  1. My wife has gotten her Heptitis C shots in a series from her employer within the last two years. Is there anyway for her not to take these shots again? What kind of documents would she need? Will employer letter be enough for this? Thanks!
  2. Pardon my ignorance, but what is EAD. Is it temporary work permit or is it change of status. Thanks! Jerry
  3. Chris, Thanks for the encouragment for those of us that just embarked on this long journey. Good luck and all the best to your family. Jerry
  4. aql, Do you mean that GZ will notify you within one month of receiving NOA2 or it takes 1 month for GZ to receive the application from NVC? Where are you in the process and what is you expection going forward? Thanks! Jerry
  5. I think the procedure for K3 is very similar to that of K1. NOA1 I believe is the notice of receiving the I-129F application. First part of NOA2 tells you that your application has been approved. Second notice or second part of NOA2 tells you that the application has been forwarded to GZ. We applied for I130 in may last year and believe that we probably will be able to get our K3 around August. Is this realistic? My wife has been accepted by a graduate program starting this fall and we really want to beat the timeline and not have to defer her program. Do you think that we should apply for change of status right after my wife arrives in the States or we should wait for the Green Card. As I understand, her green card may come through around March of next year and we will have been married for over 2 years by then. So we can get a real green card instead of conditioned GC. Any experience and comments?
  6. Guys, Just want to let you know our progress and timeline. K3 NOA1, 11/25/2002 NOA2, 02/25/2003 (Exatly three months!?!?) Case sent to GZ on 03/05/2003 I guess we are making good progress so far and hope things will be as smooth from now on. Was told by NVS not to call GZ until 10 days after 03/05/2003. Cheers
  7. We just got our P2 for K3. This is exactly 3 months after we received first notice after I-129F. Well, 6 more months to go!
  8. We got our first receipt (NOA 1) for K3 in late November and have not heard a thing since. Is this too long? Man this is frustrating. Missouri does not even have live operators!!
  9. Here I specifically mentioned "business visa" which is not hard to get if you have prior travel record to the US. My wife has come to states twice on business. Understandably, tourist visa will be more difficult to obtain without prior travel record to the US.
  10. Thanks a lot for the replies. Here is an account of what my sister in law did. She came on a business visa, which was not difficult at all to get if you have come to the states on business visa before. Once you have come to the US with a business visa, you don't even have to go to the consulate in Beijing to apply for one; just drop it off at a CITIC bank and they will take care of it. Once she landed in the US, my brother (USC) and she got married and filed I-130. She got her green card in little over a year in Texas. Her case is a bit different from my wives because we have already filed for I-130 and F-129I which indicates the intent of immigration even if we cancel them now. So by all account, even if my wife obtaines a business visa and land in the US successfully, we will have a tough time at the INS interview for her green card. Am I right or if anyone has anything to add or any experience or hearsays. Thanks!
  11. What do you guys think? Just cancel your k and cr-1 visas. Get her over on a business visa and get married in the States. My brother did it. However, what are the implications. Plus, my wife has come to the US twice on business visas. Can immigration lawyers take care of the rest once she is in the States?
  12. Mick, Since you have done this before, I would like to ask you a simple question. Does the joint sponsor use I-134 or I-864A? Should I fill out both I-134 and I-864 just as a precaution? Thanks!
  13. One more thing, My last year's (2002) income should be sufficient to cover the povery requirement. I thought what we earn going forward is probably more important than past income and this is why they require your employer certification. So are you guys saying the income shown on tax return is in fact the determining factor not your employer's certification? No matter what, I definitely will get both of my parents to co-sponsor. Just want to confirm that we don't need I-864 and I-864A for K3 in China? Owen, AZwolfman, David, thank you very much for your suggestions! Good luck and good night guys! Jerry
  14. Guys, It has been really helpful and I think the safest course of action is for me and my parents to file I-134 and all the supporting documents. You are right, it is going to be a huge task, especially my paretns and I don't live together. Also, on the I-169 (instruction for I-134), it says that the sponsor can also choose to write a letter of affidavit. Has anyone done this? Is this critical? So far, I haven't seem anyone mentioning it anywhere on the web other than the tax returns, bank statements, employer letter, etc. Thanks a lot!
  15. James, thanks a lot for your kind words and this is one major question that has been bothering me. Thanks again!
  16. Hi, guys, I am new on the board and would like to ask you some questions. This might be tough one for most of you as most of your are working professional. In my case, I am currently a graduate student in the US and bit young compared to most of you guys. As for our story; I am a naturalized citizen originally from Beijing. Having studied and lived in the US for 7 years, I went back to China and worked at a bank, where I met my wife. We were in the same business group and sat next to each other. With all the blessings, we got married early this year. Then, we got a little ambitious and decided to pursue MBA. So we separated a few months after our wedding and i am now in NYC and she is still in Beijing. She has also been accepted by a MBA program in NYC (God was good to us once again!) We just filed the K-3 visa (I-129I) in November and we were really afraid that she might not get her K-3 before school starts in August, 2003. Guys, do you think we have enough time (approximately 9 months including both Christmas and Chinese New Year which will waste about 2 weeks of time together.) Also, I am currently a student and don't have any form of income other than my student loan. So should I joint-sponsor with my parents, who do have steady income? I called DOS and the person told me that only one person needs to fill out I-134 and in my case, it will be either my father or my mother, not me. Does this make sense or has any one had similar experience? Should I and my parents also fill out both I-134, I-864, I-864A just in case and the consulate choose what they will take in? Thanks a lot in advance! Merry Christmas!! Jerry
