  1. Dan, You are right. In US, you can mail the passport with the tax return. I just want to see if there is any issues, so I plan to drop off to the TAC. Yes, I see that on Beijing's website as well regarding Certification of True Copies: However, at Beijing site: http://beijing.usembassy-china.org.cn/acs_notary.html under What we CANNOT do:Certify true copies of documents. Note: If you need a certified copy of a foreign passport for IRS purposes, you may either contact the IRS office or use a local notary. It is really confusing what exactly they can or can not do. I don't understand the difference between "certificate of true copy" and "certify true copies of documents" I am guessing the first one is for them to certify true copy of document in English".
  2. I actually contacted the Beijing IRS office when I was in China. They told me they don't handle the W-7. Asked me to go to Shanghai consular get passport copy notarized then send it with tax return to Austin, TX. It has been round and round regarding this topic. I am going to try to go to the US TAC with my wife's passport. The only thing worries me is because she is not showing in person, they have to send the passport to the ITIN unit in Austin, TX. Then send back to the US mailing address. I will let you know if this way works or not.
  3. I contacted the IRS in US. The Tax Assistant Center will except the W-7 filing with original passport. They will return the passport in mail to the US address. They will accept the certified copy of the passport as well. How can my wife get the certified copy of her Chinese passport in US Shanghai Consulate? Does she just bring her own passport and they will make a copy then certify it? I find on Beijing Embassy web page: http://beijing.usembassy-china.org.cn/acs_notary.html mentions "What we can not do" : Certify true copies of documents. Note: If you need a certified copy of a foreign passport for IRS purposes, you may either contact the IRS office or use a local notary. It seems there is no way to get a certified copy of the passport. Please advise what should I do. Ask my wife mail me her passport and submit it to the Tax Assistant Center here?
  4. Can I ask my wife to send me her Chinese passport and I go to an IRS Acceptance Agent to file the W-7 application?

  6. I found the notary service on US Shanghai Consulate web site. I will ask my wife to get the password notary.
  7. The difficult part for me and my family is I am living in US and my wife and 4 month old daughter live in Shanghai. We want to get the green card for them, so our family can reunited again. No matter file the tax as married joint filing or married separately, the TurboTax will always ask for the SSN or ITIN. If I print out and file with mail, I am afraid the IRS will ask the ITIN as well. By just mail my tax return will be enough for the NVC? To get the W-7, my wife will need to get her passport copy notarized at Embassy. Any one knows how would she do that? Will the US embassy to allow a Chinese citizen to enter and apply for the notary? How can she make an appointment for that? Please advise! Thanks
  8. I have filed my tax extension for 2012. If I submit my tax extension with 2009 to 2011 tax return to the NVC, will that be sufficient?
  9. My wife lives in Shanghai. We contacted Beijing IRS office, they said they don't issue ITIN nor have a phone call with us. They ask to submit our joint tax return with the W-7 application in US. However, I am not sure how long this will take. If our I-130 process goes right, we are expecting in June or July, the NVC will contact us.
  10. Need help urgently! I tried to file my tax return as married file separately. However, it does not allow me to file because my wife as no S/N or TIN. Can I file as single? or Should I file as joint? How can I sort out the TIN issue?

  12. One more followup question regarding the tax return. I only need to provide the federal tax return for the I-864. Do I need to include the state tax return as well?
  13. Just to be cautious. My daughter was born in China in Jan right before I became US citizen in April. She is still qualified for the I-864W, right?
  14. Thanks for the confirmation! It looks like I need to file the tax return ASAP no matter it is I-864 or I-864EZ for me.
  15. Further study, the I864W with 40 SSA coverage is for Visa applicant to earn it, which is my wife. That does not applied to her then. However, my daughter should fall into this: "You are sponsoring a child who will become a U.S. citizen immediately upon entry under the Child Citizenship Act of 2000 (CCA)". So I should file the I864W for my daughter?
  16. Even more confusing, it seems I have to use the I-864W instead because I have earned 40 quarters of coverage under the SSA. Does this mean I don't need to worry about submitted my tax returns or W-2s?
  17. I just stated preparing the I-864. I am going through web sites to understand all the details. I have several questions: 1. I filed the extension for 2012 tax return, due to the complication getting the TIN number for my wife. If I am still not able to file the complete return when the NVC asking for the I-864. How can I address this issue? 2. I see there is an I-864EZ form to use the W-2 instead (That should resolve my tax return extension problem). However I am not sure if I can take this route. The three requirements are: a. You are the person who filed Form I-130, petition for Alien Relative, for a relative being sponsored; (I meet this requirement) b. The relative you are sponsoring is the only person listed on the Form I-130 petition; (This one is tricky, I filed two I-130, one for my wife, one for my daughter. Each of them is the only person on their I-130. Does that means I meet this requirement? I think I need to submit two I-864, one I-864 for each I-130, correct? ) c. The income you are using to qualify is based entirely on your salary and is shown on one or more Forms W-2 provided by your employer(s) (I meet this requirement. Although I have some other saving income, but I don't need to use that. My salary income only would meet the requirement). Please advise! Thanks in advance.
  18. I just received the receipts for my wife and daughter's I-130. Could any one here help me to check if these are correct: 1. For my wife, the I-797C "Preference Classification" column "201 B INA SPOUSE OF USC" and in the body of the receipt, it lists NAME, Date of Birth, Country of Birth, Class (If Applicable), The Class column is blank 2. For my dughter, the I-797C "Preference Classification" column "201 B INA MINOR CHILD OF USC" The Class column is blank as well.

  20. I was checking the USCIS processing time for our cases. CSC showing Jan 19,2010 NSC showing no I-130 TSC showing May 16, 2012 VSC showing August 6, 2012, It seems will take way more time that 4-6 months?
  21. Thanks Dan, I am still try to understand the NVC process. As I understand, in my case, once the cases go to NVC, they will send DS-3202 to my wife and ask me to submit the I-864. Do we need to first mail in the DS-3202, then opt in the e-process to submit the I-864, 169, DS230 and other documents. If we opt in for the e-process (we prefer), how should I make the payment for the Visa process? Sorry asking so many questions so early. I just want to understand the next stage of the process, so we can be well prepared.
  22. One more question. Our I-130s were sent to USCIS Phoenix Lockbox.. When I check the USCIS processing time, which service center should I check?
  23. I filed all two petitions yesterday. Thank you so much for all the helps on our I-130 filing. Now onto preparing the next step. From VJ site: Pre-Interview Forms / Items: 1. Completed and signed OF-169. 2. Completed and signed Of-230 Part 1 and 2 forms. 3. I-864 Affidavit of Support Form along with past 3 year U.S tax returns (or transcripts) and any other financial documents required. 4. A copy of intending immigrants biographic page of passport(s) including expiration date. 5. Original or certified "long" birth certificate. * 6. Original adoption decree. (if applicable) 7. Marriage certificate. (if applicable) 8. Divorce decree(s) or death certificate(s) (if applicable) 9. Police certificate(s) ** 10. Court and prison records.(if applicable) 11. Custody records. (if applicable) 12. Military records (if applicable) Are all these documents sent to NVC would be similar as sending to USCIS, in copy not the original? Any one knows Chinese Police certificate will valid for how long? When should I ask my wife to get the policy certificate? What about my baby daughter, would she needs the police certificate as well? Thanks in advance!
