i got an actual reason for my denial

well after 2 weeks of hounding the Guz,I finally got a reason for my denial,after 2 weeks of a generic letter,I got an honest to God human,perhaps even with a heart.can you believe it? Anyway,i think a supervisor(is there one there) who actually looked it over,i kept asking for one to look it over.anyway they said,once a officer denies it ,they can not accept any more evidence,so at this point,i think i will back off,and now concentrate on my CR1.however,the reason is my divorce,and sudden marriage,i of course have been seperated in january 2006,applied for divorce in feb 2007,but i had to take a class on "children of divorce.and then the judge had to sign it off,which was in may.and of course i met my wife june 2007.so there you have it

an actual reason,of course having looked over my petition,the wife and I,speculated,this was probably the reason,but it has been confirmed

my question now is,how do i overcome,if it turns out like her first interview,where they wont accept any evidence(divorce records,etc).

can I stick this in my CR1 packet,the ds-230 i think is what i have to send in next,i mean i know the CR1 is already approved,but if it gets put into the file,maybe guz will read it.or is this a bit goofy.

Sounds funny to me. I met my Chinese fiancee/wife in April and we corresponded until my first visit in October. My first divorce was final in August of the same year. We didn't have any problems and my fiancee/wife got her visa in November the following year. All this took place in 01 and 02.

Well,like i said before on here,nothing is consistant about this process,thats why i often bend out of shape when people say,this is the system,you have to follow it yada yada yada.

and in reality there is no system,it is chaotic,people mean well,so i am not attacking them, everyone on here has been great,gods honest truth,but when a woman gets her visa,with a few emails,a few photos and if i am not mistaken,her husband only took one trip,and shes telling everone,yeah its easy to get the green card.in other words ,she was doing it for the green card.And then people,tell me this so called system is to catch bad guys,thats funny.and again,everyone means well,but until you been down this road,you don't know what its like,to be judged in this manner,because my wife and I are not bad guys,so it may sound funny,but Geez,what can I do,I just happened to be picked to walk down this road. So,I have to play devils advocate,or step back for a moment,and look at the facts,it is a fact,on my application,you will see,divorce may 2007,met wife on june 2007,met and married on first trip september 2007.without any other facts,i can see how this looks strange.However,where i get frosted is, had they had all the facts,it would look like a different picture.to make any judgement of any kind,you must have all the facts.whether you getting ready to bring someone to court,on trial,or to do a complex science experiment,like trying to buld the atom bomb without all the data,or making a cake without all the ingredients.......i mean,yeah it sounds funny,but these are the cards i am dealt with for now.so hopefully next interview,my wife can paint the rest of the picture,change a black and white picture into color,and maybe the VO will say Ohhhhhhhhhhhh

now i get it.

In your case you had a longer period of communications before and after meeting. (8-9 months (Apr - Nov)) then another 9 or more months after meeting. You knew your fiancee well before your divorce was final.

 

In op's case he divorced, then met his wife online and married within a very short period. Evolution of relationship: Divorce final May 07, Met online June 07, Travel to China Aug 07, and marriage September 07.

 

Unfortunately this is a big red flag (Shortness of time from meeting online to marriage).

I emailed them everyday,I told them I wanted a supervisor to look over my case.I made sure to let them know I was an american citizen,(important,to let them know this)A thing everyone seems to forget,tell them your an outraged an american citizen,because the way they wash away their errors,well the beneficiary is not a citizen,she has no rights,in fact,it states on your NOA2,a visa is not guareenteed,ah yes,but you my friend,you are an american citizen,something forgotten in this process,I told them to give full access to my congressman and senator.so we can get to the bottom of this.My last email,i wrote a pretty heart wrenching story,what my wife and I do every day and night to show we love each other, compared to ,How most american couples come home plop themselves on a couch in front of a tv set,hardly saying a word to each other all night,and this is called a relationship.And each night when i come home,my wife and i are excited to sit in front of a computer screen with a webcam and a microphone,and share our dreams,and hopes.And then we shut down our computers and go to bed and cry ourselves to sleep.This of course is my story,you will have to tell yours.I can Email you the actual email i sent,but you got the idea,and just maybe you will finally reach someone with a heart,and do i dare say....."feel for you" because Brother you and I know this is totally wrong,something know one on hear can truely understand,except for those of us who have been subjected to this"trying to catch the bad guys"

give it a shot,be firm,but not combative,or threatening,of course polite,tell them also,that this affects not just one person,but two lives,one of which (again)An american citizen.And that other person,at least in my case IS Legally my wife.See,what is happening,to them its just a job,the woman that walks in for the interview,look!!! i am sure they have seem some winners,honest to God scammers,ones truely after the green card,and after awhile they become numb,to them all these woman who happen to be our wifes/ girlfriends ect...They walk into the interview, they are looked at as dirt,i am sorry to put it this bluntly,....to them,these woman must be all looking for the so called almighty green card.could they actually be in love ? Ah there all a bunch of liars.Did you read my last post,one guy came on "inquisitor" his comment was.....if you could only speak english and hear what the "wives" are really saying amongst themselves....insinuating again all are this way !!!! this is what we are up against,this is a real mindset....look I been on 001 website,i have heard some horrifying things,but......i hear also nice things....You and I know there are bad guys out there.....but when they catch a good guy and say thats a bad guy(i am using guy generically speaking,of course i am talking about our dear wonderful ladiesWho have been treated badly)

for the most of 2 weeks i got generic letters,your case is being sent back to USCIS for possible revocation(am i spelling that right?)well, you know the letter.

Anyway give a shot.see what you get.

Everybody's background is quite different. I believe the following factors influence the result of interview:

1. Figures on Income Tax Return

2. Communication and presentation skills of the beneficiary, homework by the petitioner.

3. Time gap between your previous marriage and current relationship, how many marriage records the petitioner or beneficiary have

4. Age difference

5. Whether the petitioner has brought any alien to the US before, whether the beneficiary has got visa denied before by any western country

6. Whether the petitioner or beneficiary has any records of being arrested, being charged of something

7. Whether the beneficiary is from Fujian or TaiShan, how many children she is bringing to the US.

8. Luck. Different VO screws different weakness you have. Different weakness is screwed in different time of the year.

consistency is not a part of this visa process.... I divorced a chinese woman officially in May 2006(we were separated 8 months), and married my current wife June 2006(I already knew my wife fore 2 years at that points as friends)... filed cr1, july 2006, waited and waited for almost 2 years... then finally filed a WOM against the federal agencies, and finallly got a approved petition.

 

Problem is with yours is you got denied at Guz and you can't file anything against them. It sounds like you are doing the right thing by just filing the CR1, it will take a little longer, but you will have put in your time, and I beleive they want to have proof of your sincerity by suffering and enduring for a longer time. Just be patient and it will happen... Just ask my friend Chilton...he's a happy man today.... heck over 2 years after filing a cr1,.... me too :doorscared:

whats the cost for Marc Ellis?

 

It varies with the complexity of the case. I am sure he will be happy to discuss this with you. I found him to be very reasonable.
