  1. Randy, Thanks for the reply! Regarding whether to file I-864 or I-864W, the NVC lady told me, if I filed the wrong I-864, they will ask me to refile. What I want to know is if it is an option to me to file a normal I-864 for my daughter instead of I-864W to indicate we want to maintain her Chinese citizenship. However there is no information on Internet could confirm it is one way or the other. As you mentioned, she might be given the green card upon the entry, which would be strange if she is automatically granted as a citizen. Yes, I was billed once for the AOS fee even we have two NVC cases. I am wondering if this is usual for two related I-130 to have two NVC cases. In another word, it is the normal practice of the NVC. I am more concerned about the two separated cases will lead to more confusion down the road. For example, two separate package to the Guangzhou and two different interview time. If the normal practice is to have one NVC case after the I-130, is there any previous case to combine the cases by contacting NVC? Or it is complete waste of time. Will two cases cause issues coming to the interview time? Appreciate all the helps I am getting from this board! Bill
  2. Dan and Randy, Thanks for the response! Yes. I would like my daughter to enter the US and live here as a Permanent Resident. The reason I am so confused here is the lady at the NVC call center told me, if the child meet the automatic becoming US citizen requirement, she will be granted citizenship upon the entry not up to me to choose, which makes no sense. I am sure there are a lot of cases like ours, with children under 18 and one parent is US citizen. I am surprised that US does not provide an option for those children and automatically grant them the citizenship. I search the internet, it seems no clear answer to our case one way or the other. The second confusion part is how many I-864 do I need to file. According to the NVC lady, I have two NVC case, I need to file two I-864. However, I see suggestions for me to file only one I-864 to include both of them. How can I find a definite answer on this? Thanks! Bill
  3. Randy, Thanks for the reply. I understand a US citizen does not need a green card. My daughter currently is a Chinese citizen, because when she was born, I was not an US citizen yet. My previous understanding for my daughter's situation was that she will be given a green card upon the entry and we can file the N-600 anytime before her 18th birthday through naturalization to become a US citizen, Forgive my ignorance, looks like it is not as I thought? My questions are: 1. If I file the I-864W for her, does this mean when my daughter enter the US, she will not be given a green card? 2. We would like to have her maintain the Chinese citizenship and passport simply for convenience of traveling back and forth between China and US. We will file for her naturalization later before her 18th birthday. Is this possible? If it is possible, how? Thank you for your time and help! Bill

They told me I need to file two I-864 forms since there are two NVC cases. I really doubt the lady answered the phone gave me the correct information.   5. Dan and all nice people on this board: I finally got both my wife and daughter's GUZ number from NVC emails to me. Looks like they have some changes to the process? They directly sent me , the petitioner, two emails. The emails are titled "GUZXXXXXXXXXXX (ACL FOR WWRO)(CC)" with a PDF letter to the principle applicant instruct to submit the DS-261 online. We have already submit the DS-261 online to point me as the agent. I also received email for the AOS fee, which I paid as well. I received one email for paying IV fee, still waiting for the IV fee email for my wife. I have some questions: First of all, although I filed two I-130, shouldn't NVC combined them into one NVC Immigration visa case? 2. Since now there are two NVC cases, I called the NVC, they told me I need to submit two I-864, but they won't be able to tell me which I-864 I should use. It is obvious with two NVC cases, there will be further delays, Is it possible to ask NVC to combine it into one NVC case? Thanks in advance! Bill

  7. I finally got the NVC case numbers for both my wife and daughter. Paid the AOS fee. I am working on their I-864 and I-864W. One question regarding the I-864W. My daughter meets the requirement of automatically become US citizen upon the entry. Does this mean that she will not be given a conditional green card upon entering the US? If she still receives the green card, can we apply the US citizenship later (before her 18's birthday) and continue to use her Chinese passport for traveling ?

  10. One Question regarding filling out the I-864 Part 6: In the I-864 instruction, it states "This section is used to determine the sponsor's household income. Take your annual individual income from Item 5. and enter it on Iten Number 6.c. If this amount is greater than 125 % of the PVG, you do not need to include any household memeber's income." My understanding of "Take your annual individual income from Item 5. and enter it on Iten Number 6.c." is for the caculation of the PVG. I don't really need to enter into the 6.c. or 6.a and 6.b. Correct? I don't understand couldn't they just say, compare the number in Item 5 with the I-864P table to determind if any household member's income needed for item 6-10. Please let me know your thoughts. Thanks!
  11. So the two photos for each applicants are scan and send via email. Then submit the photos in the interview? Just to confirm, for the 1 year old, still need two photos as well? ( Didn't submit the photo for the daughter's application, at that time she was 3 month old)
  12. Dan, Thanks for all the answers! Some more clarification. In your outline of the process, step 7 opt in for the electronic filing, Setp 8 is to file two DS-260. Is this DS-260 filing electronic or by mail? If it is electronic, how can I send them the photos of the applicants? I read from State web site, once opt in for the electronic filing, everything should be scan and send via email. Does that mean I send them the scan of the photo as well?
  13. Dan, Thank you so much for the answers. Prior to your post, I thought I would need to file two I-864 just as I filed two I130. If I read your post correctly, I only need to file one I-864 for both of them? In our cases, do you know whether the NVC will assign them two case numbers or just one? Will I need to file two set of DS-260 & DS-261 or just one set?
  14. I have several questions regarding the efiling with the NVC. Here is a list of the document I will need to send to the NVC for my wife: 1. I-864 2. DS-260 3. two photos. 4. Copy of Valid Passport - Question: Chinese passport has English subtitile, no need to translate? 5. Notarial Birth Certificate (Translated) 6. Notarial Marriage Certificate (Translated) 7. Notorial Divorce Decree (Translated) - Question: Both I and my wife devorced before, will we just send her divorce Decree or both? 8. Nortarial Police Certificate (translated) - Question: Is there an expiration of the Policy Certificate? We are waiting for the NVC's initial letter, should we start to obtain the police certificate now or wait till receive NVC's letter? I think that is all the documents we need to scan and efile with the NVC. What about the original I-130 documents? I don't need to include that in the efiling to the NVC?
  15. I have several questions regarding the I-864: 1. I-864W is for applicant who earned 40 quartars SSA, not the sponsor who earned 40 quarters SSA. Correct? My wife has never worked in USA. In our case, She has to file I-864? 2. My daughter is only 1 years old and I am a US citizen. She is qualified to file I-864W. However, does that mean if we file I-864W, she will automatically become a citizen upon the first entry of the US. What if we want her to keep Chinese citizenship at the moment? 3. If filing the I-864W automatically grants my daughter citizenship upon the first entry, can we file I-864 instead? Thanks in advance!

  17. Hi, Every Friend here. After a long 10 months wait and NBC for no reason sending my wife and kid's I130 to field office for judication, I received the notice from my local field USCIS office to have an interview with me. I just finished the interview and was told both cases are approved. The officer who interview me told me there was no extra notes on our cases and he didn't understand why the NBC took so long and why they didn't approve the case by themselves and sooner. When I filed my application, my daughter was only three month old, she is now 13 month old. I missed all the happy time being with her since she and my wife are still in China. Since I filed I130s myself (I checked with the USCIS field officer, there was no errors on our applications), I would like to have your help again to complete the Visa application process. I have a few questions for the Visa process: 1. My wife and daughter are living in Shanghai, even there is a consulate in Shanghai, their interviews will still be in Guangzhou, correct? 2. Is the efiling for the Visa still available for our cases? 3. I have not yet filed my 2013 tax return. I did obtained 2010-2012 tax transcript. It is obvious not enough time to get the tax transcript even I am filing now. Can I send in the 2013 tax filing without the IRS approval? 4. What kind of time frame currectly for getting the green card visa after the I130 approval? Thank you in advance!

I guess I just have to wait then. Would it be helpful to go through the infopass for an appointment at the local field office for the case status? Will they be able to provide more detailed information regarding our cases than calling the customer service? I called, no help.
  19. I contacted my senator's office for help. They checked the status and got the reply from USCIS that the case is at NBC and NBC is holding the case before they send to the local field office. I think they are mistakenly think that my wife and daughter are in USA and waiting to send the case to local field office for the I-485 adjustment. How can I correct this?
  20. The receipt day for the I-130 of my wife and daughter is April 17,2013. I still have not heard anything back from USCIS. The status on their web site is still "initial review". Both cases are at National Benefit Center. On USCIS web site, there is no estimate time for I-130 cases. Since both my wife and almost 5 month old daughter are in China, should I try to submit the I-129F for K3/K4 visa? Or should I wait patiently for the I-130 to complete? It is too painful for me not being with my family, specially missing out seeing my daughter everyday.
  21. Randy, Took your advise. Using the Turbotax print out the tax return and mailed to IRS. According to IRS pub 501 page 7, fill in "NRA" in my wife's SSN column. I debated, however finally filed as "Married file separately". Thanks for everyone who commented and helped me on this issue.
  22. Unfortunately TurboTax Keeps failing the error check and refuse to efile the return. It keeps asking the SSN number for wife.
