Filing I-130 for my wife and 2 month old baby

Recommended Posts

I would also attach copy of marriage cert + Translation to both petitions.

Spouse petition should also have evidence of relationship, (some Photos together, one or two of you with extended family, copy of child's birth cert attached to spouse petition)

One member recently went through whole process, he tended to ask questions for each and every detail and step.

I found in the post you referred to for the details of the I-130 preparation. He listed one thing: "Evolution Of Relationship". Do I need to write the details about my marriage with my wife and if so, is there any sample that you would recommend?

EOR just to wife's petition.

EOR will detail how you met, and how relationship evolved and details your trips to China.

Having a child pretty much sets the deal, USCIS and the consulate tend to want to reunite a family, it would be very rare for them to deny a petition and visas in this situation.

Filing in US, I would not need my wife's Chinese Passport Biographic Information Page in her I-130 package, right? I read the I-130 instruction, nothing mentioned in there.

Here is the what on the cover letter regarding the content for my wife's I-130:

- Form G-1145
- Evolution Of Relationship
- Payment in the amount of $ 420.00
- Form I-130
- G-325A and passport style photo (Petitioner)
- G-325A and passport style photo (Beneficiary)
- Copy of US Naturalization Certificate (Petitioner)
- Copy of Notarial Birth Certificate (Beneficiary, Translated)
- Copy of Notarial Marriage Certificate (Translated)
- Copy of Petitioners Divorce Decree (Marriage 1)
- Copy of Beneficiary Divorce Certificate (Marriage 1 Translated)
- Copy of Beneficiary Divorce Agrement (Marriage 1 Translated)
- Copy of Birth Certificate of Daughter
- Copy of Bank Account TOD Letter
- Photographs of Petitioner and Beneficiary together

Could you please let me know if it looks OK? Anything missing?

Beneficiary birth cert not needed in the petition, it will later be needed to be sent to NVC after USCIS approves the petition as part of the foreign document process.

If Bank account is a joint account, then yes a statement attached to petition shows co-mingeling of funds as a married couple, if the account is just in the name of petitioner, that may later be used for affidavit of support.

I dont believe any passport photos needed for child's petition.

Other than that it looks good.
