  1. You have a few textbooks to read - the president is one branch of government - the Executive branch. Congress is the Legislative branch, the third is the Judicial. They operate through a system of checks and balances so that no one (of the three) has power over another. The president is the single individual with the most power. Yes, the inauguration is "just" a show.
  2. Randy, thanks for your guidance. So, i need to send in a Packet 3 for her and also to submit all pertinent AOS documents? How would she attend a biometric appointment? She turns 21 in September 2009. Thanks again !! No - she will apply for AOS after arrival in the states. You need to mark the envelopes in bright red ink saying "Please Expedite - Potential Age-out". Contact GUZ (by the web email form) soon after they receive the P3 information to schedule an interview when either you or you wife can be there (they have been known to deny K-2's whose parents weren't there). When you submit her AOS application to USCIS, mark the envelope the same way. Your cover letters should carry the same message. They can (and usually do) cooperate. The timing is tight - try to keep it moving.

  4. First off - when does she turn 21? She must APPLY for AOS before she becomes 21, and MAY be turned down if she becomes 21 before her interview.   5. I would recommend that no one, EVER go against what it says on a blue slip. Remember, we still don't know what it really says.

  7. Whoa, there! If the blue slip actually does request an I-864, he will need to submit an I-864. We're going to a lot of trouble to tell him what is called for at the interview. What matters here is what is requested on the blue slip - get it together and turn it in.
  8. You would need - Why not apply for EAD? It basically provides her with a more-or-less legitimate status short of a green card. You'd come out ahead with the tax rebate (you'd have to pay for the EAD since she's not filing for AOS), and she could drive and work while waiting for the I-130.
  9. You don't say if your total income (from SS, pension, and savings) is above the poverty line. If it is, SHOW IT. Provide an accounting statement showing your income and savings. If it is not, you need a co-sponsor,

  11. With an interview on the 22nd, the problem is going to be whether the visa is ready that day, or the next which is the 29th on the consulate's calendar. If it's ready, you may be able to pick it up that day. Or on a day when the post office is open. If it's not ready, no one will be able to pick it up until the 29th. Either way, it would have to sit at the post office for 7 days (giving you 7 days to pick it up) before it is returned. That doesn't seem to be where your problem is.

  14. You don't need ANYTHING , unless it's asked for. Then it's too late. They will often ask for the I-134 w/3 years of tax returns. They will often not ask for it at all. Not having enough income is a definite red flag.
  15. Not for a 10 year card (I don't think). But her NOA1 will extend her green card status for 1 year.
  16. Yes - I believe that the business about "they can not use that against you and your spouse/fiancee"is WAY overblown. It is also illegal for them to give a visa to someone they feel is in a non-bona fide relationship. You can bet if they come to that conclusion, you WILL get a white slip, with a completely legal reason on the white slip. My advice is to be VERY CAREFUL about providing ammunition - even if it is "okayed by the USCIS".
  17. Three days would be the 17th - the post office doesn't close for MLK day. They would have had to have mailed it on the 15th (when they were open) 2) no - the visa will be at the post office

  21. If you mean after going to the US, the K3 is a multiple-entry visa. She may come and go as she pleases.
  22. I talked with David right after I had posted this - their original I-485 was rejected. He said the Guangzhou paperwork had expired, and he had to start over. The details and time aren't quite clear to me. Anyway, they filed a new I-485 with an I-130 so it would be based on that, and not the I-129F. A little more expensive, but it seems to have been faster and less painful than anything else they could have done.
  23. Of course, it's available on the IRS web site (download the 1040). As I understand it, no change from last year, except that you use this year's information to calulate a new rebate. Then subtract any rebate amount you might have received last year. So if your wife now has an SSN, you get the full rebate, if you didn't last year. Page 61
