What is the process for getting the ir1 visa? We have the cr1 visa right now. We will be married for two years in December 15, 2018. Thank you

Once having the visa only two options:

• Delay using it to enter the USA until after 2 years of marriage (Dec 15 2018) probably not an option because the visa probably will expire before then.
• Use it before your 2nd wedding anniversary and then 2 years after getting the CR-Green Card you file an I-751 to remove conditions.

Yes, that's a little gotcha. If you had delayed receiving the visa (by delaying the interview or by not submitting the passport) until AFTER June 15, the expiration would have allowed her to wait until your second wedding anniversary. She would receive an unconditional 10 year card and you would avoid having to file to remove conditions.

 

What is relevant here is the second year anniversary date (Dec. 15) and NOT the visa type (IR1/CR1) in itself. She must enter the U.S. AFTER that date in order to receive the 10 year card.
