total shock

I am so upset and sad. I'm not clear yet what happened, but my fiancee was told she was denied for a visa today when she went to pick it up! You read correctly folks! Yesterday she was told everything was fine, and today they refused to hand over the visa they had already "approved". My fiancee was crying her eyes out when she called me at 4a.m..

 

From what I understand, they said 3 things

 

1.We are not a real relationship

2.They are sending my paperwork back to U.S. Immigration

3.They will give her the visa if I go to China and marry her there!!!

 

This makes no sense...if they claim #1, then why would they even suggest #3?

 

I am heartbroken, sick, and trying to understand what went wrong. My so will be sending me a more detailed e-mail,and I will calling my attorney. This is an outrage! After everything they put us through....they better have a very good explanation!

OMG! That is so terrible Alex. I am so sorry to hear it.

Haven't they been hard enough on you and her already?

 

Boy oh boy... Yes. This is time for an aggressive attorney and perhaps some influence from your congressman and senator. For that matter, it is time to contact the Ambassador to China - Clark T. Randt, Jr. You can contact him in Washington D.C., or have your senator contact him.

 

Also, while I know it is certainly not an option for everyone, have you considered other options, such as moving to China? After living for six months in China (I believe) you can marry her and apply for the CR-1 (or DCF) visa. I believe this is a very fast process and you can do it through the Embassy in Beijing. Just a thought.

Alex, sorry to hear of this turn of events. I've heard of this happening in the past, but I've never been clear why a case could be approved one day, and then denied the next. This is where having an attorney really pays off. Your attorney should be able to best evaluate the situation and help you with an appeal. Best of luck.

First, make sure about the denial. Was the visa flatly denied or was she blue slipped? Your point #1 suggests a blue slip where you can submit additional evidence, but point #2 suggests a flat out denial.

 

Second, did they take her passport when she was advised to return the next day to pick up her visa? If so, is there something in the passport that may have triggered something - like a different name or age from that shown on the paperwork?

 

Third, take a look at http://travel.state.gov/visa/state041682.html which provides some information on what usually happens when the files are returned stateside. Find a good immigration lawyer who might shed some light on what this all means.

 

I know this has to be one of the most disheartening events in your life, but take a deep breath and try to sort it out. Obtain as much information has you can from your fiancee and assure her that you are doing everything in your power to right this wrong. Best of luck to you.

Hey Alex, jump on a plane, marry her, bring her back and get these people off your back. If that is what it takes, you must do this. I hope they will not ask you to start the K3 visa process from the beginning I hope.

 

This is unbelieveable! Are there any other reasons why they may be doing this? What is your gut instinct as to why they have singled you out? This is so unusual? :lol: :lol:

Alex: You mentioned in an earlier post that she had used a translator. It's possible that your problem stems from a translation that misrepresented the reality of your case (the translator writing what they thought the embassy wanted to hear instead of the actual facts) or possibly a translator who just wasn't knowledgable enough in English to get your details right. Just a thought . . .

If your lawyer is native Chinese, maybe he can get to the bottom of things.

Holy sh*t, this is shocking!! And an outrage!!! I've never heard of anything like this!! She passed the interview, told to come back the next day, then was rejected, WTF?!?!

 

And they said what?? That if you go to China and marry her then they'll giver her the visa???? I've never heard of this before. Something ain't right.

 

Like others have said, get clean clear copies of all the paperwork she was given, then hand them over to your lawyer.

 

That makes no sense ... if you go over there and marry her, how can they then issue her a "fiancee" visa?? They can't! You would then have to apply for a K-3 visa, which means you guys would have to start all over again and go back to the back of the line. What a load of crap!

 

I wonder what difference it would have made if you were there for the interview?

When Bing was denied the folks here rallied around me to help me through it. This is new ground. Moon is the only one I can think of who has been through similar problems. You have the lawyer already, use him. You need a clearer picture of just WTF the problem is. It is almost as if they are trying to make the K-visa process nearly impossible. I think they forget they are playing with peoples lives here. It truely is an outrage. I am especially confused by them saying go to China and marry her. Seems to me that would force you to go through the K-3 process from point one. If that is what it takes though I would be on the quickest plane I could get on with wedding ring in hand.

This may be an outgrowth of a situation here in Seattle. Several people were arrested on Visa Fraud! Evidently 130 immigrants have come over from Viet Nam illegally. People were recruited in casinos to go over and bring back "fiances" for $1000 and a free trip. They were instructed to write letters of "commitment" take pictures with the "fiance" in Viet Nam and then travel back with them after the Visa was granted.

We may being seeing more backlash from this!
