  1. Sorry Guys, I can see from the responses I did not express myself very well. My wife is already here. She arrived in November on a K1 and we got married on Dec.15, 2008. We received her SS card on 01-14-09, so can we file jointly for our 2008 taxes using her SSN or will I need to get an ITIN for her? Thanks.

  3. Hello again, Please forgive me, I am not sure where to put this post. My wife and I got married in December. My understanding is that we can file jointly for the 2008 federal income taxes. She had no income so that should help me out some. This year, we are strongly considering moving some of our assests to China. Am I correct that as long as you do not take any money out of China to the U.S. that that money is not taxable in the U.S.? Also, I am unclear on how much money can be transferred out of the U.S.(invested) over there without any hassle, and I am wholy ignorant of what special filings with the federal government which might be required. Any guidance would be greatly appreciated.
  4. Hi guys, I understand the concept of submitting I-485, 131, and 765 together but as separate submissions, but what I am not quite clear on is where to put the I-865. At first, I thought I should put it as part of the I-485 submission, but now I'm not so sure. In other words, will I have three folders or four? Thanks
  5. I am getting really confused. I keep reading and reading and the more I do, the worse it gets. If you are filing for AOS, EAD, and Advance Parole concurrently, do you send all of the stuff to the same place in the same envelope or box? (I live in Virginia) By the way, my 90 days from entry will be up on 02-03-09. We are already married, but I am not sure I can realistically get the AOS papers in by 02-03-09. I see that I must pay $930.00 + $80.00 = $1010.00 for I-485 and for biometrics, but I can't tell if I have to pay any other fees for EAD and Advance Parole if I am filling at the same time. I notice that some of the supporting documents for I-765 are the same as for I-485. If you are sending them in together, can you just send in one batch of supporting documents, or do you need to send separate ones for them? I see that you need two passport size pictures for the I-485 but it also looks like you need two more for the I-765. And finally, I saw something about including I-797C notice of receipt of AOS submission, but I don't understand how you can do that if you are submitting things at the same time. Thanks
  6. I was thinking that the I-864 had to be notarized, but now that I am almost finsihed filling it out, I don't see anything about that in the instructions. So now I am thinking it does not have to be notarized. Am I right?
  7. Filing addresses for these forms for K1/K2. I live in Virginia. I think I am supposed to send the I-485 package to USCIS P.O. Box 805887 Chicago, IL 60680-4120. Is that correct? Also, on the I-765, for my wife I fill in C-9 on item number 16, but what about my step son (K2). Is that the same for him? Thanks. I'm sure I will have more questions. Sorry to be a pain.
  8. Let me start with the easiest question. Is an infopass appointment required or is it just used to answer questions that you can't get answered elsewhere. In other words, what is the purpose of an infopass appointment? Next, I am making good headway on my various forms, but I have a few questions that did not get answered by the sample forms that I looked at on visa journey. On G-28 In the first block where it says In re: I put AOS from K1 fiancee to Perm. Cond. Resident. (Is that OK?) I entered my wife as the petitioner (Correct?) I did not list her 20 year old son on this form. Should I list him too or should I fill out a separate one for him? (I'm thinking I should fill out a separate one for him and have him sign it) In the block that says check applicable items I chose 4. Others (Explain Fully) and I wrote in - I am _____________'s husband. We were married on 12/15/2008. In that same block I think I should print and sign my name, ph. no., etc. In the final block where it says Name of Attorney or Representative, I printed my full name. Then, where it says, The Above Disclosure IS...., I wrote - Adjustment of my status from K1 Visa holder to Permanent Legal Resident with Condition. I-765 is a little confusing. I think I need to fill out a separate one for both wife and son, but I am having a little difficulty understanding the correct answers for each of them for question number 16. I-131 is very confusing. I looked at the sample on VJ, but they only filled out such a small portion of it, I am really not sure what to do. And finally, how long is my employment verification letter that I obtained for Guangzhou valid? Do I need to get another one? Thanks for any and all help I can get. You guys are the best.
  9. We have not applied for EAD yet. I thought we were sup[posed to do that at the same time as we apply for AOS. I plan to do that within the next three weeks.
  10. Another question. The instructions for AOS are clear in requiring Passport pictures, employment letters, copies of other documents such as marriage certificates and passport/visa pages, but what about the evidence of relationship materials such as bank cards, YMCA memberships, utility bills, pictures of us together in America, etc? Do we submit that stuff with the application for AOS, or do we wait and bring them with us to the interview? Thanks.
  11. Hi, As I indicated earlier, I applied for my fiancee's SS card on 11-18-08. At that time, we were told that her son could not apply for his SS card until after we adjusted their status. (IS THAT REALLY CORRECT? I did not question it at the time.) Later, having never heard anything from SSA, I finally married my beautiful wife on 12-15-08. On 12-23-08, we re-applied (updated our application for her SS card). They told me we should receive her card in 2-3 weeks. So far, we have not. Now I'm getting worried because there are so many things that you can't really do without your card. And I still am not sure they were right in not allowing my son to apply for his card. HELP!!! B)
  12. Hi Guys, I have started filling out the various forms for my AOS package, but I am having a hard time understanding some of the information they are asking for. I have tried to read a lot of stuff about all of this, but I have not seen any sample forms that are already filled out. I think these would be enormously helpful. (Of course names and numbers could be changed for privacy if necessary.) Are there any such forms, or is there anyone out there who can help? Thanks.
  13. Hi Everyone, I have not written for a while. My new family and I have been very busy getting our home in order. Now, I have a question. On 11-18-08, we applied for my fiancee's SS card in her maiden name. On 12-15-08, my fiancee and I got married by the Justice of the Peace. We will have a "real wedding" later. Today, 12-23-08 having never heard anything from SS, we went back to the office. The woman there was very nice. She verified my girl's immigration status with DHS. Then, she updated our application to show my wife's new name. (Now my wife is using her first name, her maiden name for her middle name, and my last name for her last name.) As we were leaving the SS office, the woman said that we should contact DHS to let them know we had gotten married. Is this really necessary now, or can we just do that when we file the AOS paperwork?
  14. Hey, I'm sorry I made a very poor reply to you. My girl and her son just came through Newark on Nov. 6. This is how it was done. They picked up their checked baggage and went through customs. After they were cleared, Customs sent their luggage back to Continental so it could be forwarded on to Norfolk. My girl and her son did not have to take it back to the airline themselves. They exited customs and we rode the shuttle to the proper terminal (Terminal A that day), and then we went through security with carry on luggage. We boarded the airplane together and came home.
  15. Not to Houston, but I have flown from Beijing to Newark and from there to Norfolk three times. I had no real problems, though the last time, the flight to Norfolk was delayed.
  16. Hi Guys, I had hoped my girl and her son would go ahead and get all of their vaccinations in China, but they did not. Accordingly, I now must get them done here. I have looked through the stuff they brought from China, and all I am seeing is a little red medical book for each of them, and I don't see any vaccination forms, any yellow record book, or anything. How much (what sections) of 693 do we need? Also, I have tried to use the USCIS web site to find a list of civil surgeons in our area, but I don't see any list thought there is a link for it on their web site. Help!!! I wanted to go get their vaccinations done today at Public Health, but I think I need to await your answers to make sure I take everything we will need. I think we will go apply for the SS card for my girl today. I understand we can't get his until we adjust their statuses. Thanks all.

By the way, my new family is here now and we are getting settled in - moving things, unpacking, etc. I will write more later.

  19. Hi everyone, I will be meeting my fiancee and son in Newark on November 06. They are coming on K!/K2 visa. My question: Is there any way I can join them and go through immigration and customs with them? I will arrive in Newark a good six hours before they do, so that gives me plenty of time to ask some questions there as well, but I was sort of hoping that someone here might know something about it as well. They will arrive at 5:40 PM and then we will board another plane and leave for Norfolk, Va. at 9:10 PM. Thanks.
  20. You guys are a lot smarter than me. I have been reading all of this and I'm having a hard time figuring out where my fiancee and I will fit into it. She will arrive in the U.S. on November 6, 2008. She has made some money this year in China, but not much. We will probably get married near the end of the year or just after New Years. What must we do to comply with U.S. tax law, and what should we do to get the best deal through the IRS? I had thought it was already so late in the year that filing a joint return would not be possible. Should we file jointly? If so what do we do? Should we file married, but separate? Again, if so, how do we do it? I have an accountant here in the U.S., and I will let him prepare my taxes, but if I knew (understood) our options and requirements, I could give him the necessary information to do everything correctly.   22. Hi everyone, I will meet my new family in Newark on November 6. Meanwhile, my new son's father just bought him a new laptop in China. So, when he arrives, I need to get windows xp installed on it. I am not proficient in uninstalling and installing software. What is the best way for me to go about this. Also, I seem to remember someone saying that it is possible to keep the computer so that it functions well in both English and Chinese. If this is true, how do I do it? Or maybe I need to take it to someone and let them do all of this for me. Any suggestions would be greatly appreciated.

I love the story you mentioned about Laban, so much so that my daughter's middle name is "Rachel." hmmm...now we're getting somewhere...I think So, what you are saying is that, although there may not be scripture that directly gives a commandment against mutiple wives, because it is the law one must simply obey? If that's the best there is, I'll give that a shot at an explanation to the class next week. Anyone else? Anyone... anyone... Well Dennis, yes, that's exactly what I'm telling you. There is absolutely nowhere in the New Testament of the Bible that specifically states that a man should only have one wife. It was a long time ago that I studied Theology in college, and we discussed this issue at length. I remember then that it always brought a lot of input and discussion. There were lots of opinions on the topic, and people will take a variety of scriptures and try to manufacture their own view. But still, you will not find that specific writing anywhere in scripture. I agree. There is "God's law" and Human law. Christians are expected to obey both, unless of course there is a conflict. Then, some will say they should simply obey God's law, others will say they should work to change Human law to bring it into harmony with God's law. In this case, as has already been pointed out, there is no conflict because there is nothing in the Bible that prohibits polygamy. Hence, a "Good Christian" must obey the laws of the land regarding this issue. I hope I have not offended anyone here. This is simply my opinion based on my reading of scripture. By the way, I am not a Christian, I am closer to being a Buddhist, but I studied many different religions in college, earning an interesting but largely useless degree.
