  2. No - they would get the 10 year card, if, at the time of the interview, you had been married 2 years or more. With the K3, it would be MUCH easier to stretch it to the 2 year anniversary. With the CR1, it's at the time of the visa interview. With the K3/K4, it's at the time of the AOS interview, which can be delayed for up to 2 years.
  3. There IS NO appealing the consulate's decision. What HAS HAPPENED (Goerge&Li) is that they were white-slipped, it was returned to the USCIS and they got a court hearing. The case was won, and the USCIS re-affirmed the PETITION and returned it to GUZ. It is STILL up to the consulate to decide whether to issue a visa, or not. FOR THIS ONE CASE (very rare) they decided to issue the visa. But the appeal ONLY concerns the petition, not the visa.

  5. It's true if they're from another state - the regulations do state they must be surrendered. She needs to be treated like a first time driver.
  6. No - the Chinese driver's license won't do her any good - simply don't tell them about it. They are not understanding that the Chinese ID is a national ID card - she will still need it. It's not like our state ID's at all. I don't think there's ever a reason to surrender it - even if she becomes a citizen. Go somewhere else, or talk to a supervisor.

But check up on the requirements to get one for your state. she has an american express credit card and will soon get a bank of america debit card with her pic on it. Those aren't ID's, but of course it's optional. The state ID might come in handy when she uses the credit cards - they sometimes ask for separate identification.

  11. Gary - your petition has been "locked down" at the consulate. A lawyer there will do you no good. It will be returned to the states. If the USCIS decides to rescind the approval, you will be notified by mail and givens chance to appear in court to oppose the recision. Do not miss the court appearance. A finding of fraud would be a disaster for your chances of ever getting a visa. A ruling in your favor could mean the petition would be re-affirmed and sent back to GUZ for reconsideration.Or it may just die (this is the most likely)
  12. All you need is the EAD, which comes in about 60 days. In the meantime, she's a stuck at home Momma. Jiaying was able to get a state of Texas ID the first month she was here (exp. 2011), and then use that to get her TDL, which arrived the same day as her EAD (not sure how we got the ID), but they apparently don't do that anymore.
