question concerning letter of relationship evolution

ok..i know i have read about this before...just want some clarification...i have submitted this letter (signed and notarized) along with the I129F.....i will write another letter, a current and updated one, for when she needs next.....my questions are....when will she need this letter?....when sending in the p3, p4 or just to have when she goes for the interview?....also..what is best?...typed or hand written?..just one page?... or is more than one or two or three acceptable?.....just is difficult to write all the things on one sheet of paper....especially after having been there so many times..have many things to write about....my thanks to everyone who has input on this for me....steve

This a great question that we both must be thinking after reading about clearbluesky and there blue slip!!

 

I asked at DOS about what will happen when my NOA2 expires, it did back on 12/23/2007!!! The visa specialist suggested I make up another letter stating we were still going to get married when she gets here, even though I did with my original I-129F as per my lawyers instructions. I am going to add a one page letter with our time line together, going to keep it simple and to the point, do not want any questions asked she could not handle?

Yes, but most times it is only asked for in overcome if needed at all, but sometimes it is accepted at interview too and sometimes not accepted at all even if offered.....also..what is best?...typed or hand written? Handwritten seems to be what is asked for in overcome..just one page? Yes... or is more than one or two or three acceptable? No, it is to much of a burden to read by the VO and you also offer to much information to verify.....just is difficult to write all the things on one sheet of paper....especially after having been there so many times..have many things to write about Only the facts are needed (if at all), not a love story. Again, the more you tell the more you open yourself up to verification (read: DELAY), why take the chance.....my thanks to everyone who has input on this for me....steve

Here is my take on this issue, that is comprised of two separate components, which sometimes may be confused:

 

Some, in the past, have had a ¡®letter¡¯ ready to submit to the VO, along with the petitioner¡¯s US passport, at the beginning of the interview. This letter was more of a letter of introduction, rather than a more involved, evolution of relationship letter. Most have kept it concise, to fit on one page, as the VO is not going to have the time to read a ¡®short story¡¯ at the interview window. As I stated in a previous post, I have a friend, who went through the interview earlier last year, and who has great difficulty writing. He asked me to prepare for him, a letter of introduction (his own thoughts) which basically outlined who he was and how he felt about his wife, who was now before the VO. I will tell you that in this case, the VO did read the (one page) letter. And, according to my friend's wife, it was received favorably and commented on by the VO, and the interview was quick and painless. The letter was typed and his signature notarized.

 

With respect to the separate issue of a longer, maybe more than one page, evolution of relationship letter, I would suspect that the most appropriate vehicle would be the I-129F, for those who are going the K-1 route, and both the I-129F and the I-130 for those who are going K-3.

 

While there is no specific request within the guidelines for this document, many are now doing it, based on recent comments and interview experiences. Moreover, I think this could most appropriately be considered a component (item #6) of the new information being requested on the I-130, in the ¡®evidence of bona fide relationship¡¯ section, which was added to the list early last year. My feeling is, if prepared properly, this letter can be an important document within one¡¯s petition.

 

I thought long and hard about all of this and I included an evolution of relationship letter, within both my I-129F and I-130, and added it in each table of contents. My thought (early-on) was that most likely, my two I-130¡¯s would never end up in GUZ, and only the I-129F for K-3 and 4 would be pursued; therefore, I wanted it available for each step of the review process (USCIS and NVC) and most importantly, for the VO to have, prior to the interview. The length of one¡¯s letter will, of course, be determined by the length of the relationship. Mine was a little over two pages, as I had known my wife for over 2 years, I had made several visits to see her, and had been married for several months, by the time I submitted my I-129F for K-3 and 4.

 

Again, this is only my view of things and my opinion. We each must make our own assessment and follow our own instincts, in this regard.

3. First trip passport, ticket stubs, pictures and any misc. stuff.

4. Second trip with same as first trip.

5. Third trip with the same as other trips.

6. POE which is Chicago.

7. My city with photos of my home.

8. Daughter's school pictures.

9. Church where we will be married!

10. E-mails by time frame, beginning, the middle ground, latest ones!

Will continue to add stuff, but trying to make it easy for her to show the VO !

WOW! Excessive kitchen sink of what not to bring things for the interview and try to show to the VO.

 

Your fiance is not that strong to carry all 37lbs inside the 5th floor, and the VO does not want/have the time to see all of this non-needed stuff at her interview. Maybe some could be needed if you get blued out for the overcome later on, but not now.

 

1. NOA1. Not needed because you already received the NOA2.

2. NOA2. Not needed because you would not have got to GZ if you did not have approval. You will need it for AOS though later.

3. First trip passport, ticket stubs, pictures and any misc. stuff. Ok.

4. Second trip with same as first trip. Ok.

5. Third trip with the same as other trips. Ok.

6. POE which is Chicago. Why and who cares?

7. My city with photos of my home. VO knows your address already and who cares about a photo of your home without the 2 of you in it to show at interview time. You want your fiance to get blued because she doesn't know something in the picture you want her to give to the VO.

8. Daughter's school pictures. China daughter with you in it is good. USA picture of your daughter without your fiance in it is useless. Again, do you want her to get blued because she doesn't remember some fine detail about the picture the VO maybe will ask of her?

 

9. Church where we will be married! Again, who cares, as you are supposed to get married in the 90 days per visa/USCIS law. It is fine to make some plans with a general answer in case she gets asked when you will get married. Answer should be after I get my visa and we arrive in the USA, then we can make our plans. Don't get blued on a church address, priest name, color of the windows, etc...

10. E-mails by time frame, beginning, the middle ground, latest ones! Ok. Remember phone records and letters with post marked envelopes too if you have them.

Sorry to be so blunt, but you have the overkill of a cannon for the simple use of a spit ball gun. Go back and read the actual interviews again for the last year. Then look at what could be possibly even asked for at interview, not submitted later on overcome. While you are doing your best to provide for your fiance, you are also potentially setting her up for failure (needless questions asked of her which she will not be able to answer and you will have to provide information on at the overcome). Remember that everything that you or she submits is open to verification by GZ.

 

Example question:

 

VO: the gutter on your fiances house sure looks pretty clean in that color, when did he paint it?

 

Fiance: Huh?

 

VO: Blue slipped for not knowing about your house. Now you need to provide a receipt on when you painted the gutter and why your fiance did not know about it.

 

No more examples are needed, you get the picture.

 

She probably does not speak as good as English as you think she does and remember everything you are pumping at her, and she will be as nervous as heck, regardless what anyone else tells you about their interview. Let her remember what she needs to know, not what you think needs to be in the famed kitchen sink.

I agree with Mike. It's great that you're so well organized and have all that stuff ready for her. But definately SAVE IT. If she needs it for overcome, she'll have it. But like Mike says, anything over and above the required info opens her up to extra scrutiny. Not to mention putting added stress on her trying to remember where all that stuff is in the middle of an already stressful event.
