Our service center is Vermont, and now it looks like it has become the slowest one, where they used to at least send out NOID letters and they were quickest with applications.

I'm certainly not dissing a NOID letter, but I'm not even gonna call the DOS, the NVC, or the USCIS to ask where it is. If they send it...okay, I will provide them with the new address in China. I had two different Congressional immigration liasons tell me that denied applications sent back to the service centers were at the VERY bottom of priority. :D

We have been planning this for a bit now, and our timeline is to try for an interview date for a DCF CR-! in Jan, Feb, March of 2011. Our son starts high school in July of 2011 and it costs a fortune for his private school, so the pressure is on to get married within the next 3-4 months so we can have the 2 years an IR-1 needs and an interview date as I said. We can await 3-4 months to come back to america should we need to for the 2 years of marriage time.

What the heck, it'll all work out and now we have pretty closely nailed our Plan B timeline.

George, it was good to see your plans work out, same thing with Chawls, I don't know how I could possibly make our next attempt stronger than by a DCF , yet, any way I choose to go about it, it all adds up to 2 years. :D But that 10 year green card Chawls woman got is SWEET, it's our goal too.

Let me say to anyone with a history of heart trouble within their family DO NOT TRUST the treadmill stress test, it is pure bullshit.

:D

Hey Tsap........the most important question is, will it pass the terlet seat test? :D

Agreed Ken, "will it pass the terlet seat test" is always the most important question cause if it won't pass the terlet seat test you may as well have a heart attack and get it over with.

Just curious,

When official notice is mailed to the petitioner of the denial, what reasons are provided to show the basis for the belief that the marriage is not "bona fide".

It is my understanding that the reasons must be based on fact, not opinion or suspicion. The guidance memos and Foreign Affairs Manuel require specific documentation for the basis of such a decision. Red flags do not form a factual basis.

I can only laugh at the absurdity of this whole F'ing letter, from the 4th word to the last sentence. :drunk:

After 10 months of waiting in blue slip hell our denial was given to us on May 21st of 2008.

Anyone want to lay some money of the petition getting back to Vermont before the end of this year? We got the same letter back in June of last year.... :coolthumb:

Some body wake me up when Vermont sends me a letter.

Dear visa applicant

The consulate has carefully evaluated your application for your application for an immigrant visa .The consulate is returning your petition to the U.S. Citizenship and services (CIS) via the National visa Center for review and possible revocation ,The Consulant visa section has taken this step because of the reason marked below, should you, the petitioner, or your attorey have any questions concerning your case, make a request in writing to the CIS office where your petition was originally filed, Do not contact the U.S. Consulate Guangzhou or submit any additional documentation,as the Consulate will not be able to respond to any questions regarding the status of your case.

The consulate has determined , based on your testimony, documents and any other evidence, that you do not have a bona fide relationship with your petitioner.

It certainly appears that way jimi. Your wife's experience at the interview in Guangzhou is just like my wife's. Tons of photo, email, chat logs, but nothing was seriously considered. The VO only glanced through the pictures, questioned my wife about her lack of English and then told her too bad and gave her a blue slip. Then I started emailing Guangzhou asking them what other evidence did they need to approve a visa. I was told that the blue slip was just a temporary denial while my case underwent administrative processing and that the consulate would not accept any additional information while the case was in administrative processing. Then in December my wife gets a white slip. I made repeated attempts to provide anything the consulate wanted or to answer any of their questions, but they refused.

That is what really pisses me off, because I tried to intervene before they returned my petition to the NVC. The consulate even blew off my Senator and Congressman.

But rules are rules and policy is policy. I just do not understand how the consulate can blatantly violate policy and get away with it. Not only is it "American Communism" it is UNAMERICAN!!

Trap,

when you refile, pay special attention to section D-2 where they ask if you filed before, make sure they know in no uncertain terms that they KNOW that the woman which they determined you did not have a bonified relationship with, has been living with you for X number of years. Really stick it in their face that they messed up.

As far as being in China, my wife has ben after me to retire from the VA once I get past the 20 year mark for government service and we have paid in what I would have during my military time had I paid into the retirement account. Once we get that done, if I haven't yet gotten a better position, she wants me to retire and move to China and teach English in her home city. We might just see you there.

Carl, believe you me, I can't wait to politely stick that point so far up their dumb-asses that they'll think they're eating yesterdays lunch...AGAIN. :sosad:

They speculated and conjectured our application like a bunch of criminal thugs...screw it, it's just too toxic to talk or think about it sometimes. :(

Everyday of my life, now, I work, writing reports or going to see the VA mental health doctors and workers. The VA and SSDI is gonna pay through the nose for the DOS's criminal mistake and criminal activity on our case.

I've just gotten my SSDI on the first try (a miracle) and last October I was awarded 50% (a nice start) Service connected for PTSD...in the next few weeks I'm headin' off for Coatsville, Pa. VAMC for their 4 to 10 week PTSD in patient domicilary. They have one of the oldest PTSD clinics in the nation...if I need to stay there for 10 weeks, I'll take it like a man. :)

You work for the VA, you understand exactly where I'm headed...and I've got the combat background from those blood drippin' Huey's to warrant 100%. It's the only reason I am in america today. :)

Yes, I'm gonna stick their mistake in the criminal DOS worker's faces, with our evidence and a DCF from China, and dear ol' Uncle is gonna pay for every dime I spend to do it.

That's my plan, and the lil' rabbit and I are committed to it. :D

Carl, I am so thankful for everything the VA and the people like yourself who work for them have done for me. My hat is off to you buddy. I wrote letters of appreaciation for the nurses and doctors, and the physical therapy workers in the rehab hospital I was in in Aspinwal, Pa. VAMC, and I clowned around with the service people and let them know, everyday, that I appreciated what they were doing....my God they treated us like kings, it was very humbling and completely opposite of the VA I knew in the late 70's.

Good luck if you should retire to China. I look forward to spending some time there but I will never give up my wife's dream of at least experiencing america. We'll keep our house in China when we move to the states in 2011...in case a certain lil' rabbit sees america isn't everything she dreamed it would be. :o

Thanks for your service, Carl. :)

heya TSAP - before you jump off to the next treatment center - any thoughts about getting some kinda laptop, to take with you, so's you can keep in touch with us here? (and also finish up writing the stuff you need to write on yer various cases). Might be a good idea to get a 'data plan' from yer fav cell provider, for a few months.

Darnell, you are one aware "techie". :o

This stay will not exactly be a stay in "the cuckoo's nest" but it's not a private hotel room either. It's like a rehab for drugs and alcohol, only it's primary purpose is for PTSD. I gotta be focused intently for the 4-10 weeks...this is the most important thing I can be possibly be doing right now.

This is the last case I'm workin' on now so I'll only have my trusty writing pad with me. :sosad: I'll have to miss you guys again, but I'll be back. If I'm allowed a cell phone I'll call cuzin' Chawls...and tell him how I helped the "big Indian" throw a sink through a window and escape. :)

Hopefully I'll get an approximate time tomorrow or Wednesday...if they think it's gonna be a month of two to get me a bed then I'm hightailin' it to Liaoning provence to get married in Shenyang.

Tsap, sorry to hear the latest. The blessing is that you already have plan B well under way.

It is unbeleivable the delays some have to go through and in your case, no real reason. Well, as myself and Chawlz went through the test of time, you shouldn't have any problems with DCF, it is hard to deny a DCF as you know.

I wish you nothing but the best as you move forward. You had your surgery and you are in very good shape which everyone here is very happy to hear.

Go git you Lil rabbit an marr her. forgit whtz Uncles Sam says. This will only make you and the little one closer.
