Should I Contact a Senator?

Hello everyone,

 

It’s been over five months since I mailed out my K-1 application. Under the advice of my lawyer, about 3 months into the processing time, I submitted an expedite request based on an emergent situation. Two months have passed since my expedite request was received by the Vermont Service Center, and I have heard nothing back yet(not even a denial.) Furthermore, the last two times I called the NSC, they told me that normal processing time was 5 months. When I called again yesterday to find out the status of my expedite request, (which they still had no answer for), I was informed that the processing time was now 7 months. They were still working on Feb. 28th applications!

 

I’m not sure what else I can do. My fiance and I really don’t want to needlessly wait 2 more months. Is it worth asking a senator for a letter at this point? Could a senator’s letter possibly annoy anyone at the service center and cause more harm than good? Some insight would be deeply appreciated. I don’t want to rock the boat if there is the risk of it tipping over. :sweating_buckets:

Yep has to be an extreme emergent situation for them to bump your case ahead of all the others filed before yours still waiting.

 

Are you in the military, and are about to be deployed? That is one of the very few cases that warrants an expedite.

3 months is nothing, and yes VSC is quite backlogged, and 5-7 months is the current norm.

Like chilton747 said, you can contact your congress person but they aren't going to be able to find out anything you can't already find out yourself. Yes, hate to be the one to tell you but other than being able to show your girlfriend that you are doing something, they are useless.

 

Sent in an expedite at 3 months? Yikes, unless you are military I'll bet that went over like a lead balloon. I doubt they put you farther down the list but I can imagine the look on some overworked USCIS officer's face. Did the lawyer recommend that? Generally USCIS operators will hardly even talk to you until you're over the "normal processing" time period.

 

Just hang in there, if they told you the normal processing time is now 7 months then you're gonna have to find a way to live with that. Yep, it sucks, but you, your attorney, and some lame duck politician can't speed things up. You'll be at the NVC stage before you know it.

 

If you're at five months now, and can get the time off work, etc... take another trip to Chinertucky to see the lil' lady, plane rates are low this time of year..Get busy with somehthing.....start working on interview questions and her english, anything productive to pass some time.

 

For what it's worth, it took our case 8 months for my wife to get through USCIS....and that was when most people were getting through in 4 or 5 months. We made it through okay....so what, if we got kicked off Yahoo Messenger for too much internet sex, Verizon cut off my phone for excessive phone sex, and my therapist had me on 400mg of some kinda weird stuff to make me stop howling at the moon at 3am. The time was nothing, I tells ya....I haven't barked, peed on any fireplugs, or howled at the moon in over 8 months now. The shrink says I can stop the drugs in another month or so....the time was jes a walk in the park.

Like Dan said, Three months is nothing.

Look at my time line and i did k-3 and CR-1 together.

 

Why not just do the CR-1 route and save some time and money.

You are filing and applying for a chinese national to be given entry to US benefits via a green card... Almost nobody in the US is going to expedite that. You have got the wrong lawyer if they told you otherwise... this is basic information and if they don't know this then you are wasting your money. Most lawyers deal with the world of consulates but have little experience with China.
