That doesn't sound real promising as far as getting a visa in Hong Kong - I think he needs to figure out where the visa is going to come from before he leaves, which may not be Thursday.

They also have same day service. And most of the visa services will overnight, if need be.

I had emailed GUZ before they opened Friday that we would be coming to China and could they please schedule his interview while we were there? So he gets the P4 yesterday (today if you're in China), and we get an email that the interview is scheduled for Sept. 28! We'll be there (Guangxi, except for the side trip to GUZ) Sept 24 through Oct 15 Kind of puts a crimp on our first week there (We are planning to stay in Beijing for 1 day, and then take the train to Yulin) and my travel agent/wife doesn't speak English. But I'm sure she'll figure out how to do things.

To get it done quickly after arrival: Have her come NOW, get married, and apply for AOS and AP (and EAD?). The AP document came in about 2 1/2 months in our case. She needs her Chinese passport and the AP document to travel. The longest she can stay in China: 6 months until the visa expires. I see David's here, also. I'm sure he'll straighten this out.

I would say definitely file the AP now (with the AOS), to make sure you have it for the trip. We had our AOS interview in June, and are still awaiting the FBI background check. I think that's happened to a few others as well. If you file the EAD now, it would need to be renewed in a year, if you still don't have the green card. I suppose you could wait 9 months, and then file the EAD. Maybe someone else might have an idea about how well that would work. Bottom line, don't count on getting the green card by a needed date.

That may or may not bode well with GUZ... I'd prepare my SO for some extra questions if I were you... and then some... I had been married three times, but no questions were asked anywhere (except by Jiaying). It seems like it's best to NOT get her overly concerned with this issue. Any questions for the petitioner are likely to be simply blue-slipped, with no questions asked at the interview (as for Michael & Manyun).

Why not get her a new I-134? Also send copies of 2005 tax forms (which you've done), a fresh employment letter (I just used the raise letter that I got), copies of 3 most recent paystubs, your mortgage statement. This stuff is NECESSARY only if they ask for it - it's good to have handy just in case. -
90 days from NOW is in December - she can simply delay her entry to make sure she can stay through that period. The visitor's visas are usually for a 6 month stay.

Jiaying has a card for our VISA account. Everything is charged to it. I'm glad she doesn't read English, because she gets plenty of applications.

I think the notarization of the translated copy would have to occur when the translation is made - not in Lizhou, unless you find a translator there.

Check other timelines for P4 dates in early August - for example, Michael and Manyun's P4 date of 8/3, and interview date of 9/14. The October dates were not scheduled until about August 20, if they still follow their past patterns. So you're probably correct, but remember that Oct 11 is coming up pretty quick. -

If his visit visa would be denied , how could we count on a student visa ? It would be still a problem. Student visas are awarded regularly, visitor visas are denied routinely. If your son applies to, and is accepted for admission to an American university, he will most likely get a student visa. Many American universities, like the Unversity of Texas, actively recruit foreign students. -
This was a definite pre-determined outcome. If they had notified you in advance, it would have given Manyun time to get the information together, and you could have gone to GUZ for the real interview, instead of this farce. Stick to the facts, and be very matter-of-fact about them. She knows when they separated (doesn't she?), and around when he married his second wife, and when they had the child (or at least when she heard about it). If she has any idea where he is (hopefully at least in a different city or province), provide that. And state that he refuses to answer any questions. And, make the case that she thought she was divorced (and so did you) and didn't find out otherwise until after that first trip. This is an especially nasty curve-ball, but it sounds like an easy overcome. Hit them over the head with the simple facts - that you both thought she was divorced, that the ex re-married before the divorce, and that he refuses to cooperate - and then explain the details in a paragraph or two. They don't ask for the impossible - they simply ask. You provide the information that is available. Good luck - we'll be watching for the good news.

All the necessary forms may be downloaded from the Candle FAQ's. Make sure your SO is ready on October 11. She will need the P4 letter from the Consulate to get in. They will issue another if she does not have the first one.
