 I would count me and the person being sponsored, and on my mother's she would count herself and the person being sponsored, so it would always be a household size of 2 even though three of us will be living in the same residence. Is that right? 3. For every box we leave blank, including the squares for Alien Registration Number, should we write "None" or "N/A"? 4. Is it correct that both my mother and I need a letter from our employers? Is there a format for this? What should the letter from my employer in China state? My company is fairly incompetent when dealing with most issues, so knowing exactly what they need to write would be helpful. 5. As far as establishing domicile… I have a driver’s license, some credit card statements from 2013/2014, and transcripts of my past 3 years of tax returns. Will that be sufficient? Should I have my mother write an affidavit saying we plan to reside in her home upon our arrival in America? Should I have my wife bring my actual driver's license to the interview? Thank you!!
  13. Howdy, There are four different transcripts available from http://www.irs.gov/Individuals/Get-Transcript. The "Return Transcript" is the only one necessary, right? Did any of you include the Account, Record of Account, or Wage & Income transcripts? Is it a good idea to submit all four? I could see including the "Wage & Income" transcripts because it has the W-2s... Best, J
  14. Hey everyone. I DCF'd our i-130 over 3 weeks ago, still waiting to hear back from USCIS. I'm starting to wonder what I can do to get prepared for the next steps. My mother will be the joint-sponsor for the i-864 and I'm wondering what I'll need her to send to me in China from home. From what I understand, the three pieces of evidence needed from the joint sponsor are - 3 years of tax returns, 6 months of evidence of salary, and a letter from her employer. Does she need to send the originals of these documents to me or can they be scanned and sent to me via email? Will she need to send me her original signed i-864 form or will a scanned copy of that be enough? Is there anything else I should ask her to send from home for the i-864 or for the interview? Besides the documents I asked about, I also will have her send my original birth certificate. We're trying to make a list of everything so she can send it all at once. Thanks as always! -Sam
  15. Hello again, Sorry to bother you all. I just realized one more problem - in the instruction of I-864 page 2 it states "If extra space is needed to complete any item, attach a continuation sheet, write your name and A-number(if any), at the top of each sheet of paper, indicate the Part and item number to which your answer refers, and date and sign each sheet" - so we have a sort of explanation, not continuation sheet for our joint sponsor's i-864. E.g. it states why Part 6 Item13 is different with his form in our previous submission - because he now has the 2014 tax return, when two months ago he didn't have it yet, and we want to update it. Does he still need to sign this additional explanation sheet? He lives far away. It's a little painful to ask him mail us things again and again. In addition, he signed the form using blue ink....... I know it requires "Type or print legibly in black ink".... Could this be bad? I mean the whole form is typed out, but only the signature is in blue:( Thank you.
  16. Hello again, Thanks for all your previous help (especially Randy and Dnoblett). As I'm going over my documents the last time today, I realized that for the check-box of Part 6 Item 13 on I-864, my husband probably need to leave it blank - because he only filed tax return in 2013 and 2014, not 2012 - he was still a college student at that time and had no income. Is that correct please? He did enter the tax return in 13a to 13b. I guess my real concern is that - if he leaves this check-box blank, would USCIS scans the bar code and ignore the fact he pays tax for the recent two years? Thanks a lot.
  17. Hey all, I'm preparing form I-864 for myself and my co-sponsor and I'm confused on mine. I've been working in China for the past two tax years and all of my income was excluded using the Foreign Earned Income Exclusion. My tax for 1040 shows 0 on line 22 (total income), my tax transcripts also show 0 under the TOTAL INCOME line item. Am I gonna report 0 for my income on the I-864 or just my gross income without taking into consideration the FEIE? Oi vey... Best, J
  18. Hello again, Thanks so much for everyone's help so far. I'm getting ready to file our documents for RFE. However I have one last question: my income is from a college, and schools budget system goes with "academic year". E.g Aug 2014 to July 2015 is counted as a year. So there is no way for me to know the exact amount of my income from this Aug to Dec at this point of a year, it's too early... However I have a letter from my office proving that it will only be more than what is was in 2014. So would that be okay if I use 2014's income of Aug-Dec to estimate this years', and attach a letter to explain please? Thank you.
  19. Hello, Thanks everyone for posting all the useful information. I learned a lot for my green card application:) However here are two questions that I couldn't find a clear answer for: 1. For petitioner I-864 part 6 item 13, should I try to separate my husband (petitioner)'s income from the adjusted gross income in 1040 of our joint tax return? I have my name in 6a-c of part 6, but this item 13 seems to ask for petitioner only. 2. The current I-864 is expiring on 3/31/15, so does that mean I have to mail it out before that, if I'm using this current form? Or only the signature date matters please?   20. Dear all, I just scheduled our interview in Guangzhou for mid-April. However, I noticed that the I-864 expires at the end of this month. I have two co-sponsors that I'm wanting to send out the I-864 forms to but I'm worried that they will change the forms. Should I just wait until April? I'd rather do things sooner than later.   21. Hey guys, Need a little bit help here. Here is the situation: My husband stayed home taking care of his uncle for the last 5 years, meaning my husband has been unemployed for these years with 0 income. After his uncle passed away, he succeeded his money and properties. Currently, we are at NVC stage and we are selling the primary residence house to have the money in the bank as asset for I-864 because we are moving to another state after I get back. We also are getting our friend as co-sponsor who earns a very decent annual income. The reason we didn't have families as co-sponsor is either because they dont earn enough or they are retiring in a few years. Info abt me: young, healthy, BS degree in Engineering from a famous US college Our questions are: 1. Will the CO accept our friend as co-sponsor since he is not a relative of ours? 2. Is our I-864 in good standing? 3. Any suggestions? Best Wishes, Jack
  22. Hey all, My honey and I are preparing for the interview and are waiting until the new I-864 edition comes out. According to http://www.uscis.gov/i-864, the current edition expires at the end of this month and it seems that versions previous to the current edition are not accepted. I just thought I'd make everybody at the same stage in the game as I aware of this. Peace, J
  23. What's the proper way to notify the interviewing officer of any errors on forms like the I-864, where I wouldn't be able to get a new original document in time for interview? It's not a big deal, but I noticed they put their own address in a field which was meant for the beneficiary's address due to the confusing layout of the first page. I would print out a new page myself but Chinese A4 paper doesn't match US A4 and I don't want the officer to have anything to complain about.
  24. I got a letter from NVC. It says: [x] Item 19. Your ____________ income must match the total (gross) income reported on your ___________________________________ Federal income tax returns. If you filed Form 1040EZ, use the adjusted gross income instead I filled out that section with my gross income based on my W2. because I thought it's 1-864EZ form means I'm the only one sponsor. In 1040EZ , it's My husband's and my income together, we file joint tax return every year. Should I fill it out with the adjusted gross income of both of us ?
  25. Not sure if I need to file my California state taxes since I don't owe anything and it costs $39 to file. Anyone know A) if I will need the state tax returns for the interview and B) if filing a state tax return is necessary when you've been living abroad and don't owe taxes? Thanks!
