Remember the guy who had his wife arrested?

The people on 001 asked if anyone in the Jersey area could help this woman, so Zhen & I have been talking to her. It's a little difficult to understand 100% (her English is fine, its just she cries so much) but from what I can gather, her husband has left her & her son to fend for themselves. They have an apartment until the end of this month, she is working until the end of this month, after that she will be out of luck. She wants to know how/if she can apply for the Green Card & Work Permit on her own if necessary?

I'm not positive, but I think she said her husband had filled out both applications & had her sign them, but she didn't know if he ever sent them in... {there were posts by him [profpsy?] at one time on this site where I believe he said he wasn't going to send them, but I can't find them now} anyway...

If he did send them, she has never received anything in the mail about them. If he did not send them, she wants to try to do them herself. Her 2 main questions are:

1) If they were filed, what should she do to see their statuses? Keep in mind she has no receipt numbers...

2) If they were not filed, can she do so herself & how? I believe the husband needs to send them in, correct? But she entered the relationship in good faith & now he's split...

Any help you could give would be greatly appreciated, thanks much in advance.

umm.... I remember this a little

 

 

She can call USCIS to check her status, if they filed there must be records, she can use the A# from her K-1 NOA2 or her I-94.

 

Sorry it did not work out for them.

Better yet, try to see someone at USCIS and schedule an appointment to see whether he submitted documents to them. Either that, I would try to find an immigrations lawyer. He brought her over here, he should be made responsible for his own actions. Any man that abandons a woman for the hell of it is a real coward.

Assuming he never sent the papers in for her - yes she can apply for herself. Whether she is approved or not is another story. But she will legally be in the country as long as her case is still open. Whether she eventually gets the green card may very hinge on whether she can claim abuse or not. I would think that, under the circumstances, this would be fairly easy. She can also, at least temporarily, get a work permit.

 

If the USCIS denies her application, they will not have her removed. They will go to court for this. She will have a chance there to explain her case to the judge.

 

All this takes money, of course.

Will this be looked at abuse or abandonment? Without a police report confirming abuse it may be difficult to show a case in her favor. Her place of employment is also providing a place to live ?Not to stick it to her landlord it would take a month or two to have her evicted. Maybe she has some breathing room there. Look into some churches for help. As others have mentioned it is time for an hour visit with an expert in this matter.

Please be careful with this case. This woman has a bad situation. However there are a few of us out there that are close to this situation and know what has happened. All I will say is beware of all the tears and poor me talk. There are 2 sides to this story, many people have tried to help this woman and her son with money, a place to stay, marrage counceling to mention a few. Her behavior is a problem for her, I hope she can make her life better in the future

Well, we're not trying to give her money or a place to stay. From what she has said, she wants to be able to support herself & son. All she has asked is to find out how to pursue the Green Card & Work Permit without his help. If you'd like to PM me & explain what you've done for her that she did not appreciate, that would be great, but we'd like to be able to give her the answers to her questions if possible.

A infopass will be of no use if nothing has been filied, she needs to call USCIS first with her A# and ss# see if anything has been filied.

 

my suggestion is either she can do this herself or get a attorney.But for AOS I suggest a very good lawyer

I remember the story well. I read all of his posts here with great interest. I don't recall much of anything that would make me believe he is completely innocent. She has some anger issues but so does he. By having her arrested he bollicked up her AOS severely. There were also some issues of him not working, spending all the AOS money and other things. IMO her case is too convoluted to try and do on her own. She needs an immigration attorney. Abandoning her is in her favor but the arrest record may be difficult for her to overcome. I wish her and her young son well.

The truth is this woman has the receipt number of her case and checked it every day. They just got the finger print down at July 21st. Everything is going well.

Also she already found a place live for free from the people she knows here.

 

I didn't see anything wrong with her and wonder how can she print her story in a whole different tone than the truth.

 

Anybody knows her truth color will not buy her story--that's why she got herself to a position now.

If she can get her status adjusted, then all is well. I expect that she can, hopefully without having to hire any lawyers.

Then she is set - he's already filed the AOS for her. The only thing she could be worried about is WHERE the greencard is shipped to. Would her husband destroy it if it showed up at his address?

But two things could potentially happen -

 

1) She could be denied if her husband doesn't show up for the interview and she is unable to claim abuse - time to head for a lawyer and a court hearing

 

2) He can rescind the I-864 up until the interview

 

She can change her address easily enough, and get a replacement if they still happen to send it to the old address.
