i-693 for aos application

Recommended Posts

hello to all. i'm trying to working out wedding, honeymoon, and filing aos plans for after my honey arrives. since we will get married about 60 days after she arrives and we will have a short time to file aos papers, i was wondering if it's possible to visit the civil surgeon before we marry and get the i-693 filled out? this would certainly make it easier to file the aos in a timely manner. thanks for the help.

Yes - but there is no 90 day deadline for the AOS application.

you are not eligible for adjustment of status if any of the following apply to you:

F. You failed to maintain your nonimmigrant status, other than through no fault of your own or for technical reasons; unless you are applying because you are:

. . .

2. A
K-1
fianc¨¦(e) or a
K-2
fianc¨¦(e) dependent who married the U.S. petitioner within 90 days of admission; or

. . .

from the I-485 instructions

Yes, there is no requirement to be married first to gather any of the information for AOS. The only requirement is you must get married within 90 days. You can file outside of the 90 days without worrying.

Also, just a note, you only need the vaccination supplement. Don't get sucked into paying for the whole form when you don't need it. Most CS's will try to get you to spring for the I-693 when all you need is the supplement. I got Lisa's done for nothing. Other's have had to pay $25 dollars for the surgeon's time.

thanks for the reply. please correct me if i'm wrong but isn't it a new requirement to file out the i-693 and include it with the aos app? the 693a vaccination supplement is no longer listed on the forms page of uscis. it says to only have the vaccination section filled out on the 693 if you have had medical within the past year. i think they recently revised the 693 to include vaccination info and discontinued the 693a supplement. is this correct or am i confused again?

You are not only correct and confused, but you are in 100% agreement with what he said and confused.

Confusion is optional

Just looked at the I-693 instructions. My mistake. Yes, they changed it and made it all part of one form.

They may have made it all one form but the instructions still say if a K visa has had a medical within a year of filing another medical exam is not needed. Only the vaccinations.

What if I am a K nonimmigrant visa holder and already had a medical exam overseas?

If you were admitted as a:

A. K-1 fianc¨¦¡¯(e) or a K-2 child of a K-1 fianc¨¦¡¯(e) or as a

B. K-3 spouse of a U.S. citizen or a K-4 child of a K-3 spouse of a US citizen and

C.You received a medical examination prior to admission, then-

a.You are not required to have another medical examination as long as your Form I-485, Application to Register Permanent Residence or Adjust Status, is filed within one year of your overseas medical examination.

b.You will. However be required to complete Part 1. Information about you and submit the vaccination section of Part 2 with your adjustment of status application. A designated civil surgeon must complete the vaccination section and Part 5. the Civil Surgeon¡¯s certification

There was never a "693a" available at USCIS, it was a CDC from. USCIS has updated the I-693 with specific instructions to doctors to do just the Vaccination part of the form for K-Visa holders.

If I am reading this correctly, as long as the K-1 visa holder complies with the requirement to get married within 90 days of arrival, then AOS can be filed whenever convenient? Is there any time limit on when the AOS must be filed after the expiration of the K-1 visa (expiration meaning "marriage" or 90 days after arrival)?

You may have some explaining to do at the interview if you take longer than 6 months, but there are many of us who took 90 days to 6 months, and even a year.

dale7570, Didn't you have to get the 693 done for the interview in GUZ?

we havn't had the medical exam yet as i am trying to plan ahead for aos. we have received the p-4 and several medical forms, but no 693. apparently the consulate doesn't use the 693.

The I-693 is furnished by the exam clinic, and is a required document for all visas

Here's the form and instructions

http://www.uscis.gov/portal/site/uscis/men...00045f3d6a1RCRD

But your paperwork follows you around. The IO at the AOS interview will already have the I-693 from the GUZ medical exam. In fact, your SO carries all the paperwork from GUZ to the IO at the Point of Entry in another sealed envelope

Part 2. Medical examination (Continued)

5. Vaccinations (See Technical Instructions at http://www.cdc.gov/ncidod/dq/civil.htm for list of required vaccines.)

is for the vaccinations. This part only (on a new I-693) will be filled in by the US Civil Surgeon. He will give you a sealed envelope with the new I-693 in it.

Your AOS file will contain 2 I-693's = one from the medical exam in China, and one from the US Civil Surgeon for only the vaccinations.
