My wife received an RFE for her Removal of Condition.

 

We sent the below initially

 

Check for $590 to the Department of Homeland Security

I-751 Form

• Copies of the green card, driver license, social security, and student ID cards of (My Wife's name).

• Copy of the tax transcripts of our 2009 and 2010 joint US tax return.

• A letter from my company of the designation of my benefits to (My Wife's name).

• A copy of car insurance notice. (I am excluded due to high cost of insurance)

• A copy of our car finance summary, showing joint ownership.

• A copy of our Vehicle Registration Card showing joint ownership and common address.

• A copy of our Vehicle Registration Renewal Notice showing joint ownership and common address.

• A copy of our Mastercard and credit card statement showing a joint account.

• A copy of our hotel reservations for our Las Vegas trip in September of 2009 and April of 2010.

• A copy of our hotel reservation for our Laughlin, Nevada trip in July of 2011.

• Copy of our various casino players¡¯ club cards.

• A copy of my credit card statement showing airline ticket purchase for my wife¡¯s vacation back home and class tuition for her college.

• 24 pictures of us and our family and friends.

 

The RFE is asking for the exact samething that was sent.

 

We are a young couple and don't have enough money to move out so we do not have a lease or a mortgage. My parents is the typical Chinese that is afraid to sign anything related to the government so me making up a lease or rent agreement is out of the question.

 

We are living at my parents house and do not have a lease or agreements. We are living rent free at my parents.

 

My wife is a full time student so she is not working at the moment.

 

The only thing we own together is a car that we bought that I am currently paying off. I am also paying for her insurance.

 

We have a PO Box and all of my wife's important mail is going there, the only thing we get at my parents house from her is advdertisements like credit card offers, etc..

 

I am planning to send the what I sent initially and adding tax transcrips for 2011 and some more credit card statements. I paid Bank of America $10.00 to send me a letter about our joint account.

 

My wife did receive a letter from the SSA at my parents house as well as USCIS letters, should I send those as proof that she lives with me?

 

Please suggest what else I should include.

Momentary digression (please ignore)

 

Okay, David! With the two I've reported, this is now the THIRD (request for more and more evidence). You NOW have a TREND!

 

Others have reported similar experiences at USCIS recently - I am guessing this MAY be a political response to the Obama administration pressuring them for more rapid approvals. They can RESPOND now to any inquiries that your case was delayed for missing evidence.

In any event, simply COMPLY with the request to the best of your ability, even if it means re-sending some items you've already sent.

One note about 2011 transcript, that may take until June to get, so send them a photo copy of your return, (1040 + W2 + any 1099s)

Just resend what you sent and add in the SSA and USCIS letters. I think the question that USCIS may have which gave you a RFE is the fact that you guys have absolutely no lease or ownership papers for your "home" address, and your wife having a PO box for important papers. etc. I don't know of too many government agencys that trust PO boxes.

 

At any rate, it doesn't seem to be a big problem to overcome, and you guys probably wouldn't have gotten this "mosquito" bite if you had some form of a lease with your parents that the USCIS could have read. No biggie, it will all be okay.

 

That this is a "trend" of any sorts is a real stretch of the imagination. All of the cases cited had some minor question mark attached to them which gave them RFE's. And none of them were serious problems anyhow. Trying to make a case that USCIS is getting tougher, from this OP's and the other cases cited is nothing more than silly.

 

A trend? Hmmmm, maybe a trend that the USCIS has some alert and awake workers, nothing more. After almost 2 years in America these folks have no common lease, and important mail for the wife goes to a PO box???? Looks like a simple question mark about a case, no puffed up trend.

It's ALWAYS good to know what experiences others are having, whether they form a "trend" or not. In this case, a simple response to a simple RFE is all that is required.

 

For others who are beginning a process, perhaps more attention to their relationship evidence is called for.

 

No huffing OR puffing needed.

reason for the PO Box is no one is home all day and my mail box is near the curb so we wanted a secure location for papers with SSA numbers exposed, etc... kinda regret getting it now. I plan on slowly changing all of her addresses and have everything go to the house now and yea we are broke so can't move out even after 2 years....

Just a reminder, any time you change your physical address, you need to file an AR-11 and I-865, this does not end until after naturalization becoming a US citizen, or leaving the USA giving up residency.

We got a RFE today instead of the approval we were hoping for :(

We are in a similar situation as my house is paid for and all utility bills are in my name.

We owe no one money and the CC is in my name.

She does not work but does go to ESL classes at our local school, I'll see about getting a copy of her school papers from them showing our address.

 

Let's face it the days of mailing poeple information or receipts are about gone. Maybe she needs a Face Book account and friends to provide she exists!!!

 

The sheet did request something we had not sent them before, a copy of my drivers liscense.

 

We will resend all of the tax and finatial records along with new tax receipt of my house and vihicals.

I also have a freash letter from the state of Kansas to the both of use about our 2010 taxes and a copy of my 2011 Fed tax form. We will send new pictures of us with todays news paper and our house, friends and family!

 

I hope that does it.

Copy of US Citizen DL is normal, I included copy of mine and wife's DL.

 

ROC is all about showing living together, many items showing same address.

 

Call bank and get a CC in spouses name, we have several joint accounts, and is easy to order additional card in spouse name.

All this RFE talk has got me worried. My wife and I will file a week from Tuesday. I think we've got everything covered but we'll see I guess.

Just a quick note: I got my 2011 tax transcripts from the IRS. I file back in early Feb and requested it in late Feb. it took about double the normal processing time but I got 'em.

Make that four!

 

Make that FIVE. We just got an RFE letter today.

 

The morons at the California center sent the RFE letter on 3/5/12 to my old address (my parents house) even though I did a change of address and the I-751 clearly showed the new address. It got returned to sender, and the morons realized their mistake and I just got the resent letter today 4/2. Despite their screwup, they did not extend the RFE response deadline, and one month is wasted. To make matters worse, when I called USCIS hotline 2 weeks ago to check on the status of the case, they made no mention that an RFE was sent!

 

We're dealing with total imbeciles here. Good luck to all!

Is there a way for me to attach or post the RFE form letter we receiced. it would help others going into a I-751 to submit more than the I-751 instruction state. I must admit it asked for some things that I don't remember in the I-751, like the last 6 months bank statements, copy of my DL's....., This could be posted with the "Sticky" How To File An I-751 that I followed.

Use a scanner and save to a JPEG, then use a feee photo service like Photo bucket to save on the web, then paste the forum posting link provided there in a post here.

 

I use photo bucket.

 

Also black out things like case number and name on the RFE.

 

Note VJ should have example in their gallery but it looks more like one for AOS.
