Hi Sebastian,

Sorry it's the "State Department". Here is the message:

Application Type: I129F , PETITION FOR FIANCE(E)

Current Status: This case has been received from the State Department with a request we review it.

On February 24, 2009, a USCIS office received this case from the State Department with a request that we review it. We will notify you when we complete our review, or if we need something from you. WHEW ! Not the Department o Justice, afterall. If it was DOJ, then maybe they're mad at some GUZ officer ??? Or maybe there's a criminal charge ?

I was really worried, these guys are heavy hitters...

Sounds like a 'standard review' - but that's good - at least yer case is getting reviewed in a 'timely' fashion. If you are offerred a chance for 'rebuttal' - it'll come in the mail with specific instructions.

GOOD LUCK !

Wow 2 months for approval. That is great for you. You applied through VSC too!!

But really leaves me wondering about this process. My wife and I applied for K3/CR-1 through VSC in November also. We have not gotten approval. Maybe I should have been denied K1 first?? But seriously why such a difference and how can one take 2 months and I seen others take 1 year?

It's been much faster in VSC lately. Many people including me got their CR-1 approved within 2 to 3 months. If you look through the visa journey site, you'll understand what I meant. This is an important factor regarding the considering of the appeal for the K-1 denial.

Mei,

A recent friend of mine on K-1 was blue slipped on 2/18/09 because his fiance did not have his tax returns and w2's for 2008. Did you find out why your K-1 was denied?

The reason was "not a bonafide relationship". We used the tool free phone card to talk to each other. It's like 1.3 cent a minute from US to China and there is no record for all the calls. We only had a few emails and we also only have a few pictures of us being together. The biggest mistake we made was that I didn't go to China to go to ACH in Guangzhou. The consulate official asked to see my real passport( not a copy) from my then fiancee.

In summary, we were too naive at the time.

Thanks, I'll make sure I submit my 2008 tax return and have my W-2 ready before the interview.

  • 4 weeks later...

Hi all,

Haven't been here for a while. I have been busy with NVC for a few weeks now trying to collect all the doucuments. I just finished preparing our 2008 tax return. Yes, my wife is in the return and the W7 form is filed with IRS. Thanks for the advice from you guys and gals.

One thing I am surprised is that Packet 3 for China is actually delt with NVC in US and not the US consulate in China. NVC collects all the documents such as police ceritficate, etc. It then sends the documents to China and the consulate will schedule the intervew.

Still no news from the INS regarding the K-1 review, I will respond to the letter when I get a letter from INS regarding the result of the review of the K-1 denial.

I got everything ready to sent to NVC and will mail out today.

I will probably go back to Guangzhou with my wife in 2 months.

By the way, my name is Steve. Mei is my wife's name.

Hi Sebastian,

Sorry! Push the wrong button.

Yes, that's me in the "Visa Journey" site. I have been very active at the site.

I have sent everything to the NVC and the case should be completed very soon.

I am still trying to find out what else I should do to improve our chance at Guanzhou.

Steve
